Business, Affiliate & Third-Party Service Disclosure

D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”) is committed to clear and responsible disclosure regarding our website, travel coordination services, commercial relationships, advertising, referral arrangements, affiliate relationships, and the role of independent third-party service providers.

This Disclosure is intended to help Clients and website visitors understand: who D’Palawan Travel and Tours is and how we assist travelers; how travel services coordinated through the Agency may be delivered; how the Agency may earn revenue; how commissions, referral arrangements, affiliate links, advertisements, and sponsored content may operate; the difference between general informational content and confirmed booking information; the responsibilities of independent third-party Providers; important limitations affecting availability, pricing, schedules, safety, and service performance; and how this Disclosure interacts with the Agency’s other terms, policies, and service-specific conditions.

Transparency is particularly important in travel because a booking may involve several independent businesses, changing weather or transportation conditions, financial commitments, government requirements, and time-sensitive arrangements.

Please read this Disclosure together with the other policies applicable to your use of this Site and any Service you book through D’Palawan Travel and Tours.

1. Acceptance of This Disclosure

This Disclosure forms part of the legal and booking framework of D’Palawan Travel and Tours.

Booking, reserving, paying for, confirming, participating in, receiving, using, or otherwise availing any Service through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of this Disclosure together with all other applicable Agency terms, policies, procedures, company processes, service-specific rules, Provider requirements, safety instructions, and applicable regulations.

Acceptance may be evidenced through any lawful form of confirmation, including: a reservation or booking request; payment of a deposit, partial payment, or full payment; electronic or physical acceptance of a waiver; replying “Confirmed,” “Agree,” “Yes,” or similar language; accepting a Booking Confirmation; appearing at a scheduled pickup or meeting point; boarding a vehicle or vessel; accepting a rental unit; or otherwise knowingly participating in or availing the Service.

If any provision, fee, relationship, inclusion, exclusion, Provider arrangement, booking condition, refund rule, or other matter is unclear, please contact D’Palawan Travel and Tours and obtain clarification before making payment.

If you disagree with any applicable provision, policy, process, rule, or condition, do not proceed with the booking, payment, reservation, or Service.

2. Who We Are

D’Palawan Travel and Tours is a Palawan-based travel coordination and booking agency that assists travelers in identifying, arranging, reserving, and coordinating tourism-related services.

Depending on the Client’s requirements, these Services may include: tours and sightseeing activities; island hopping; travel packages; boat and sea transfers; land transfers; airport transfers; boat rentals; car rentals; motorbike rentals; services with drivers, captains, guides, or crew; accommodation arrangements; permits and entrance-fee coordination; activities and excursions; and other tourism-related arrangements requested by Clients.

Additional information about the Agency, its location, background, and travel coordination services is available on our About D’Palawan Travel and Tours: Travel Agency Services in Palawan page.

3. How Travel Services Are Delivered

D’Palawan Travel and Tours may coordinate Services that are performed by independent third-party Providers.

Depending on the booking, these Providers may include: tour operators; boat operators and vessel owners; transport companies; vehicle owners and drivers; rental suppliers; accommodation establishments; guides; captains and crew; activity providers; venues and attractions; local tourism suppliers; and other businesses or individuals involved in fulfilling a travel arrangement.

DPTT may assist with matters such as quotations, availability inquiries, reservations, scheduling, passenger information, payment coordination, meeting points, pickup instructions, itinerary communication, and Provider updates.

The Provider responsible for performing a particular Service retains responsibility for that Provider’s operational performance.

4. Provider Operational Responsibility

Independent Providers generally determine and manage the operational aspects of the Services they perform, including as applicable: staffing; driver, captain, crew, or guide assignments; vehicle or vessel assignment; equipment selection; maintenance and equipment condition; routes; departure windows; passenger limits; baggage and weight limits; boarding procedures; waiting-time rules; safety procedures; weather and operational assessments; onsite service delivery; emergency procedures; permits and regulatory requirements applicable to their operations; and compliance with government and local authority directives.

Coordination by DPTT does not transfer management or operational control of an independent Provider’s business, personnel, equipment, vehicle, vessel, accommodation, or activity to the Agency.

5. Independent Business Relationships

Providers generally operate as independent businesses or individuals.

A booking relationship between DPTT and a Provider for the purpose of arranging Client Services does not by itself create an employment relationship, partnership, joint venture, ownership interest, or common management arrangement between DPTT and that Provider.

Each Provider remains responsible for its own business operations, personnel, taxes, registrations, equipment, regulatory obligations, policies, and liabilities to the extent applicable under law.

6. Provider-Related Concerns and Claims

If a concern arises from the actual performance of a Service by an independent Provider, responsibility for investigating or resolving that operational matter may primarily rest with the Provider responsible for the Service.

Examples may include concerns involving: driver, guide, captain, or crew conduct; vehicle or vessel condition; accommodation conditions; equipment; late Provider arrival; Provider cancellation; operational delays; service quality; onsite decisions; accidents or safety incidents; lost or damaged property in the Provider’s custody; or other matters arising directly from the Provider’s performance.

DPTT may assist the Client by relaying communications, requesting information, forwarding documentation, or seeking available options from the relevant Provider.

Such assistance is a coordination service and does not constitute a guarantee that the Provider will approve a refund, compensation, replacement, credit, insurance claim, or any other requested remedy.

7. How D’Palawan Travel and Tours May Earn Revenue

D’Palawan Travel and Tours is a commercial travel agency. Our operations may generate revenue through one or more methods depending on the transaction.

Revenue may include: Booking or coordination income: compensation associated with arranging or coordinating travel Services; Service or handling fees: fees that may be charged for booking administration, processing, customized coordination, multi-provider itineraries, remote-destination arrangements, special requests, or other work; Provider commissions: commissions paid by Providers in connection with bookings referred, arranged, or completed through the Agency; Margins: differences between Provider or contracted pricing and the amount offered as part of an Agency booking or package; Referral fees: compensation received when a Client is referred to another business or platform; Affiliate commissions: compensation generated when visitors use certain tracked links and later make qualifying purchases or bookings; Advertising revenue: compensation generated from advertising displayed on the Site; Sponsored content or partnerships: compensation, products, services, or other consideration connected with promotional or collaborative content; and other lawful commercial arrangements reasonably related to the Agency’s operations.

These revenue sources help support Agency operations such as staffing, customer communication, booking coordination, website hosting, software, accounting, content development, marketing, and administrative services.

8. Agency Fees and Provider Commissions

A Client’s booking price may include Agency compensation, Provider commissions, coordination fees, administrative charges, embedded margins, or similar commercial components.

Not every commercial component will necessarily appear as a separate line item where the Service is offered as an overall quoted price or package price.

Where a separate fee is specifically charged to the Client, DPTT will use reasonable efforts to disclose that fee before payment.

If the structure of a particular quotation is important to the Client, the Client should request clarification before accepting the quotation or making payment.

9. Prices Offered Through DPTT May Differ From Other Channels

The price of a travel Service can vary depending on how, where, and when it is booked.

A Provider may offer different prices through: direct bookings; travel agencies; online travel agencies; affiliate platforms; resellers; promotional campaigns; group arrangements; contracted rates; walk-in bookings; or other distribution channels.

Accordingly, DPTT does not represent that every price displayed, quoted, referred, or arranged through the Agency will necessarily be the lowest price available from every possible source.

Differences in pricing may also reflect differences in inclusions, cancellation rights, payment arrangements, administrative support, transfers, permits, fees, group size, or other booking conditions.

10. Affiliate and Referral Links

Some links appearing on the Site may be affiliate or referral links.

If a visitor follows such a link and later completes a qualifying booking, purchase, registration, or other transaction, D’Palawan Travel and Tours may receive a commission, referral fee, or other benefit from the third-party business.

Affiliate compensation generally does not determine whether a traveler is legally required to purchase through the linked business. Visitors remain free to compare alternatives and make their own purchasing decisions.

An affiliate or referral link does not guarantee: the lowest available price; the best available product or Service; availability on a particular date; identical cancellation terms across platforms; identical inclusions; specific service quality; or a particular outcome from the third party.

Clients should review the third party’s own terms before completing a transaction.

11. Advertising

The Site may display advertisements supplied directly by advertisers or through third-party advertising networks.

Some advertising systems select or display advertisements automatically based on factors determined by the advertising platform.

Unless expressly stated otherwise, the appearance of an advertisement on the Site does not mean that DPTT has independently tested, verified, approved, or guaranteed the advertised product or service.

Any transaction between a visitor and an advertiser may be subject to the advertiser’s own terms, privacy policy, return policy, warranties, and other conditions.

12. Sponsored, Promotional, and Collaborative Content

Some Site content may involve commercial cooperation with tourism businesses, Providers, destinations, brands, platforms, or other organizations.

Where reasonably practical, compensated or sponsored content may be identified using descriptions such as: “Sponsored”; “Paid Partnership”; “Promotional Content”; “Partner Content”; “Affiliate Link”; or similar disclosure language.

Technical limitations, older content, embedded third-party systems, automatic advertising placement, or layout restrictions may mean that a commercial relationship is not labeled next to every individual link or reference.

This Disclosure therefore serves as a general notice that commercial relationships may exist in connection with content appearing on the Site.

13. Complimentary Products, Services, or Familiarization Experiences

From time to time, DPTT or persons involved in producing Site content may receive complimentary or discounted accommodations, tours, transportation, activities, products, meals, access, or other benefits from businesses or tourism stakeholders.

Where such consideration is materially relevant to content presented as a review, recommendation, or promotion, reasonable disclosure may be provided where appropriate and practical.

Receipt of complimentary or discounted access does not guarantee favorable coverage.

14. Editorial and Informational Content

DPTT may publish travel articles, destination guides, itinerary suggestions, route information, travel tips, photographs, videos, and other informational material.

We aim to make such content useful and reflective of actual travel conditions known at the time of preparation.

However, informational content may: become outdated; reflect conditions existing when the content was produced; describe a Provider or destination that later changes; contain estimated rather than guaranteed travel times; refer to seasonal conditions; depend on information supplied by third parties; or be affected by later government or operational changes.

General Site content should therefore be distinguished from a specific Booking Confirmation.

15. General Information Is Not a Booking Guarantee

The appearance of a destination, Provider, route, accommodation, vehicle, vessel, activity, tour, or package on the Site does not by itself guarantee: availability; acceptance of a reservation; a specific departure time; a specific vehicle or vessel; a particular guide, driver, captain, or crew; specific weather conditions; uninterrupted operations; unchanged prices; unchanged government fees; unchanged permit requirements; an identical itinerary; identical scenery or conditions to photographs; a particular level of service quality; or a particular travel outcome.

The applicable Booking Confirmation and relevant Provider and Agency policies govern the confirmed arrangement.

16. References to Providers Are Not Absolute Guarantees

DPTT may identify, feature, coordinate with, or arrange bookings involving particular Providers.

Doing so means that the Provider may be part of our available travel coordination network or relevant to the information being discussed.

It should not be interpreted as an absolute warranty concerning every aspect of the Provider’s: future performance; equipment; personnel; availability; financial condition; licensing or accreditation status at every future point in time; insurance; service quality; safety outcome; or compliance after the date information was obtained.

Licenses, registrations, personnel, insurance, policies, and operational circumstances can change. Where a particular credential or condition is important to a Client, the Client should request current verification before travel.

17. Provider Substitution

A particular Provider identified during an inquiry or preliminary quotation may not always be the Provider ultimately assigned to perform the Service.

Provider substitutions may occur due to: availability; overbooking; mechanical problems; staffing issues; weather; safety considerations; route changes; capacity requirements; regulatory requirements; emergencies; or other legitimate operational considerations.

Where substitution is reasonably necessary, the Agency or responsible Provider may arrange an alternative Provider or service component where available and appropriate.

A substitution does not automatically create a refund entitlement if the contracted travel purpose can reasonably still be performed, subject to the Booking Cancellation, Rescheduling & Refund Policy, booking-specific terms, applicable Provider rules, and mandatory law.

18. Travel Conditions and Information Can Change

Travel in Palawan and other island destinations is highly dependent on current conditions.

Information, routes, schedules, stops, and activities may be affected by: weather; localized weather systems; sea state; wind and waves; tides and currents; road conditions; flooding or landslides; airport or port conditions; government directives; Philippine Coast Guard restrictions; protected-area management rules; environmental restrictions; tourist capacity limits; permit requirements; Provider operational decisions; staff or equipment availability; or other circumstances beyond reasonable control.

A published description or preliminary itinerary should therefore not be interpreted as a guarantee that conditions will remain unchanged through the travel date.

19. Photos, Videos, and Visual Content

Photographs, videos, maps, and other visual material are generally provided for reference, illustration, information, or promotion.

Actual conditions may differ because of factors such as: season; weather; tide; time of day; lighting; natural environmental changes; camera angle; image processing; display technology; renovations; Provider substitutions; vehicle or vessel assignments; and other circumstances.

DPTT does not guarantee that a Client’s actual travel experience will visually reproduce photographs or videos appearing on the Site.

20. Cookies, Analytics, Advertising Technology, and Third-Party Tracking

The Site may use cookies, analytics tools, embedded content, advertising technology, security tools, and similar technologies.

These technologies may be supplied by DPTT or by independent third-party technology providers.

Depending on the technology and applicable consent requirements, information may be processed for purposes such as: Site functionality; security; performance measurement; audience analytics; advertising; fraud prevention; user preferences; or content delivery.

Please review the Privacy & Personal Data Policy for additional information regarding personal data, cookies, Providers, government disclosures, and related data-processing matters.

21. Third-Party Websites and Platforms

DPTT may provide links to external websites, booking platforms, social-media pages, payment providers, mapping services, tourism resources, accommodations, Providers, or other businesses.

External websites are controlled by their respective owners and may have separate: terms of use; privacy policies; refund policies; prices; booking conditions; security practices; cancellation rules; and customer service procedures.

DPTT is not responsible for changes made by an independent external website after a Client leaves the DPTT Site.

Clients should review the third party’s own terms before completing a transaction.

22. No Guarantee of Suitability for Every Traveler

Travel Services and destinations differ substantially in physical demands, accessibility, remoteness, environmental exposure, transportation conditions, accommodation standards, and available facilities.

A Service appropriate for one traveler may not be appropriate for another.

Clients are responsible for considering their own: health; physical ability; mobility; age; medical conditions; travel experience; comfort with boats, road travel, or remote areas; dietary requirements; risk tolerance; and personal requirements.

Please review the Pre-Travel Client Responsibilities & Readiness Guide before booking or traveling.

23. Personal Travel Insurance

Travelers are encouraged to consider obtaining appropriate travel insurance suited to their itinerary, activities, health circumstances, baggage, cancellations, interruptions, and other risks they wish to insure against.

Unless expressly confirmed otherwise in writing, the purchase of a Service through DPTT should not be assumed to include personal travel, health, accident, cancellation, baggage, or similar insurance.

Any insurance product is governed by the policy issued by the relevant insurer, including its exclusions, claim procedures, deductibles, documentation requirements, and coverage limits.

24. Advance Booking Reconfirmation

Clients with advance bookings must contact D’Palawan Travel and Tours on the day before the scheduled tour to confirm that the booking has been properly acknowledged and to obtain the latest available operational instructions.

Where relevant, the same reconfirmation practice should be followed for advance transfers, rentals, and other scheduled Services.

Day-before confirmation may be important for communicating: current meeting or pickup locations; departure windows; Provider assignments; weather-related updates; route changes; manifest requirements; identification requirements; vehicle or vessel changes; safety notices; and other time-sensitive instructions.

Clients should rely on the latest confirmed instructions rather than only on old quotations, preliminary itineraries, or earlier messages.

25. Disclosure Concerning Short-Notice Bookings and Refunds

Clients should review the complete Booking Cancellation, Rescheduling & Refund Policy before making payment.

Bookings made within three (3) calendar days of the scheduled Service date are non-refundable.

Short-notice bookings frequently require immediate Provider confirmation, scheduling, capacity reservation, crew or driver allocation, permits, supplies, fuel, or other commitments. Clients should therefore ensure their plans are final before paying for a booking made within this period.

26. Disclosure Concerning Skipped or Modified Tour Destinations

Land and sea tours may require itinerary adjustments because of safety concerns, weather, sea conditions, road conditions, official directives, environmental restrictions, Provider operational decisions, or other circumstances.

No prorated or proportional refund is due merely because a destination, stop, attraction, route, or portion of an itinerary is skipped, shortened, replaced, or made unavailable because of safety considerations, weather or sea conditions, government or authority directives, road conditions, or the Provider/operator’s reasonable operational discretion.

This rule must be read together with the complete Booking Cancellation, Rescheduling & Refund Policy and any applicable Provider terms.

27. Limits of Responsibility for Independent Provider Matters

To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, loss, delay, cancellation, property damage, service interruption, missed connection, additional expense, or other damage arising directly from the independent acts or omissions of a Provider or unrelated third party where the matter is outside DPTT’s reasonable control.

This may include matters involving: Provider personnel; vehicle or vessel operation; equipment maintenance; accommodation operations; onsite safety management; route decisions; third-party cancellations; Provider overbooking; Provider service quality; Provider regulatory compliance; external payment platforms; airlines and other carriers; government authorities; or other independent entities.

Where the Agency itself has a legal responsibility that cannot lawfully be excluded or limited, nothing in this Disclosure is intended to remove that responsibility.

28. Circumstances Beyond Reasonable Control

DPTT, Providers, and Clients may be affected by events that cannot reasonably be prevented or controlled.

Examples include: typhoons and severe weather; unsafe sea conditions; earthquakes; floods; landslides; fires; epidemics or public-health restrictions; government orders; port, airport, road, or attraction closures; security incidents; transportation interruptions; utility or telecommunications failures; environmental restrictions; protected-area closures; strikes; civil disturbances; and other force majeure or comparable circumstances.

The effect of such circumstances on a booking is subject to the applicable Provider rules, Agency policies, booking terms, and Philippine law.

29. Client Responsibility to Review Important Information

Clients should carefully review information that materially affects their booking before payment and before travel.

This includes: price; inclusions and exclusions; date and schedule; pickup and meeting point; headcount; payment requirements; cancellation and refund rules; Provider requirements; identification and manifest requirements; health and safety requirements; weather-dependent aspects; insurance needs; vehicle, vessel, or rental conditions; and applicable service-specific terms.

Failure to ask for clarification before payment does not convert a clearly stated policy into a different agreement.

30. Agency Interpretation and Clarification of Its Policies

DPTT’s policies are intended to operate together as one coherent legal and booking framework.

If any provision appears unclear, incomplete, ambiguous, or potentially inconsistent with another Agency policy, Clients must seek clarification before payment or participation.

To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, rules, procedures, booking conditions, company processes, and terms, including determining which Agency provision is applicable to a particular booking or circumstance.

Any interpretation shall remain subject to applicable Philippine law and rights that cannot legally be waived.

31. Complaints and Direct Resolution

If a Client has a concern, complaint, disagreement, or dispute involving D’Palawan Travel and Tours, the Client agrees to first communicate the matter directly to the Agency through an Official Channel.

The Client should provide relevant supporting information where available, including: booking details; receipts; payment records; messages; photographs or videos; Provider communications; incident reports; and other information reasonably relevant to the matter.

The Client and Agency shall first attempt in good faith to resolve the dispute directly for at least thirty (30) days from written notice of the dispute.

32. Governing Law and Exclusive Venue

This Disclosure and matters arising from the use of the Site, bookings, Agency policies, commercial disclosures, or Services coordinated through DPTT are governed by the laws of the Republic of the Philippines.

If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.

The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.

33. Non-Waivable Rights

Nothing in this Disclosure is intended to unlawfully waive, exclude, or limit a consumer right, statutory protection, legal responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.

If any provision is legally restricted, it shall be applied to the maximum extent permitted by law while the remainder of this Disclosure remains effective where legally possible.

34. Severability

If any portion of this Disclosure is determined by a competent authority to be invalid or unenforceable, that provision shall be limited or separated only to the extent necessary.

The remaining provisions shall continue to apply to the fullest extent permitted by law.

35. Changes to This Disclosure

D’Palawan Travel and Tours may revise this Disclosure when reasonably necessary to reflect changes in: business practices; Provider arrangements; affiliate programs; advertising; technology; Site functionality; booking practices; commercial relationships; regulatory requirements; or other relevant circumstances.

The current version will be published on this page.

Continued use of the Site after publication of an updated Disclosure constitutes acceptance of the revised Disclosure as applicable to subsequent use, subject to applicable law.
