These Boat Transfer Terms (“Terms”) apply to point-to-point boat and sea-transfer Services coordinated, arranged, reserved, booked, scheduled, or otherwise assisted by D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).

These Terms are intended to clearly explain: the scope of a boat-transfer booking; DPTT’s role as a travel coordination and booking agency; the operational responsibilities of the independent boat or maritime Provider; booking and payment requirements; passenger manifests and identification; boarding, meeting-point, waiting-time, and baggage rules; weather, sea-state, tide, port, and government-related changes; passenger safety responsibilities; delays, substitutions, cancellations, and refunds; maritime and travel risks; incident and emergency procedures; and the allocation of responsibilities among the Client, DPTT, the independent Provider, and relevant authorities.

Please read these Terms before paying for or boarding a boat transfer.

Booking, reserving, paying for, confirming, participating in, boarding, receiving, using, or otherwise availing a boat-transfer Service through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms and all other applicable Agency policies, procedures, company processes, Provider requirements, safety instructions, and regulations.

If anything is unclear, contact D’Palawan Travel and Tours before making payment.

If you disagree with any applicable provision, do not proceed with the booking or Service.

1. Definitions

“Agency,” “DPTT,” “we,” “us,” or “our” means D’Palawan Travel and Tours.

“Client,” “Passenger,” “Traveler,” “you,” or “your” means a person who inquires about, reserves, books, pays for, boards, participates in, receives, or is included in a boat-transfer booking coordinated through DPTT.

“Provider,” “Boat Provider,” “Transport Supplier,” or “Independent Provider” means the independent boat operator, vessel owner, maritime transport supplier, captain, operator business, or other independent party responsible for delivering the sea-transfer Service.

“Vessel” means the boat or other lawful watercraft assigned by the Provider for the transfer.

“Boat Transfer” or “Sea Transfer” means point-to-point transportation by water where the principal purpose is to transport passengers from an agreed START location to an agreed END location.

“Booking Confirmation” means the written or electronic confirmation, message, itinerary, receipt, voucher, invoice, acknowledgment, or similar record identifying the confirmed transfer arrangement.

“Official Channels” means the telephone number, email address, website, and authorized messaging or social-media accounts identified by DPTT.

“Calendar days” means consecutive days, including weekends and public holidays, unless otherwise stated.

2. Scope — Point-to-Point Sea Transportation

These Terms primarily apply to point-to-point sea transportation where the main purpose of the booking is to transport passengers from one location to another.

Covered arrangements may include: port-to-port transfers; island-to-island transfers; port-to-island transfers; island-to-mainland transfers; transport between beaches or coastal communities; transfers involving coastal barangays or towns; shared or joiner sea transfers; semi-scheduled maritime transportation; private point-to-point transfers; alternative routes required by operational circumstances; and emergency diversions, alternative landing points, or early disembarkation required for safety or compliance.

3. Boat Transfers Included Within a Tour or Travel Package

These Terms also apply to a point-to-point boat-transfer component that forms part of a larger tour, travel package, or other travel arrangement coordinated through DPTT.

In that situation, these Boat Transfer Terms apply to the sea-transport component together with the applicable: Travel Booking & Service Terms and Conditions; Tours, Travel Packages, and Service Waiver and Liability Disclaimer; Booking Cancellation, Rescheduling & Refund Policy; Booking Confirmation; Provider requirements; and other applicable Site Policies.

4. Boat Transfer Distinguished From Boat Rental or Island-Hopping Tour

A point-to-point boat transfer is different from a boat rental, charter, or leisure itinerary whose principal purpose includes discretionary sightseeing or multiple recreational stops.

These Boat Transfer Terms do not replace the separate Boat Rental With Captain: Terms and Conditions terms where the Service is primarily a private rental, charter, or recreational boat arrangement.

Likewise, where a Service includes activities such as: island hopping; multiple sightseeing stops; snorkeling; swimming stops; beach hopping; recreational anchoring; fishing activities; lagoon visits; or other leisure activities, the applicable tour, boat-rental, Provider, and liability terms may also apply.

5. D’Palawan Travel and Tours’ Role

D’Palawan Travel and Tours operates as a travel coordination and booking agency.

DPTT may assist with: identifying available transfer options; checking Provider availability; requesting quotations; coordinating reservations; collecting passenger information; communicating manifest requirements; communicating meeting points; relaying schedules or departure windows; coordinating payments; transmitting Provider instructions; communicating operational changes; and providing reasonable booking assistance.

The actual sea-transfer Service is performed by the independent Provider responsible for the particular booking.

6. Provider Operational Responsibility

The Provider performing the transfer is responsible for operational matters within its control.

Depending on the transfer, these may include: vessel assignment; vessel readiness; vessel maintenance; captain and crew assignment; crew qualification requirements; passenger capacity; cargo and baggage limitations; boarding procedures; safety procedures; life-saving appliances; route selection; departure timing; weather and sea-state assessment; landing and disembarkation decisions; fuel requirements; operational documentation; Provider-side permits and registrations; compliance with maritime requirements applicable to the Provider; and real-time safety decisions.

DPTT’s coordination of a reservation or transmission of information does not transfer day-to-day operational management of the Provider’s vessel, captain, crew, equipment, or maritime operations to the Agency.

7. Independent Provider Relationship

Boat Providers generally maintain their own businesses, personnel, vessels, procedures, registrations, policies, and legal responsibilities.

A booking, referral, commission arrangement, or coordination relationship between DPTT and a Provider does not by itself create common ownership, employment, partnership, or joint operational control.

The Provider remains responsible for the maritime Service it performs to the extent provided by applicable law.

8. Remote and Limited-Service Locations

Some islands, beaches, coastal communities, and remote locations may have limited transportation availability.

In some circumstances, the Client may specifically request assistance in identifying an available independent boat owner or local transport Provider for a requested route.

Where DPTT assists with such an arrangement, the Client should request clarification before paying if any particular requirement relating to: Provider registration; vessel documentation; insurance; crew credentials; vessel type; equipment; route experience; or other Provider qualification is material to the Client’s decision.

9. Booking Is Not Confirmed Until Acknowledged

An inquiry, quotation, availability request, preliminary itinerary, or payment instruction does not by itself guarantee a confirmed Boat Transfer.

A booking becomes confirmed when:

  • the Agency or relevant Provider acknowledges that the reservation has been accepted; and
  • any required payment, deposit, passenger information, or other confirmation requirement has been completed and verified.

Until confirmation, availability, price, schedule, Provider, vessel, meeting point, and route may change.

10. Acceptance of All Applicable Terms

By making a reservation, deposit, partial payment, full payment, confirmation, appearing for boarding, boarding the Vessel, or otherwise availing the Boat Transfer, the Client accepts: these Boat Transfer Terms; the Agency’s applicable Site Policies; the applicable Booking Confirmation; Provider operating rules; manifest and identification requirements; port and authority requirements; safety instructions; Agency processes applicable to the booking; and other lawful regulations governing the Service.

If any provision is unclear, request clarification before payment.

11. Day-Before Reconfirmation Is Required

Clients with advance Boat Transfer bookings must contact D’Palawan Travel and Tours on the day before the scheduled transfer to ensure that the booking has been properly acknowledged and to obtain the latest operational information.

The Client should provide or verify, as applicable: full booking name; transfer date; START location; END location; passenger count; meeting or pickup location; contact number; accommodation information where relevant; special requirements already disclosed; and other information requested for coordination.

Reconfirmation is particularly important because weather, tides, sea conditions, mobile-signal limitations, port instructions, Provider availability, and meeting points may change close to departure.

12. Latest Instructions Control

Clients should rely on the most recently confirmed operational instructions rather than solely on: an old quotation; an earlier screenshot; a preliminary itinerary; an old meeting point; a promotional page; general website information; or an earlier estimated departure time.

Where conditions change, the latest lawful and reasonable Provider or authority instruction applicable to the transfer takes priority.

13. Passenger Manifest Requirements

Boat transfers may require passenger manifests for operational, maritime, safety, port, or government purposes.

The Client must provide accurate and timely passenger information requested for the booking.

Depending on applicable requirements, information may include: full legal name; age; date of birth; nationality; gender where specifically required; identification information; passenger count; and other information required by the Provider or authority.

14. Accuracy of Manifest Information

The booking Client is responsible for checking the accuracy of passenger information before submission.

Problems may arise from: incorrect spelling of names; wrong passenger counts; missing passengers; incorrect ages; missing identification; late submission; inconsistent information; or other inaccurate booking data.

Incorrect or late information may cause delay, additional processing, penalties, denial of boarding, or inability to provide the Service.

Refund consequences are subject to the Booking Cancellation, Rescheduling & Refund Policy and applicable Provider rules.

15. Identification

Passengers should carry valid identification required for the transfer.

Identification may be requested by: the Provider; port personnel; the Philippine Coast Guard; local government authorities; protected-area personnel; law-enforcement personnel; or another competent authority.

A Client who cannot satisfy a required identification procedure may be denied boarding or delayed and may be treated in accordance with Provider and Refund Policy rules.

16. Government and Maritime Requirements Take Priority

Boat Transfers remain subject to lawful requirements issued by competent maritime, port, local, environmental, or government authorities.

These requirements may affect: departure authorization; passenger manifests; vessel capacity; boarding cutoffs; routes; landing points; inspections; baggage; dangerous goods; protected areas; operating hours; weather restrictions; and other maritime operations.

Lawful authority requirements override Client preferences or earlier preliminary arrangements.

17. Meeting Points and Boarding Locations May Change

Coastal and maritime meeting points may need to change because of: tides; wave conditions; wind; port congestion; docking restrictions; beach conditions; weather; authority directives; no-waiting rules; vessel access; safety considerations; or other operational circumstances.

The Client agrees to monitor Official Channels and reasonably cooperate with updated meeting or boarding instructions.

18. Pickup and Drop-Off Points

The controlling START and END locations are those identified in the applicable Booking Confirmation, subject to lawful and reasonable changes required for safety, maritime conditions, or authority compliance.

A transfer described using the name of an island, beach, port, town, or barangay does not necessarily guarantee boarding or disembarkation at any specific dock, beach position, jetty, or exact geographic point unless expressly confirmed.

19. Waiting Time and Cutoff Rules

Waiting-time allowances and boarding cutoffs are determined by the Provider according to the particular operation.

Waiting time may be limited because of: tide windows; daylight; port requirements; scheduled departures; other passengers; crew schedules; fuel considerations; weather windows; subsequent trips; or other operational requirements.

Clients must arrive sufficiently early to complete any required check-in or boarding process.

20. Late Arrival and No-Show

A Passenger may be treated as a no-show where the Passenger: fails to appear; arrives after the applicable boarding cutoff; cannot be contacted; goes to an incorrect meeting point despite updated instructions; fails manifest requirements; fails required identification procedures; or otherwise misses the scheduled departure despite the transfer being reasonably available.

No-shows and late arrivals are subject to the Provider’s rules and the Booking Cancellation, Rescheduling & Refund Policy.

21. Fares, Pricing, and Additional Charges

Boat-transfer prices may depend on: route; distance; vessel type; private or shared arrangement; passenger count; fuel costs; season; availability; port charges; landing fees; government or environmental charges; special baggage or cargo requirements; and other legitimate operational factors.

Unless expressly stated as included, passengers should not assume that every port, terminal, environmental, permit, handling, or other third-party fee is included in the quoted transfer price.

22. Payments and Deposits

A Provider or DPTT may require a deposit, partial payment, or full payment to secure the Boat Transfer.

Advance payments may be used or committed for: reservation of vessel capacity; Provider reservation; crew scheduling; fuel; manifest preparation; port arrangements; positioning of the Vessel; other transportation arrangements; or other advance commitments.

The Client should provide proof of payment when requested.

23. Bookings Made Within Three Days Are Non-Refundable

A Boat Transfer booking first made within three (3) calendar days of the scheduled transfer date is non-refundable from the time it is confirmed.

This applies subject to rights or remedies that applicable law does not permit the parties to exclude.

Clients making short-notice Boat Transfer bookings should ensure that their travel plans are final before payment.

24. Other Cancellations

Cancellations outside the three-day rule remain subject to: the Booking Cancellation, Rescheduling & Refund Policy; Provider cancellation terms; amounts already committed; Provider deposits; mobilization costs; bank and payment costs; other non-recoverable expenses; and applicable law.

A cancellation does not automatically result in a full refund.

25. Boat-Transfer Risks

The Client acknowledges that sea transportation inherently involves conditions and risks that cannot be completely eliminated.

Depending on circumstances, these may include: rough seas; sudden weather changes; waves; wind; currents; tides; wet or slippery surfaces; wet docks; ladders or ramps; uneven beach landings; boarding and disembarkation movement; collision or impact; mechanical problems; engine failure or stalling; grounding; swamping; capsizing; sinking; floating debris; saltwater exposure; motion sickness; heat and sun exposure; rain; dehydration; limited communication; delayed emergency response; acts of other passengers or third parties; and other maritime hazards.

Passengers should assess their own comfort and fitness for sea travel before proceeding.

26. Safety Overrides Schedule

Safety takes priority over the planned departure time, arrival time, route, landing location, or preferred itinerary.

The Provider, captain, crew, port authority, Philippine Coast Guard, or other competent authority may reasonably: delay departure; suspend boarding; change a route; change a landing location; return early; seek shelter; divert the Vessel; require additional inspection; reduce baggage or cargo; restrict passengers; reschedule the transfer; or cancel the transfer.

Such decisions may be made before departure or while the Vessel is already underway.

27. Weather Forecasts Are Not Guarantees

A favorable forecast, sunny weather at the departure point, or good conditions earlier in the day does not guarantee that maritime conditions will remain safe or that authorities will permit departure.

Sea conditions can differ materially between locations and may change rapidly.

Operational decisions should therefore be based on current conditions and lawful Provider or authority assessments rather than solely on a general weather forecast.

28. Route and Landing-Point Changes

A Provider may reasonably modify a route, landing location, port, beach, or disembarkation point to: avoid unsafe seas; respond to changing tides; avoid hazards; comply with government instructions; respond to port congestion; address mechanical concerns; obtain emergency assistance; or protect passengers and crew.

Where the essential point-to-point transportation can still reasonably be completed through an alternative route or safe nearby landing arrangement, that operational adjustment does not automatically create a refund entitlement.

29. Delays

Boat transfers may be delayed by: weather; sea state; tide; port congestion; Coast Guard or authority clearance; passenger processing; manifest issues; loading; mechanical concerns; previous trips; emergency conditions; Provider scheduling; or other maritime circumstances.

DPTT does not guarantee an exact arrival time where the timing is affected by Provider operations or circumstances outside the Agency’s reasonable control.

30. Four-Hour Connection Buffer

If the Boat Transfer is being used to connect with a flight, ferry, tour, appointment, accommodation cutoff, or other important fixed commitment, the Client should plan for an estimated arrival at least four (4) hours before the required connection time.

This is a minimum planning recommendation drawn from the existing Boat Transfer framework and does not guarantee that four hours will always be sufficient.

Additional buffer time should be allowed where appropriate because of: distance; season; weather; sea conditions; port restrictions; remote routes; multiple transportation segments; or the importance of the onward commitment.

31. Missed Connections

To the fullest extent permitted by law, DPTT shall not be responsible for a missed flight, ferry, tour, appointment, accommodation check-in, or other onward commitment where the missed connection results from: weather; sea conditions; authority restrictions; Provider delay; port congestion; mechanical circumstances; Force Majeure; insufficient Client buffer time; or another circumstance outside DPTT’s reasonable control.

32. Vessel Substitution

The Provider may substitute the originally anticipated Vessel where reasonably necessary because of: maintenance; mechanical problems; passenger capacity; route requirements; availability; safety; weather; regulatory requirements; or other legitimate operational reasons.

A reasonable Vessel substitution capable of performing the essential transfer does not automatically create a refund entitlement.

33. Provider Substitution

If the original Provider becomes unavailable, DPTT or the responsible Provider may coordinate an alternative independent Provider where reasonably possible.

A reasonable Provider substitution that preserves the essential point-to-point transportation does not automatically constitute cancellation of the booking.

34. Life Jackets and Safety Equipment

Passengers must follow instructions concerning life jackets and other safety equipment.

Where instructed, passengers must: wear the life jacket properly; keep it fastened; avoid tampering with emergency equipment; remain in assigned or instructed areas; keep access to safety equipment clear; and follow captain and crew instructions.

A Passenger who refuses required safety measures may be denied boarding or participation where reasonably necessary for safety or legal compliance.

35. Boarding and Disembarkation

Passengers must exercise reasonable care during boarding and disembarkation.

Depending on location, boarding may involve: wet docks; floating pontoons; steps; ladders; ramps; beach boarding; uneven shorelines; moving vessels; wading through shallow water; or other local boarding arrangements.

Passengers must follow crew instructions and request assistance when reasonably needed.

36. Passenger Seating and Movement

Passengers must follow Provider or crew instructions concerning: where to sit; when movement is permitted; weight distribution; boarding order; disembarkation order; restricted areas; and safe positioning of baggage.

Passenger convenience does not override safety-related seating or weight-distribution requirements.

37. Baggage and Cargo

Providers may impose baggage or cargo restrictions based on: Vessel size; passenger load; weight; available storage; weather; route; safety requirements; port rules; or other operating limitations.

Clients should disclose unusually large, heavy, fragile, or specialized baggage before booking.

38. Excess or Undisclosed Baggage

Excess, oversized, or undisclosed baggage may: be refused; require another vessel or transfer arrangement; require additional charges; cause reallocation of capacity; or require rescheduling.

DPTT is not responsible for consequences arising from material baggage information that the Client failed to disclose before booking.

39. Hazardous and Prohibited Items

Passengers must not carry items prohibited by applicable law, port requirements, or Provider safety rules.

These may include, where prohibited: illegal drugs; contraband; explosives; unsafe fuel containers; flammable or hazardous materials; dangerous chemicals; unauthorized weapons; or other cargo reasonably considered unsafe for the Vessel.

40. Intoxication and Unsafe Conduct

The Provider may deny boarding or discontinue transportation where a Passenger’s intoxication, disorderly behavior, aggression, interference with the crew, or other conduct creates a material safety or legal concern.

Refund eligibility in such circumstances is governed by Provider rules and the Refund Policy.

41. Personal Belongings and Water Exposure

Passengers remain responsible for safeguarding personal belongings unless the Provider expressly accepts custody of particular property.

Sea travel may involve: spray; rain; waves; wet boarding areas; saltwater; movement; loading and unloading; and other conditions capable of damaging property.

Passengers should appropriately protect: mobile phones; cameras; passports; cash; identification; medications; electronics; documents; and other valuable or water-sensitive property.

42. Minors and Dependents

A parent, guardian, or responsible accompanying adult remains responsible for supervising minors and dependents.

Children must follow applicable life-jacket, seating, boarding, and safety requirements.

If a Provider imposes a minimum age, supervision rule, passenger limit, or other child-safety requirement, that rule must be followed.

43. Pets

Pets may be transported only where permitted by the Provider and applicable port or authority requirements.

Where allowed, the Passenger is responsible for: proper containment; control of the animal; required documentation; cleanliness; preventing interference with crew or passengers; and any Provider-imposed animal-transport requirements or charges.

44. Medical Fitness for Sea Travel

Passengers are responsible for considering whether they are medically and physically fit for the booked transfer.

Particular consideration should be given to: pregnancy; heart conditions; respiratory conditions; severe motion sickness; mobility limitations; recent surgery; serious anxiety relating to sea travel; conditions affected by prolonged heat or sun exposure; and other circumstances that may make sea travel difficult or unsafe.

Passengers should seek appropriate medical advice where necessary.

45. Necessary Medications and Personal Medical Supplies

Passengers are responsible for carrying required personal medication and necessary medical supplies.

Important medication should be kept accessible and protected from water or loss.

DPTT does not provide medical diagnosis or medical clearance.

46. Emergency Response

In a medical, maritime, security, or other emergency, the captain, crew, Provider, and competent authorities may take such immediate action as reasonably necessary under the circumstances.

Emergency response in remote maritime locations may be affected by: distance; weather; sea conditions; communications; availability of rescue vessels; local medical resources; port access; time of day; and other operational factors.

Clients should review the Traveler Emergency & Incident Response Guide before travel.

47. Emergency Medical Coordination

Where reasonably necessary, the Provider may seek emergency medical, evacuation, rescue, or other assistance for a Passenger.

DPTT may also assist with communications or coordination where reasonably possible.

The Client remains responsible for personal emergency, evacuation, rescue, medical, hospital, accommodation, transportation, and related costs except to the extent applicable law or a responsible party legally requires otherwise.

48. Incident Reporting

A material incident should be reported promptly to the Provider and, where Agency assistance is requested, to DPTT.

Where reasonably possible, passengers should preserve relevant evidence such as: photographs; videos; names of witnesses; Provider information; receipts; medical records; official reports; messages; booking records; and other relevant documentation.

49. Force Majeure

Boat-transfer operations may be affected by circumstances beyond the reasonable control of DPTT or the Provider.

Examples include: typhoons; storms; unexpectedly rough seas; earthquakes; tsunami warnings; flooding; fires; government orders; emergency restrictions; port closures; environmental restrictions; civil disturbance; security incidents; public-health restrictions; utility or telecommunications failure; transport disruption; or other comparable events beyond reasonable control.

Refund, rebooking, substitution, or credit consequences are governed by the applicable Provider rules, Booking Confirmation, Booking Cancellation, Rescheduling & Refund Policy, and mandatory law.

50. When the Transfer Is Delayed but Still Operates

A delay by itself does not automatically create a full or partial refund right if the point-to-point transfer is subsequently performed.

This is particularly true where the delay results from: safety considerations; weather; port clearance; authority requirements; tides; sea conditions; passenger processing; operational sequencing; or other legitimate maritime circumstances.

51. When a Transfer Cannot Operate

If the booked Boat Transfer cannot operate at all, possible options may include, depending on Provider policy and circumstances: rescheduling; alternative routing; another Provider; credit; partial refund; refund of a recoverable portion; or another reasonable alternative.

The applicable remedy depends on Provider rules, amounts already committed, the reason for cancellation, the Booking Cancellation, Rescheduling & Refund Policy, and mandatory law.

52. Sea Tours and No Prorated Refund for Skipped Destinations

Where a Boat Transfer forms part of a sea tour, island-hopping tour, travel package, or itinerary involving multiple destinations, the following universal DPTT rule applies:

No prorated or proportional refund is due merely because a destination, attraction, stop, route, or itinerary component is skipped, shortened, reordered, replaced, or made unavailable because of safety considerations, weather or sea conditions, government or authority directives, environmental restrictions, or the Provider/operator’s reasonable operational or safety discretion.

The price of a tour commonly covers overall mobilization, vessel use, fuel, staffing, coordination, permits, and operation rather than a separate refundable price for every individual destination.

53. Point-to-Point Transfers and Route Changes

For a pure point-to-point Boat Transfer, an alternative route, different boarding point, different landing point, weather-related delay, or similar operational change does not itself create a proportional refund right where the essential transportation can still reasonably be performed.

If the essential transfer cannot be performed, the Refund Policy and applicable Provider terms determine the available remedy.

54. Claims Relating to Provider Operations

Where a claim principally concerns the Provider’s operational performance, including matters involving: Vessel condition; captain or crew conduct; baggage handling; boarding; navigation; maintenance; equipment; delay; operational cancellation; denied boarding; maritime incident; or another Provider-controlled matter, the responsible Provider may be required to investigate and respond under its own procedures and applicable law.

DPTT may assist with communications and Agency-held documentation where reasonably appropriate.

55. DPTT Assistance With Provider Claims

DPTT may, where reasonably possible: relay a complaint; send supporting documents to the Provider; request clarification; provide booking records maintained by DPTT; communicate a Provider response; or help identify available Provider remedies.

Such coordination does not constitute a guarantee that a Provider will approve compensation, a refund, replacement transportation, insurance payment, or another requested remedy.

56. Limitation Relating to Independent Provider Conduct

To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, loss, property damage, delay, missed connection, expense, cancellation, or other damage caused by the independent acts, omissions, operational decisions, negligence, misconduct, or non-performance of a Provider or unrelated third party where the matter is outside DPTT’s reasonable control.

This provision does not exclude a responsibility that applicable law places directly and non-waivably upon DPTT.

57. Client Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Client’s: illegal conduct; intentional misconduct; fraud; inaccurate manifest information; carriage of prohibited items; damage to Provider property; breach of these Terms; unsafe conduct; interference with the captain or crew; violation of maritime or port rules; or violation of another person’s lawful rights.

This clause does not require indemnification for a responsibility applicable law places directly and non-waivably upon DPTT.

58. Personal Insurance

Passengers are encouraged to consider obtaining travel insurance appropriate to their itinerary and risk profile.

Depending on individual needs, coverage may include: medical expenses; accident coverage; emergency evacuation; trip cancellation; trip interruption; baggage; missed connections; and other travel risks.

Any insurance is governed by the issuing insurer’s policy, conditions, exclusions, limits, and claims procedures.

59. Provider Insurance

If a Provider states that insurance exists, such insurance may be subject to: coverage limitations; policy exclusions; deductibles; passenger eligibility; reporting deadlines; documentation requirements; and insurer determination.

DPTT does not guarantee the scope, adequacy, continuing validity, or claim outcome of independent Provider insurance unless expressly verified and confirmed in writing.

60. Privacy and Passenger Data

DPTT may collect and share personal information reasonably necessary for: booking; manifests; identification; Provider coordination; port compliance; safety; payment verification; incident documentation; and other legitimate purposes described in the Privacy & Personal Data Policy.

Relevant information may be supplied to the responsible Provider and competent authorities where reasonably necessary for the transfer.

61. Electronic Communications and Evidence

Messages, emails, screenshots, payment records, manifests, confirmations, photographs, videos, and other records exchanged through Official Channels may be retained and used to document: booking terms; passenger information; schedule changes; meeting-point updates; Provider instructions; cancellations; participation; incidents; refund requests; claims; and disputes.

Such information is subject to the Privacy Policy and applicable law.

62. Specific Liability Provisions

These Boat Transfer Terms do not establish a separate competing numerical liability cap for D’Palawan Travel and Tours.

Where a claim directly concerns alleged primary liability of DPTT itself, the applicable monetary limitation is governed by the more specific Tours, Travel Packages, and Service Waiver and Liability Disclaimer, subject to applicable law.

That more specific provision shall control to the extent that it addresses the same liability issue.

63. Consequential Losses

To the fullest extent permitted by applicable law, DPTT shall not be responsible for indirect, incidental, special, punitive, exemplary, or consequential losses caused by independent Provider operations or circumstances outside DPTT’s reasonable control.

Such losses may include: lost income; lost profits; lost opportunity; missed work; missed flights; missed ferries; missed accommodations; missed tours or appointments; additional personal transportation; business interruption; or similar consequential economic loss.

Any more specific liability provision applicable to DPTT itself is governed by the Agency’s applicable waiver and Philippine law.

64. Client Responsibility to Ask Before Booking

If any matter is important to the Client’s decision, the Client should request clarification before payment.

This may include questions about: Vessel type; route; Provider; departure window; expected duration; baggage; children; pets; mobility; medical considerations; insurance; port fees; manifest requirements; refund terms; or connection timing.

65. Agency Interpretation of Its Policies

These Terms form part of DPTT’s wider contractual and policy framework.

If any Agency provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must request clarification before payment or participation where the issue is material to the booking.

To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, and terms, including determining which DPTT provision applies to a particular booking or circumstance.

This right does not authorize DPTT to override mandatory provisions of applicable law.

66. Direct Resolution of Complaints and Disputes

If a Client has a complaint, disagreement, claim, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to the Agency through an Official Channel.

The Client should provide available supporting information such as: Booking Confirmation; payment records; messages; manifest information; photographs; videos; Provider communications; authority notices; incident records; medical records where relevant; and other information reasonably necessary to evaluate the matter.

The Client and Agency shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.

67. Governing Law and Exclusive Venue

These Boat Transfer Terms and disputes arising from or relating to the booking, transaction, Agency policies, or Boat Transfer are governed by the laws of the Republic of the Philippines.

If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.

The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.

68. Consumer Protection and Non-Waivable Rights

Nothing in these Terms is intended to unlawfully exclude, waive, restrict, or limit any right, responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.

If a provision is legally restricted, it shall apply to the maximum extent permitted by law while the remainder of these Terms continues in effect.

69. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.

The remaining provisions shall continue to apply to the fullest extent permitted by law.

70. No Waiver by Exception or Non-Enforcement

A delay or failure by DPTT to enforce a provision on one occasion does not permanently waive the provision.

A goodwill refund, rescheduling accommodation, credit, alternative transfer, or other exception granted in one case: does not amend these Terms generally; does not create a precedent; does not automatically apply to another Client; and does not waive applicable Provider rules.

71. Updates to These Boat Transfer Terms

DPTT may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; maritime procedures; booking processes; technology; payment systems; government requirements; travel conditions; safety practices; or other relevant circumstances.

The current version will be published at:

https://bookwithoutcreditcard.com/boattransferterms

Updates generally apply to future bookings and subsequent use, while existing transactions remain subject to the terms and mandatory laws legally applicable to them.
