These Motorbike Rental (Self-Drive) Terms (“Terms”) apply to self-drive motorbike, motorcycle, scooter, and similar two-wheeled motor-vehicle rentals coordinated, reserved, booked, arranged, referred, or otherwise assisted by D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).
Under a self-drive motorbike rental, the Client accepts possession of a motorbike supplied by an independent rental Provider or Vehicle owner and personally operates it, subject to the applicable Rental Agreement, Provider requirements, traffic laws, safety rules, and these Terms.
These Terms are intended to clearly explain: driver eligibility and licensing; the elevated risks associated with motorcycle and scooter use; helmet and protective-equipment responsibilities; passenger responsibilities; inspection and condition documentation; safe operation requirements; prohibited uses; fuel and rental-period requirements; extensions and late returns; Vehicle damage, theft, and loss; accidents and incident reporting; traffic tickets, penalties, towing, storage, and impoundment; Provider insurance or other coverage, if any; Client financial responsibility; road, weather, and remote-area risks; emergency procedures; cancellation and refund rules; and applicable DPTT liability limitations.
Please read these Terms carefully before making payment, accepting possession of the motorbike, or riding it.Booking, reserving, paying for, confirming, accepting delivery, taking possession of, operating, riding, extending the rental of, carrying a passenger on, or otherwise using a self-drive motorbike coordinated through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms together with all applicable Agency policies, procedures, company processes, Provider requirements, Rental Agreement provisions, safety rules, and regulations.
If anything is unclear, contact D’Palawan Travel and Tours before making payment or accepting the motorbike.
If you disagree with an applicable provision, do not proceed with the booking, handover, or rental.

“Motorbike” includes motorcycles, scooters, automatic or manual motorbikes, and similar two-wheeled motor vehicles, regardless of engine displacement, subject to the actual unit supplied.
“Authorized Rider” means the Client or another person expressly permitted to operate the Motorbike under the Provider’s rules or Rental Agreement.
“Passenger” means a person carried by the Renter on the Motorbike where permitted by law, the unit’s design, and Provider rules.
“Rental Agreement” means the rental contract, receipt, checklist, acknowledgment, deposit arrangement, written or electronic terms, or other conditions imposed by the Provider concerning possession and use of the Motorbike.
“Rental Period” means the period beginning when the Renter accepts possession of the Motorbike and ending when the Motorbike is properly returned and accepted by the Provider, subject to the Rental Agreement.

2. Scope of These Terms
These Terms apply to self-drive motorbike and scooter rentals where the Client personally operates the unit.
They apply to matters including: reservation; handover; delivery or pickup; Motorbike inspection; Rental Period; helmet requirements; Passenger use; fuel; extensions; late returns; early returns; damage; loss; theft; mechanical problems; accidents; traffic violations; towing; storage; impoundment; deposit disputes; return inspection; and other matters reasonably arising from the same rental transaction.
3. Self-Drive Distinguished From Motorbike With Driver
These Terms apply where the Client personally operates the Motorbike.
They do not govern a motorbike transportation Service where another rider or driver supplied by the Provider transports the Client as a passenger.
For those arrangements, review the Motorbike Rental With Driver: Terms and Conditions terms.
4. Self-Drive Motorbike Included in a Tour or Package
If a self-drive Motorbike rental forms part of a larger tour, package, accommodation arrangement, or other travel Service, these Terms apply together with: the Travel Booking & Service Terms and Conditions; the Tours, Travel Packages, and Service Waiver and Liability Disclaimer; the Booking Cancellation, Rescheduling & Refund Policy; the Booking Confirmation; the Rental Agreement; Provider requirements; and other applicable DPTT policies.
5. D’Palawan Travel and Tours’ Role
D’Palawan Travel and Tours operates as a travel coordination and booking agency.
DPTT may assist with: identifying available Motorbike rental options; checking availability; requesting quotations; coordinating reservations; relaying Provider eligibility requirements; coordinating delivery or pickup; communicating unit information; coordinating payment arrangements; relaying extension requests; communicating Provider responses; relaying incident information; and providing reasonable booking support.
The actual Motorbike is supplied and the rental Service is performed by the independent Provider responsible for the booking.
6. Provider Responsibility
The Provider generally controls rental-specific matters relating to the Motorbike.
Depending on the booking, these may include: ownership or authority to supply the Motorbike; maintenance; mechanical condition; roadworthiness; registration documents; Rider eligibility requirements; age requirements; license requirements; security deposits; identification requirements; helmet availability; fuel rules; geographic or road restrictions; Passenger restrictions; prohibited uses; extensions; late-return charges; damage assessment; repairs; Provider insurance or other coverage, if any; and other Provider-specific rental requirements.
7. Independent Provider Relationship
Independent Providers generally maintain their own Motorbikes, rental agreements, maintenance systems, deposits, insurance arrangements, personnel, policies, and business operations.
A booking, coordination, commission, referral, or commercial relationship between DPTT and a Provider does not by itself create: employment; partnership; joint venture; common ownership; common fleet management; or common operational control.
8. Limited-Availability and Independent-Owner Arrangements
In some destinations or peak periods, established rental Providers may have limited availability.
Where appropriate and lawful, DPTT may assist the Client in identifying an independent Motorbike owner if the Client requests assistance finding a unit.
If the Client proceeds with such an arrangement, the applicable rental conditions remain between the Client and the Motorbike owner, subject to applicable law.
9. Booking Is Not Confirmed Until Acknowledged
An inquiry, quotation, availability request, Motorbike description, or preliminary discussion does not itself constitute a confirmed rental.
The booking becomes confirmed when:
- DPTT or the applicable Provider acknowledges that the reservation has been accepted; and
- any required payment, deposit, identification, license information, or other confirmation requirement has been satisfied and verified.
Before confirmation, unit availability, price, Provider, delivery arrangements, and deposit requirements remain subject to change.
10. Acceptance of These Terms
The Renter accepts these Terms by: making a reservation; paying a deposit; making partial or full payment; accepting the Booking Confirmation; accepting the Rental Agreement; accepting delivery; taking possession of the Motorbike; operating or riding the Motorbike; requesting an extension; or otherwise using the rental unit.
11. Day-Before Reconfirmation Is Required
Clients with advance Motorbike Rental (Self-Drive) bookings must contact D’Palawan Travel and Tours on the day before the scheduled rental start date to ensure that the booking has been properly acknowledged and to obtain the latest available handover information.
The Renter should verify, as applicable: booking name; rental date; handover time; handover location; Motorbike information; Provider information; license requirements; identification requirements; deposit requirements; helmet arrangements; balance due; return requirements; contact information; and other time-sensitive rental instructions.
12. Driver’s License Requirement
The Renter must hold a valid driver’s license authorizing lawful operation of the Motorbike.
The Renter is responsible for ensuring that: the license is current and valid; the license authorizes operation of the applicable Motorbike class; any required restriction or endorsement requirements are satisfied; the license is legally recognized for the Renter’s circumstances in the Philippines; and information supplied to the Provider concerning licensing is accurate.
13. Rider Eligibility
The Provider may impose additional Rider requirements such as: minimum age; minimum driving experience; license tenure; identification; deposit; local contact information; or other lawful eligibility conditions.
The Renter must satisfy the Provider’s applicable eligibility conditions before taking possession.
14. Authorized Riders Only
Only the Renter or another person expressly permitted under the Rental Agreement may operate the Motorbike.
The Renter must not allow an unauthorized person to ride or operate the Motorbike.
Unauthorized Rider use may result in: breach of the Rental Agreement; financial responsibility for damage; loss or limitation of Provider-provided coverage, if any; termination of the rental; additional charges; or other consequences permitted under the Rental Agreement and applicable law.
15. Motorbike Riding Is a Higher-Risk Activity
The Renter acknowledges that riding a Motorbike carries materially greater exposure to bodily injury than traveling inside an enclosed passenger Vehicle.
A Motorbike provides comparatively limited physical protection in a collision, fall, or loss-of-control event.
Even an incident occurring at relatively low speed may result in: serious bodily injury; head injury; fractures; road rash; permanent disability; property damage; or death.
The Renter voluntarily chooses to operate the Motorbike with knowledge of these inherent risks.
16. Motorbike-Specific Road Risks
Motorbike operation may involve risks including: collisions with vehicles; pedestrian incidents; animal crossings; road debris; skidding; sliding; tipping; wobbling; loss of traction; panic braking; oversteering; understeering; misjudging speed or turning radius; wet roads; sand; gravel; mud; oil or other slippery material; loose stones; potholes; uneven road surfaces; steep inclines or descents; unpaved roads; blind curves; poor lighting; sudden rain; flooding; landslides; falling debris; road construction; reckless conduct of other road users; unsafe overtaking by other motorists; mechanical problems; limited emergency response; and other two-wheel road hazards.
17. Helmet Use Is Required
The Renter must use an appropriate helmet whenever operating the Motorbike and must require any Passenger to use an appropriate helmet as required by applicable law and Provider rules.
The Renter acknowledges that failure to use a helmet significantly increases the risk of catastrophic head injury or death.
The Renter should confirm helmet availability, size, fit, and condition at handover.
18. Protective Riding Gear
In addition to a helmet, the Renter is encouraged to use protective clothing appropriate for motorcycle travel.
Depending on the circumstances, this may include: closed footwear; long trousers; gloves; protective outerwear; eye protection; and rain protection.
If specific protective gear is important to the Client, availability should be confirmed before rental. It should not be assumed that the Provider supplies equipment other than items expressly included.
19. Passenger Use
A Passenger may be carried only where: permitted by applicable law; permitted by the Provider; the Motorbike is designed for Passenger use; Passenger capacity is not exceeded; and required safety equipment is used.
20. Renter Responsibility for Passenger Safety
If the Renter chooses to carry a Passenger, the Renter is responsible for reasonably managing the additional safety considerations involved.
The Renter must ensure, as applicable, that the Passenger: uses a helmet; is seated properly; uses available footrests; does not interfere with operation; does not create unsafe imbalance; complies with lawful Passenger restrictions; and follows reasonable safety instructions.
The Renter acknowledges that carrying a Passenger may: affect balance; increase stopping distance; alter acceleration; reduce maneuverability; change cornering characteristics; and increase the consequences of a fall or collision.
21. No Riding While Impaired
The Motorbike must not be operated while the Rider is impaired by: alcohol; illegal drugs; medication that materially impairs safe riding; severe fatigue; illness materially affecting safe operation; or another impairing condition.
Impaired riding may also affect or invalidate Provider insurance or other coverage, where applicable.
22. Mobile Phones and Distraction
The Renter must comply with applicable restrictions concerning mobile-phone use and distracted driving.
The Renter should stop in a safe and lawful place before: typing messages; reviewing maps in a way that materially distracts from riding; taking photographs or video; making handheld calls; or performing another task incompatible with safe Motorbike control.
23. Prohibited Uses
Unless expressly authorized by the Provider and lawful, the Motorbike must not be used for: racing; speed contests; stunts; reckless riding; illegal purposes; overloading; unauthorized towing; carrying hazardous materials; dangerous off-road riding; unsafe beach riding; hazardous river crossings; operation by an unauthorized Rider; commercial use not authorized by the Provider; or another purpose prohibited by the Rental Agreement.
24. Restricted Roads and Terrain
The Provider may restrict use of the Motorbike on particular roads, areas, or terrain.
The Renter should clarify restrictions before entering: deep mud; severe off-road terrain; flooded roads; river crossings; beaches; construction routes; extremely rough roads; restricted protected areas; closed roads; or other unusual terrain.
25. Riding Within Personal Ability
The Renter must make conservative decisions based on personal experience and ability.
The Renter should not attempt a route, terrain, speed, maneuver, water crossing, or riding condition that exceeds the Renter’s reasonable skill level.
26. Vehicle Inspection Before Acceptance
The Renter should inspect the Motorbike before riding it.
The inspection should reasonably include: existing scratches; dents; body panels; tires; brakes; lights; headlight; brake light; turn indicators where applicable; horn; mirrors; steering; throttle response; visible fluid leakage; seat condition; and other obvious matters affecting ordinary operation or condition documentation.
27. Refuse an Apparently Unsafe Unit
If the Motorbike presents an apparent material safety problem at handover, the Renter should raise the concern with the Provider before operating it.
The Renter should not knowingly begin riding a Motorbike that the Renter reasonably believes is unsafe to operate.
28. Pre-Rental Photo and Video Documentation
The Renter is strongly encouraged to take clear photographs or video of the Motorbike before departure.
Documentation may include: body panels; scratches; dents; mirrors; lights; tires and wheels; seat; exhaust; visible accessories; fuel level where relevant; odometer where relevant; and other visible condition matters.
This documentation can help distinguish pre-existing condition from damage occurring during the Rental Period.
29. Handover Checklist
If the Provider uses a condition checklist, acknowledgment, photographs, video, or electronic handover record, the Renter should review it before departure.
Any disagreement concerning visible pre-existing damage should be raised before the Renter begins using the Motorbike where reasonably possible.
30. Acceptance of Possession
Once the Renter accepts the Motorbike and the Rental Period begins, the Renter assumes responsibility for possession and lawful operation of the Motorbike subject to: the Rental Agreement; Provider rules; these Terms; and applicable law.
31. Duty of Reasonable Care
The Renter must use reasonable care throughout the Rental Period.
This includes: riding prudently; reducing speed for rain and poor visibility; allowing additional braking distance; avoiding unnecessary risks; protecting the Motorbike when parked; observing warning indicators; following Provider restrictions; and stopping use when a serious mechanical or safety problem is reasonably suspected.
32. Mechanical Warning Signs
If the Motorbike develops warning signs such as: brake problems; throttle problems; steering problems; unusual vibration; unusual noises; tire problems; electrical problems; headlight failure; overheating; chain or belt problems where applicable; warning lights; or another condition reasonably suggesting unsafe continued use, the Renter should stop using the Motorbike as soon as it is safe to do so and contact the Provider promptly.
33. Continuing to Ride After a Known Problem
Continuing to operate the Motorbike after the Renter becomes aware of a serious mechanical or safety problem may: increase the risk of injury; worsen Vehicle damage; increase repair costs; affect Provider coverage, if any; and affect responsibility under the Rental Agreement and applicable law.
34. Breakdown Procedures
If the Motorbike breaks down, the Renter should: move to a reasonably safe location where practicable; stop continued operation if further riding may be unsafe; contact the Provider promptly; follow reasonable Provider instructions; document the problem where useful; and contact emergency authorities where the situation creates an immediate hazard.
35. Repairs
The Renter should not authorize substantial repairs or replacement parts without Provider approval except where an immediate emergency reasonably requires action and communication is genuinely unavailable.
Responsibility for repair expenses depends on: the cause of the problem; Rental Agreement provisions; Provider policy; available evidence; Client conduct; and applicable law.
36. Fuel Policy
The Provider may impose a fuel requirement concerning pickup and return.
The Renter is responsible for understanding the applicable fuel policy before accepting the Motorbike.
Additional charges may apply where the Motorbike is returned below an agreed fuel level, subject to Provider rules and applicable law.
37. Fuel Planning
When traveling to remote areas, the Renter should consider that fuel may not be available at regular intervals.
Fuel stations may be: limited; far apart; temporarily unavailable; closed at certain hours; or absent from particular routes.
The Renter is responsible for reasonable fuel planning.
38. Rental Period
The Rental Period is determined by the applicable handover and return arrangement.
The Renter should confirm: rental start date; start time; return date; return time; delivery or pickup location; return location; extension procedures; and late-return charges.
39. Rental Extensions
An extension is subject to Provider approval and availability.
The Renter should request an extension sufficiently in advance.
Where practicable, consistent with DPTT’s existing rental framework, the Client should provide at least six (6) hours’ notice before the current rental period expires.
An extension may require: Provider approval; additional payment; confirmation that no subsequent reservation conflicts; updated return instructions; and other Provider requirements.
40. Unauthorized Extension
Keeping the Motorbike beyond the agreed Rental Period without approval may result in: late fees; additional rental charges; Provider recovery action; deposit deductions; additional losses where lawfully recoverable; or other consequences under the Rental Agreement.
41. Late Return
The Motorbike must be returned at the agreed time unless an extension has been approved.
The Renter should promptly notify the Provider or DPTT if circumstances may materially delay return.
42. Early Return
Returning the Motorbike before the end of the Rental Period does not automatically create a right to a prorated refund.
Refund eligibility, if any, is governed by Provider terms, the Booking Cancellation, Rescheduling & Refund Policy, and applicable law.
43. Return Inspection
The Provider may inspect the Motorbike upon return.
The inspection may include: new visible damage; body condition; wheels and tires; mirrors; lights; fuel level; odometer where applicable; missing accessories; cleanliness; return time; and other matters covered by the Rental Agreement.
44. Return Photo and Video Documentation
The Renter is encouraged to take photographs or video when returning the Motorbike, particularly where condition, fuel, mileage, accessories, or timing may later become disputed.
45. Damage During the Rental Period
Responsibility for Motorbike damage is governed by: the Rental Agreement; cause of damage; available evidence; Provider rules; any applicable insurance or coverage; and applicable law.
The Renter may be responsible for damage caused by: collision; falling or tipping the Motorbike; reckless riding; negligent use; prohibited use; unauthorized Rider use; overloading; misuse; continued riding after known mechanical warning signs; unlawful conduct; or another Client-caused circumstance covered by the Rental Agreement.
46. Normal Wear and Tear
Normal wear and tear should be distinguished from chargeable damage according to the Rental Agreement and applicable law.
Pre-rental and return condition documentation may help resolve such issues.
47. Damage Assessment
The Provider may inspect damage and obtain repair estimates or technical assessments.
Any claim for repair costs should remain subject to: the Rental Agreement; condition evidence; causation; repair documentation where applicable; Provider policy; and applicable law.
DPTT does not independently determine repair costs, technical damage, or parts-and-labor pricing.
48. Downtime or Loss-of-Use Charges
A Provider may include downtime or loss-of-use charges in its Rental Agreement where a Client-caused incident prevents the Motorbike from being rented or operated.
Any such charge is governed by the Rental Agreement, evidence supporting the claim, applicable law, and the circumstances of the damage.
DPTT does not independently assess or guarantee such charges.
49. Theft or Loss of the Motorbike
If the Motorbike is stolen, lost, or otherwise cannot be accounted for during the Rental Period, the Renter must promptly: notify the Provider; contact competent authorities where appropriate; comply with lawful reporting requirements; preserve relevant information; and cooperate reasonably with the Provider concerning the incident.
Financial responsibility is determined by the Rental Agreement, available insurance or coverage if any, applicable law, and the circumstances of the loss.
50. Security Deposits
A Provider may require a security deposit.
Before paying, the Renter should clarify: the amount; payment method; conditions for deductions; return procedure; expected return timing; and documentation required for release.
51. Deposit Deductions
Subject to the Rental Agreement and applicable law, a Provider may seek deductions for properly chargeable amounts concerning: Motorbike damage; late return; fuel deficiency; traffic or parking penalties attributable to the Renter; towing or storage; missing Provider property; helmet or accessory loss or damage; other valid rental obligations; or other properly documented amounts due under the Rental Agreement.
52. Identification Requirements
The Provider may require valid identification and Driver’s License documentation before releasing the Motorbike.
The Renter must provide accurate and authentic documentation.
53. Custody of Identification Documents
If the Provider proposes to retain a physical identification document as part of its rental procedures, the Renter should understand and agree to the arrangement before handover and retain appropriate alternative identification where necessary.
Any custody, return, or dispute concerning identification held directly by the Provider remains governed by the Provider–Renter arrangement and applicable law.
DPTT does not independently hold identification unless expressly documented otherwise.
54. Traffic Tickets and Violations
The Renter is responsible for traffic violations arising from the Renter’s use of the Motorbike during the Rental Period to the extent provided by applicable law and the Rental Agreement.
This may include: speeding; reckless driving; illegal parking; helmet violations; license violations; traffic-sign violations; prohibited road use; checkpoint violations; mobile-phone violations; Passenger violations attributable to the Rider; or other traffic offenses.
55. Towing and Storage
If the Motorbike requires towing or storage during the Rental Period, responsibility for the costs depends on: the cause; the Rental Agreement; Provider policy; Client conduct; Motorbike condition; insurance or other coverage, if any; and applicable law.
56. Impoundment
If competent authorities impound, detain, or otherwise hold the Motorbike, the Renter must cooperate with the Provider and authorities.
Where impoundment results from the Renter’s violation, unauthorized Rider, prohibited use, licensing issue attributable to the Renter, or other Client-caused circumstance, the Renter may be responsible for: fines; penalties; release fees; towing; storage; Provider expenses; and other amounts lawfully recoverable under the Rental Agreement.
Where the issue arises from Provider-controlled documentation or another matter not caused by the Renter, responsibility shall depend on the facts, Rental Agreement, and applicable law.
57. Accidents
If an accident occurs, the Renter must prioritize immediate safety.
As applicable, the Renter should: stop safely; seek medical assistance where needed; contact competent authorities where required; notify the Provider promptly; notify DPTT if Agency coordination assistance is requested; document the scene where safe and lawful; obtain relevant third-party details; preserve witness information where available; and follow reasonable Provider instructions.
58. Accident Documentation
Where reasonably possible, the Renter should preserve: photographs; videos; Motorbike condition; other Vehicle information; driver or Rider information; witness details; police or barangay reports where applicable; medical records; receipts; messages; and other relevant evidence.
59. Third-Party Injury or Property Damage
If the Renter is involved in an incident affecting another person, Vehicle, or property, responsibility shall be determined under: the facts of the incident; the Rental Agreement; applicable insurance or coverage, if any; Provider policy; and Philippine law.
The Renter should not assume that the Motorbike automatically includes unlimited coverage for third-party injury or property damage.
60. Provider Insurance or Rental Coverage
If the Provider states that insurance or another form of rental coverage exists, such coverage may remain subject to: coverage limits; deductibles; participation fees; authorized-Rider requirements; age restrictions; license requirements; geographical restrictions; prohibited-use exclusions; Passenger restrictions; helmet requirements; alcohol or drug exclusions; police-report requirements; claim deadlines; documentation requirements; and insurer or Provider approval.
61. Do Not Assume “Insured” Means Fully Covered
The Client should not assume that a statement that a Motorbike is “insured” or “covered” means every accident, repair, injury, theft, or third-party claim will be fully paid.
If insurance or rental coverage is material to the Client’s decision, the Client should request clarification before accepting the Motorbike.
62. DPTT and Provider Insurance
DPTT does not guarantee the existence, scope, adequacy, continuing validity, exclusions, deductibles, or claim outcome of an independent Provider’s insurance or rental coverage unless expressly verified and confirmed in writing.
63. Remote-Area Riding
Some routes may involve: unpaved roads; gravel; mud; sand; mountain roads; steep sections; narrow roads; poor lighting; limited mobile signal; limited towing services; limited repair facilities; limited fuel stations; limited medical facilities; flood-prone roads; construction; or other remote-area conditions.
The Renter is responsible for reasonable trip planning and conservative riding decisions.
64. Night Riding
Night riding may involve additional risks because of: reduced visibility; limited road lighting; unmarked hazards; animals; pedestrians; road debris; weather; headlight limitations; fatigue; and reduced availability of repair or emergency services.
The Renter should exercise additional caution and avoid routes the Renter reasonably considers unsafe.
65. Rain and Wet Roads
Rain may significantly affect Motorbike handling.
Wet conditions may: reduce traction; increase stopping distance; hide potholes; create slippery painted surfaces; increase visibility problems; create standing water; increase skidding risk; and make gravel, mud, sand, or leaves more hazardous.
The Renter must adjust speed and riding behavior according to conditions.
66. Flooded Roads and Water Crossings
The Renter should not attempt flooded-road travel or water crossings where depth, current, road condition, visibility, or mechanical risk makes the route unsafe.
Damage caused through prohibited or unreasonable water exposure may be chargeable to the Renter under the Rental Agreement.
67. Health and Fitness to Ride
The Renter is responsible for assessing whether the Renter is physically and medically able to operate the Motorbike safely.
Relevant considerations may include: balance; vision; reaction time; fatigue; recent surgery; mobility limitations; medication; illness; heat exposure; dehydration; and other conditions capable of affecting safe riding.
68. Personal Medication
The Renter is responsible for carrying necessary personal medication and medical supplies.
DPTT does not provide medical clearance or medical advice concerning fitness to ride.
69. Emergency Response
In an accident, breakdown, medical emergency, security incident, or other serious event, the Renter should prioritize immediate safety and contact appropriate emergency or Provider resources.
Emergency response may be affected by: location; traffic; weather; road conditions; mobile signal; ambulance availability; police or rescue availability; repair availability; towing availability; local medical facilities; and other circumstances.
Clients should review the Traveler Emergency & Incident Response Guide.
70. Emergency Medical Assistance
Where reasonably necessary, the Provider or another responsible person may seek emergency medical assistance for the Renter or Passenger.
DPTT may assist with communication or coordination where reasonably possible.
The Client remains responsible for personal medical, emergency-transportation, hospital, medicine, accommodation, and other emergency expenses except where another legally responsible party or applicable law provides otherwise.
71. Bookings Made Within Three Days Are Non-Refundable
A Motorbike Rental (Self-Drive) booking first made within three (3) calendar days of the scheduled rental start date is non-refundable from the time the booking is confirmed.
This applies subject to rights that applicable law does not permit the parties to exclude.
Clients making short-notice rentals should confirm their travel plans, licensing, and ability to operate the Motorbike before payment.
72. Other Cancellation and Refund Rules
Other cancellation and refund requests are governed by: the Booking Cancellation, Rescheduling & Refund Policy; Provider rules; unit reservation commitments; delivery or mobilization costs; non-refundable Provider costs; payment-processing expenses; the Rental Agreement; and applicable law.
73. No Prorated Refund for Unused Rental Time
Once the Rental Period has begun and the Motorbike has been accepted, voluntary early return, reduced use, change of plans, weather preferences, or failure to use the Motorbike for the entire reserved period does not automatically create a right to a prorated refund.
74. Tour or Package Destination Changes
If the Motorbike rental forms part of a broader travel package, no prorated refund is due merely because a land or sea tour destination, stop, route, attraction, or itinerary component is skipped, shortened, reordered, replaced, or made unavailable because of safety, weather, road or sea conditions, authority directives, environmental restrictions, or reasonable Provider/operator discretion.
75. Force Majeure
The rental or the Renter’s travel plans may be affected by circumstances beyond reasonable control, including: typhoons; storms; earthquakes; flooding; landslides; fires; road closures; government restrictions; civil disturbances; security incidents; public-health restrictions; fuel-supply interruptions; telecommunications failures; emergency directives; or other comparable events beyond reasonable control.
Refund, extension, substitution, or other consequences depend on Provider terms, the Rental Agreement, Refund Policy, circumstances, and applicable law.
76. Claims Relating to Motorbike Condition or Provider Operations
Where a claim principally concerns a matter controlled by the Provider, the Provider may be responsible for investigating and responding under its procedures and applicable law.
This may include matters involving: Motorbike condition; maintenance; Provider documentation; helmet availability; deposit deductions; fuel charges; damage assessments; repair pricing; downtime charges; Provider insurance or coverage; handover issues; return inspection; or other Provider-controlled rental matters.
77. DPTT Assistance With Provider Disputes
DPTT may, where reasonably appropriate: relay communications; provide Agency-held booking records; forward Client documentation; request Provider clarification; communicate Provider responses; or assist with identifying available procedures.
Such assistance does not constitute an admission of Agency liability and does not guarantee a deposit return, damage decision, insurance outcome, refund, replacement unit, Provider admission, or other requested result.
78. Limitation Relating to Independent Provider Matters
To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, death, Motorbike damage, property damage, theft, loss, delay, expense, breakdown, towing, storage, rental dispute, deposit dispute, repair dispute, insurance dispute, or other loss caused by independent Provider acts or omissions, the acts of other road users, third parties, or circumstances outside DPTT’s reasonable control.
This provision does not exclude any responsibility applicable law places directly and non-waivably upon DPTT.
79. Renter Indemnification
To the fullest extent permitted by law, the Renter agrees to indemnify and hold harmless DPTT and its owners, officers, employees, agents, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Renter’s: illegal conduct; fraud; intentional misconduct; reckless or negligent riding; unauthorized Rider use; prohibited use of the Motorbike; overloading; Passenger use contrary to law or Provider rules; traffic violations; damage caused through wrongful use; material breach of these Terms; material breach of lawful Provider restrictions; or violation of another person’s lawful rights.
This provision does not require the Renter to indemnify DPTT for a legal responsibility applicable law places directly and non-waivably upon the Agency.
80. Privacy and Rental Information
DPTT may collect, use, retain, and share information reasonably necessary for: booking; identification; license verification coordination; Provider coordination; handover; payment verification; extensions; incident documentation; refunds; claims; chargebacks; disputes; and other purposes described in the Privacy & Personal Data Policy.
81. Electronic Communications and Evidence
Electronic records may be used to document the rental.
Such records may include: Booking Confirmations; messages; emails; payment records; driver-license information; identification information; handover photos; handover videos; location pins; extension requests; Provider approvals; incident reports; return photographs; return videos; repair estimates; receipts; and other relevant rental documentation.
82. Controlling DPTT Liability Provision
These Motorbike Rental (Self-Drive) Terms do not establish a separate competing numerical liability cap.
Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, the controlling liability provisions are contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
If a competent court determines D’Palawan Travel and Tours itself to be primarily liable, DPTT’s maximum aggregate monetary liability is limited, to the fullest extent permitted by applicable law, to two (2) times the Cash Received by DPTT from the Client for the specific booking or transaction giving rise to the claim.
The definition and calculation of Cash Received, aggregation of related claims, and other conditions governing that limitation are contained in the controlling Waiver and Liability Disclaimer.
83. Consequential, Missed-Income, and Opportunity Losses
To the fullest extent permitted by applicable law, DPTT shall not be liable for consequential, indirect, incidental, special, exemplary, or punitive losses.
This expressly includes, where legally excludable: missed income;lost wages;lost earnings;lost profits;lost business;lost opportunities;opportunity costs;business interruption;missed work;missed flights or ferries;missed reservations or appointments;additional personal travel expenses; and similar consequential economic losses.
The complete controlling provision appears in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
84. Agency Interpretation and Clarification
These Terms form part of DPTT’s broader legal, booking, operational, safety, and policy framework.
If an Agency provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Renter must request clarification before payment, handover, or use where the matter is material to the rental.
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, rules, and terms, including determining which DPTT provision applies to a particular booking or circumstance.
This right does not authorize DPTT to override mandatory provisions of applicable Philippine law.
85. Provider Rental Agreement Remains Important
The Renter acknowledges that the Provider’s Rental Agreement may contain additional requirements concerning: deposits; Rider eligibility; age restrictions; license requirements; helmets; Passenger use; fuel; extensions; late returns; damage; downtime; insurance or coverage; geographic restrictions; prohibited uses; accident procedures; and other rental-specific matters.
The Client should review and understand those requirements before accepting the Motorbike.
86. Direct Resolution of Complaints and Disputes
If the Renter has a complaint, claim, disagreement, or dispute involving D’Palawan Travel and Tours, the Renter agrees to first provide written notice directly to DPTT through an Official Channel.
The Renter should provide reasonably available supporting information, including where relevant: Booking Confirmation; payment records; Rental Agreement; handover documentation; photographs; videos; Provider communications; extension requests; incident reports; police or barangay reports where applicable; repair documentation; medical records; return records; and other reasonably relevant evidence.
The Renter and DPTT shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.
87. Governing Law and Exclusive Venue
These Terms and disputes arising from or relating to the self-drive Motorbike rental, booking, transaction, communication, or Agency policy are governed by the laws of the Republic of the Philippines.
If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.
The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.
88. Consumer Protection and Non-Waivable Rights
Nothing in these Terms is intended to unlawfully waive, exclude, limit, or restrict any right, responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.
If any provision exceeds what applicable law permits, the provision shall apply only to the maximum lawful extent while the remainder continues in effect.
89. Severability
If a competent authority determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.
The remaining provisions shall continue to operate to the fullest extent permitted by law.
90. No Waiver by Exception or Non-Enforcement
A goodwill refund, credit, deposit accommodation, extension, replacement unit, reduction of a charge, rescheduling arrangement, or other concession granted in a particular case does not: amend these Terms generally; create a precedent; automatically apply to another rental; or waive an otherwise applicable Provider rule.
91. Updates to These Terms
D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; Motorbike options; rental procedures; payment systems; technology; safety practices; government requirements; road and travel conditions; or other relevant circumstances.
The current version will be published at:

Advance bookings must be reconfirmed on the day before the scheduled rental. Bookings first made within three calendar days of the rental start date are non-refundable. Once the Rental Period has begun, early return or reduced use does not automatically create a prorated refund. If the rental forms part of a broader tour or travel package, the Agency’s no-prorated-refund rule for destinations modified or skipped because of safety, weather, road or sea conditions, authority directives, environmental restrictions, or reasonable operational discretion also applies. Where DPTT itself is determined primarily liable by a competent court, the controlling liability limitation is contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer. If anything is unclear, obtain clarification before payment or handover. If you disagree with an applicable provision, do not proceed with the rental.
