These Self-Drive Car Rental: Terms and Conditions (“Terms”) apply to self-drive car and four-wheeled Vehicle rentals coordinated, reserved, booked, arranged, referred, or otherwise assisted by D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).
Under a self-drive rental, the Client accepts possession of a Vehicle supplied by an independent rental Provider or Vehicle owner and personally drives the Vehicle or permits only another driver authorized under the applicable rental arrangement to drive it.
Because the Renter directly possesses and operates the Vehicle, these Terms address additional responsibilities involving: driver eligibility and licensing; authorized drivers; Vehicle inspection and condition documentation; safe operation; traffic-law compliance; prohibited uses; fuel and mileage rules; deposits and identification requirements; rental extensions and late returns; Vehicle damage or loss; mechanical problems; accidents and incident reporting; traffic tickets and penalties; towing, storage, and impoundment; Provider insurance or other coverage, if any; Client financial responsibility; remote-road conditions; emergency procedures; cancellations and refunds; and applicable liability limitations.
Please read these Terms carefully before making payment, accepting the Vehicle, or driving.Booking, reserving, paying for, confirming, accepting delivery, taking possession of, operating, driving, extending the rental of, or otherwise using a self-drive Vehicle coordinated through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms together with all applicable Agency policies, procedures, company processes, Provider requirements, Rental Agreement provisions, safety rules, and regulations.
If anything is unclear, contact D’Palawan Travel and Tours before making payment or accepting the Vehicle.
If you disagree with any applicable provision, do not proceed with the booking, handover, or rental.
1. Definitions

“Client,” “Renter,” “Driver,” “User,” “you,” or “your” means the person who reserves, books, pays for, accepts possession of, drives, operates, or otherwise uses the self-drive Vehicle.
“Provider,” “Supplier,” “Rental Provider,” or “Independent Provider” means the independent rental company, operator, Vehicle owner, business, or individual that owns, controls, supplies, or rents the Vehicle to the Renter.
“Vehicle” means the four-wheeled motor vehicle supplied for self-drive use.
“Authorized Driver” means the Renter or another person expressly permitted to drive the Vehicle under the applicable Provider rules or Rental Agreement.
“Rental Agreement” means the rental contract, receipt, checklist, acknowledgment, deposit arrangement, written terms, electronic terms, or other conditions imposed by the Provider governing possession and use of the Vehicle.
“Rental Period” means the period beginning when the Renter accepts possession of the Vehicle and ending when the Vehicle is properly returned and accepted by the Provider, subject to the applicable Rental Agreement.
“Booking Confirmation” means the applicable written or electronic confirmation, message, itinerary, receipt, voucher, invoice, acknowledgment, or similar booking record.
“Official Channels” means the telephone number, email, website, messaging accounts, and other communication channels identified or authorized by DPTT.
“Calendar days” means consecutive days including weekends and public holidays unless otherwise stated.
2. Vehicle Types Covered
For convenience, the word “Car” may be used generally, but these Terms may apply to various four-wheeled Vehicles, including: sedans; SUVs; crossovers; vans; AUVs; MPVs; pickups; and other similar four-wheeled Vehicles supplied for lawful road use.
The actual Vehicle available depends on the Provider, booking, availability, route expectations, passenger requirements, and Rental Agreement.
3. Scope of These Terms
These Terms apply only to self-drive Vehicle rentals where the Client or another Authorized Driver personally operates the Vehicle.
They apply to: Vehicle reservation; delivery or pickup; handover; Vehicle inspection; Rental Period; extensions; early returns; late returns; fuel requirements; mileage requirements where applicable; damage claims; loss or theft; accidents; breakdowns; towing; storage; impoundment; traffic penalties; deposit disputes; return inspection; and other matters reasonably connected with the same rental transaction.
4. Self-Drive Distinguished From Vehicle With Driver
These Terms do not govern a Vehicle Service where the Provider supplies the Driver and the Client participates only as a passenger.
Where a Driver is supplied with the Vehicle, review the Car Rental With Driver: Terms and Conditions terms.
A Vehicle booked for self-drive use must not be converted informally into another type of arrangement where doing so would violate the Provider’s rules or applicable law.
5. Self-Drive Rental Included in a Tour or Package
Where a self-drive Vehicle rental is included as a component of a larger tour or travel package, these Terms apply together with: the Travel Booking & Service Terms and Conditions; the Tours, Travel Packages, and Service Waiver and Liability Disclaimer; the Booking Cancellation, Rescheduling & Refund Policy; the Booking Confirmation; the Rental Agreement; Provider requirements; and other applicable Agency policies.
6. D’Palawan Travel and Tours’ Role
D’Palawan Travel and Tours operates as a travel coordination and booking agency.
DPTT may assist with: identifying available rental options; checking availability; obtaining quotations; coordinating reservations; relaying Provider eligibility requirements; coordinating handover and return schedules; communicating Vehicle information; coordinating payment arrangements; relaying extension requests; communicating Provider responses; relaying incident information; and providing reasonable booking assistance.
The actual Vehicle is supplied and the rental is performed by the independent Provider responsible for the booking.
7. Provider Responsibility
The Provider generally controls the rental-specific matters applicable to the Vehicle.
Depending on the rental, these may include: Vehicle ownership or authority to supply the Vehicle; Vehicle maintenance; Vehicle condition; roadworthiness; Vehicle documentation; rental eligibility requirements; driver-age requirements; driver-license requirements; security deposits; identification requirements; fuel rules; mileage rules; geographic or road-use restrictions; prohibited uses; extension rules; late-return charges; damage assessment; repair arrangements; insurance or other coverage offered by the Provider, if any; and other Provider-specific rental conditions.
8. Independent Provider Relationship
Independent rental Providers generally maintain their own Vehicles, rental agreements, policies, personnel, maintenance arrangements, insurance arrangements, deposits, and business operations.
A booking, referral, coordination, commission, or other commercial relationship between DPTT and a Provider does not by itself create: employment; partnership; joint venture; common ownership; common fleet management; or common operational control.
9. Limited-Availability and Private Vehicle Arrangements
In some locations or periods, established rental Providers may have limited availability.
Where appropriate and lawful, DPTT may assist the Client in identifying an independent Vehicle owner where the Client requests assistance with finding a self-drive rental.
If the Client proceeds with such an arrangement, the applicable rental conditions remain between the Client and that Vehicle owner, subject to applicable law.
10. Booking Is Not Confirmed Until Acknowledged
An inquiry, quotation, availability request, proposed Vehicle, or preliminary discussion does not by itself guarantee a confirmed rental.
The rental becomes confirmed when:
- DPTT or the applicable Provider acknowledges the reservation as confirmed; and
- any required payment, deposit, identification, licensing information, or other confirmation requirement has been satisfied and verified.
Before confirmation, Vehicle availability, price, pickup arrangements, deposit requirements, and Provider terms remain subject to change.
11. Acceptance of These Terms
The Renter accepts these Terms by: making a reservation; paying a deposit; making partial or full payment; accepting the Booking Confirmation; signing or accepting the Rental Agreement; accepting delivery or handover; taking possession of the Vehicle; driving the Vehicle; requesting an extension; or otherwise using the Vehicle.
12. Day-Before Reconfirmation Is Required
Clients with advance self-drive rental bookings must contact D’Palawan Travel and Tours on the day before the scheduled rental start date to ensure that the booking has been properly acknowledged and to obtain the latest available handover information.
The Renter should verify, as applicable: booking name; rental date; handover time; handover location; Vehicle information; Provider information; identification requirements; driver-license requirements; deposit requirements; payment balance; return arrangements; contact information; and other time-sensitive rental instructions.
13. Driver Eligibility
The Renter must satisfy the Provider’s driver-eligibility requirements and must be legally permitted to operate the Vehicle.
The Renter is responsible for ensuring that: the driver’s license is valid; the license is appropriate for the Vehicle being operated; any age or experience requirements imposed by the Provider are satisfied; the Renter is legally permitted to drive in the Philippines under the circumstances applicable to that Renter; and all information supplied concerning driver eligibility is accurate.
14. Authorized Drivers Only
Only persons authorized under the applicable Rental Agreement or Provider rules may operate the Vehicle.
The Renter must not allow an unauthorized person to drive the Vehicle.
Allowing an unauthorized driver may result in: breach of the Rental Agreement; additional liability; loss or limitation of Provider-provided coverage, if any; financial responsibility for damage; termination of the rental; or other consequences under Provider rules and applicable law.
15. Responsibility for Additional Authorized Drivers
Where the Provider allows more than one Authorized Driver, the booking Renter remains responsible for ensuring that each Authorized Driver understands and follows: the Rental Agreement; these Terms; Provider restrictions; traffic laws; Vehicle-use rules; incident-reporting requirements; and other applicable conditions.
16. Legal and Safe Driving
The Vehicle must be operated lawfully and prudently.
The Driver must comply with applicable: traffic laws; speed limits; seatbelt requirements; parking rules; road restrictions; local ordinances; checkpoint procedures; mobile-phone restrictions; alcohol and drug prohibitions; and other road-safety requirements.
17. No Driving While Impaired
The Vehicle must not be operated while the Driver is impaired by alcohol, illegal drugs, medication, fatigue, or another condition that materially impairs safe driving.
The source rental framework specifically recognizes that impairment materially increases the risk of serious injury or death and may affect any Provider coverage that might otherwise apply.
18. Prohibited Uses
Unless expressly permitted by the Provider and lawful under applicable rules, the Vehicle must not be used for: racing; speed contests; stunts; reckless driving; illegal activity; overloading; unauthorized towing; transporting hazardous materials; prohibited off-road terrain; unsafe river crossings; operation by an unauthorized Driver; or any other use prohibited by the Rental Agreement.
19. Geographic and Road Restrictions
The Provider may impose restrictions regarding where the Vehicle may be driven.
The Renter must clarify applicable geographic or road-use restrictions before undertaking: remote travel; rough or unpaved roads; mountain roads; roads affected by flooding; construction roads; off-road routes; river crossings; restricted areas; or other routes that may fall outside ordinary road use.
20. Vehicle Inspection Before Acceptance
The Renter should inspect the Vehicle before driving it.
The inspection should reasonably include: visible scratches; dents; body damage; tires; lights; wipers; horn; mirrors; seatbelts; steering; braking response; and other obvious matters that may affect ordinary use or condition documentation.
If the Renter identifies a material safety concern or a condition materially different from what was agreed, the Renter should raise the issue with the Provider before accepting or driving the Vehicle.
21. Pre-Rental Photo and Video Documentation
The Renter is strongly encouraged to take clear photographs or video of the Vehicle at handover.
Documentation should reasonably record: existing scratches; dents; visible body condition; wheels and tires; windshield and glass; interior condition; fuel level where relevant; odometer where relevant; and other visible matters that may later become the subject of a condition dispute.
Such documentation may help distinguish pre-existing condition from damage arising during the Rental Period.
22. Handover Record
Where a Provider uses a checklist, inspection form, acknowledgment, photographs, or electronic condition record, the Renter should review the record before accepting the Vehicle.
Any disagreement concerning visible pre-existing damage should be raised before departure where reasonably possible.
23. Acceptance of Possession
Once the Renter accepts the Vehicle and begins the Rental Period, the Renter assumes responsibility for possession and lawful use of the Vehicle, subject to: the Rental Agreement; Provider rules; these Terms; and applicable law.
24. Duty of Reasonable Care
During the Rental Period, the Renter must exercise reasonable care in possessing and operating the Vehicle.
This includes: driving conservatively; reducing speed in rain or poor visibility; avoiding unnecessary risks; observing warning indicators; protecting the Vehicle when parked; using the Vehicle only within permitted conditions; and stopping operation when a serious mechanical or safety problem is reasonably suspected.
25. Mechanical Warning Signs
If the Vehicle develops warning signs such as: warning lights; overheating; brake problems; steering problems; unusual noises; significant tire problems; electrical problems; or another condition reasonably suggesting unsafe continued operation, the Renter should stop using the Vehicle as soon as it is safe to do so and promptly contact the Provider.
Continuing to operate a Vehicle after becoming aware of a serious mechanical or safety warning may worsen damage or increase risk and may affect responsibility under the Rental Agreement and applicable law.
26. Breakdown Procedures
If the Vehicle breaks down, the Renter should: move to a reasonably safe location where practicable; avoid continued operation if doing so may worsen the problem; contact the Provider promptly; follow reasonable Provider instructions; document the circumstances where useful; and contact emergency authorities if the situation creates an immediate safety hazard.
27. Repairs
The Renter should not authorize substantial repairs, replacement parts, or significant mechanical work without Provider approval except where an immediate emergency reasonably requires action and communication is genuinely unavailable.
Responsibility for repair expenses is determined by: the cause of the problem; the Rental Agreement; Provider policy; available evidence; Client conduct; and applicable law.
28. Fuel Policy
The Provider may impose a fuel policy applicable to pickup and return.
The Renter is responsible for understanding the applicable fuel requirement before accepting the Vehicle.
Depending on the Rental Agreement, the Vehicle may be required to be returned with a specified fuel level.
Additional charges may apply where the Renter does not comply with the agreed fuel requirement, subject to Provider rules and applicable law.
29. Fuel Planning
When traveling to remote areas, the Renter should consider that fuel stations may be: limited; far apart; closed at certain hours; temporarily unavailable; or not located along the intended route.
The Renter is responsible for reasonable fuel planning during the Rental Period.
30. Mileage Rules
Where the Provider imposes mileage limits, kilometer limits, or geographic restrictions, the Renter must comply with those requirements.
Any excess-mileage or excess-distance charge is governed by the Rental Agreement.
31. Rental Period
The Rental Period begins and ends according to the handover and return arrangements established by the Provider.
The Renter should confirm: start date; start time; return date; return time; pickup or delivery point; return location; extension procedure; and late-return consequences.
32. Rental Extensions
An extension is not automatic.
A Renter who wants to keep the Vehicle beyond the confirmed Rental Period must contact the Provider or DPTT sufficiently in advance for approval.
Any extension is subject to: Vehicle availability; Provider approval; additional rental charges; existing future bookings; payment of required amounts; and other Provider conditions.
33. Unauthorized Extension
Keeping the Vehicle beyond the confirmed Rental Period without approval may result in: late-return charges; additional rental charges; Provider recovery action; loss of deposit; claims for additional losses where legally recoverable; or other consequences under the Rental Agreement and applicable law.
34. Late Return
The Vehicle must be returned at the agreed time unless an extension has been approved.
Late-return fees or additional rental charges may apply under Provider rules.
The Renter should promptly communicate any circumstance likely to delay return.
35. Early Return
Returning the Vehicle before the end of the confirmed Rental Period does not automatically create a right to a prorated refund.
Refund eligibility, if any, is governed by the Provider rules, the Booking Cancellation, Rescheduling & Refund Policy, and applicable law.
36. Vehicle Return Inspection
The Provider may inspect the Vehicle upon return.
The return inspection may consider: new visible damage; Vehicle condition; fuel level; mileage where applicable; cleanliness; missing Provider property; return time; and other matters covered by the Rental Agreement.
37. Return Photo and Video Documentation
The Renter is encouraged to photograph or video the Vehicle when returning it, particularly where condition, fuel level, mileage, or timing may later be disputed.
38. Damage During the Rental Period
Responsibility for Vehicle damage is governed by the Rental Agreement, cause of damage, available evidence, Provider rules, and applicable law.
The Renter may be financially responsible for damage caused by: collision; reckless or negligent use; prohibited use; unauthorized Driver use; overloading; misuse; continued operation after known mechanical warning signs; unlawful conduct; or another circumstance for which the Renter is responsible under the Rental Agreement or applicable law.
39. Normal Wear and Tear
Responsibility for ordinary wear and tear should be distinguished from chargeable damage according to the Rental Agreement and applicable law.
The Renter should use handover and return documentation to reduce unnecessary disputes concerning pre-existing condition or ordinary use.
40. Damage Assessment
The Provider may assess Vehicle damage through its own inspection process and may obtain repair estimates or technical evaluation.
Any amount claimed should remain subject to: the Rental Agreement; available condition evidence; repair documentation where applicable; causation; Provider policies; and applicable law.
DPTT does not independently determine Vehicle repair costs or technical damage assessments.
41. Vehicle Theft or Loss
If the Vehicle is stolen, lost, or otherwise cannot be accounted for during the Rental Period, the Renter must promptly: notify the Provider; contact competent authorities where appropriate; cooperate with lawful reporting requirements; provide available information concerning the circumstances; and preserve relevant documentation.
Financial responsibility is governed by the Rental Agreement, available insurance or coverage if any, applicable law, and the circumstances of the loss.
42. Security Deposits
A Provider may require a security deposit as a condition of rental.
The Client should clarify before payment: deposit amount; method of payment; conditions for deductions; return procedure; timing of return; and documentation required for release of the deposit.
43. Deposit Deductions
Subject to the Rental Agreement and applicable law, a Provider may seek deductions for amounts properly chargeable in connection with: Vehicle damage; late return; fuel deficiency; applicable excess mileage; traffic or parking violations; towing or storage; missing Provider property; other properly documented rental obligations; or other amounts validly due under the Rental Agreement.
44. Identification Requirements
The Provider may require valid identification and driver-license documentation before handover.
The Renter must provide accurate and authentic documents as required for lawful rental processing.
45. Custody of Identification Documents
If a Provider proposes to retain physical identification as part of its rental process, the Renter should understand and agree to the applicable arrangement before handover and should retain appropriate alternative identification for travel where necessary.
Any custody, return, timing, or dispute involving identification held directly by the Provider is governed by the arrangement between the Provider and Renter and by applicable law.
DPTT does not independently hold identification unless expressly documented otherwise.
46. Traffic Tickets and Violations
The Renter is responsible for traffic violations occurring through use of the Vehicle during the Rental Period to the extent provided by applicable law and the Rental Agreement.
This may include: speeding; illegal parking; traffic-sign violations; reckless driving; prohibited road use; checkpoint violations; other traffic offenses; and lawful fines or penalties arising from the Renter’s use.
47. Tolls and Road Charges
Where tolls or other road charges apply to the Renter’s route, responsibility for those amounts is governed by the Rental Agreement.
48. Towing and Storage
If the Vehicle requires towing or storage during the Rental Period, responsibility for the resulting costs depends on: the reason towing became necessary; the Rental Agreement; Provider policy; Client conduct; Vehicle condition; available insurance or coverage, if any; and applicable law.
49. Impoundment
If competent authorities impound, detain, or otherwise hold the Vehicle, the Renter must cooperate with the Provider and applicable authorities.
Where impoundment results from the Renter’s violation, prohibited use, unauthorized Driver, or other Client-caused circumstance, the Renter may be responsible for: fines; release fees; towing; storage; Provider expenses; and other amounts lawfully recoverable under the Rental Agreement.
Where the issue arises from Provider-controlled documentation or another matter not caused by the Renter, responsibility shall be determined by the applicable facts, Rental Agreement, and law.
50. Accidents
If an accident occurs, the Renter must prioritize immediate safety.
The Renter should, as applicable: stop safely; seek medical assistance where necessary; contact competent authorities where required; notify the Provider promptly; notify DPTT if Agency coordination assistance is requested; document the scene where safe and lawful; obtain relevant third-party information; preserve witness details where available; and follow reasonable Provider instructions.
51. Accident Documentation
Where reasonably possible, the Renter should preserve: photographs; videos; Vehicle condition; other Vehicle information; driver information; witness information; police or authority reports; medical records; receipts; messages; and other relevant evidence.
52. Third-Party Property Damage or Injury
If the Renter is involved in an incident affecting another person or property, responsibility shall be determined under the facts, Rental Agreement, applicable insurance or coverage, and Philippine law.
The Renter must not assume that the Vehicle automatically includes unlimited third-party coverage.
53. Provider Insurance or Rental Coverage
Where a Provider states that insurance or other rental coverage exists, the Renter should understand that such coverage may be subject to: policy limits; deductibles; participation fees; authorized-Driver requirements; age restrictions; geographical restrictions; prohibited-use exclusions; reporting deadlines; police-report requirements; documentation requirements; alcohol or drug exclusions; coverage exclusions; and insurer or Provider determination.
54. No Assumption of Full Insurance Coverage
The Client should not assume that the words “insured,” “covered,” or similar descriptions mean that every loss, accident, repair, injury, or third-party claim will be fully paid.
If insurance or coverage is material to the Client’s decision, the Client should request details before accepting the Vehicle.
55. DPTT and Provider Insurance
DPTT does not guarantee the existence, scope, adequacy, continued validity, exclusions, deductibles, claim approval, or collectability of independent Provider insurance or rental coverage unless expressly verified and confirmed in writing.
56. Road and Driving Risks
Self-driving involves inherent risks that cannot be completely eliminated.
Possible risks include: collisions; side impacts; rear-end accidents; pedestrian incidents; animal crossings; road debris; potholes; blind curves; sudden braking; reckless acts of other motorists; flooding; landslides; falling rocks or debris; poor visibility; road construction; narrow bridges; uneven roads; mud; unmarked hazards; mechanical failure; brake problems; tire failure; electrical failure; overheating; towing delays; repair delays; limited mobile signal; limited emergency response; and other ordinary road-travel risks.
57. Remote Travel
Some routes may involve: rural roads; limited lighting; weak mobile signal; limited towing services; limited repair facilities; limited fuel stations; long distances from hospitals or clinics; temporary road closures; construction; seasonal flooding; or other remote-area conditions.
The Renter is responsible for reasonable trip planning and conservative driving decisions in such areas.
58. Travel-Time Estimates
Estimated travel times are not guarantees.
Weather, roadworks, checkpoints, flooding, landslides, traffic, mechanical circumstances, and Client route choices may cause significant delays.
59. Passenger Safety
The Renter is responsible for operating the Vehicle safely for passengers.
The Renter must: observe passenger-capacity limits; avoid overloading; ensure appropriate seatbelt use; drive according to conditions; avoid unsafe distractions; and comply with applicable child-safety requirements.
60. Child Safety
The Renter is responsible for compliance with applicable child-safety requirements.
If a child seat or booster seat is required or desired, the Renter should determine availability before handover and ensure proper installation and use.
61. Passenger Conduct
The Renter is responsible for reasonable management of passengers whose conduct may affect safe Vehicle operation.
The Renter must not permit passengers to: materially distract the Driver; interfere with Vehicle controls; overload the Vehicle; carry prohibited hazardous materials; engage in conduct materially affecting safe operation; or otherwise cause unlawful or reckless Vehicle use.
62. Personal Belongings
The Renter and passengers remain responsible for personal belongings kept in or around the Vehicle.
Clients should appropriately safeguard: cash; passports; identification; phones; cameras; jewelry; medication; electronics; travel documents; and other valuables.
63. Emergency Response
In an accident, medical emergency, breakdown, security incident, or other serious event, the Renter should first prioritize immediate safety and contact appropriate emergency or Provider resources.
Emergency response may be affected by: location; traffic; weather; road conditions; mobile signal; ambulance availability; police or rescue availability; repair availability; towing availability; local medical facilities; and other circumstances.
Clients should review the Traveler Emergency & Incident Response Guide.
64. Emergency Medical Assistance
Where reasonably necessary, the Provider or another responsible person may seek emergency medical assistance for the Renter or passenger.
DPTT may assist with communication or coordination where reasonably possible.
The Client remains responsible for personal emergency and medical expenses except where another legally responsible party or applicable law provides otherwise.
65. Bookings Made Within Three Days Are Non-Refundable
A Car Rental (Self-Drive) booking first made within three (3) calendar days of the scheduled rental start date is non-refundable from the time the booking is confirmed.
This applies subject to rights that applicable law does not permit the parties to exclude.
Clients making short-notice rentals should ensure that their plans and driver eligibility are confirmed before payment.
66. Other Cancellation and Refund Rules
Other cancellation and refund requests are governed by: the Booking Cancellation, Rescheduling & Refund Policy; Provider rules; Vehicle reservation commitments; non-refundable Provider costs; delivery or mobilization costs; payment-processing expenses; the Rental Agreement; and applicable law.
67. No Prorated Refund for Unused Rental Time
Once the Rental Period has begun and the Vehicle has been accepted, voluntary early return, change of plans, reduced use, or failure to use the Vehicle for the entire reserved period does not automatically create a right to a prorated refund.
68. Tour and Package Destination Changes
If the self-drive rental forms part of a broader tour or travel package, no prorated refund is due merely because a land or sea tour destination, stop, route, attraction, or itinerary component is skipped, shortened, reordered, replaced, or made unavailable because of safety, weather, road or sea conditions, authority directives, environmental restrictions, or reasonable Provider/operator discretion.
The applicable package-level rules are contained in the Refund Policy and the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
69. Force Majeure
The rental or the Renter’s travel plans may be affected by circumstances beyond reasonable control, including: typhoons; storms; earthquakes; flooding; landslides; fires; road closures; government restrictions; civil disturbances; security incidents; public-health restrictions; fuel-supply interruptions; utility failures; telecommunications failures; emergency directives; or other comparable circumstances.
Refund, extension, substitution, or other consequences depend on the Provider terms, Rental Agreement, Refund Policy, circumstances, and applicable law.
70. Claims Relating to Vehicle Condition or Rental Operations
Where a claim principally concerns matters controlled by the independent Provider, the Provider may be responsible for investigating and responding under its procedures and applicable law.
Such matters may include: Vehicle condition; maintenance; Provider documentation; deposit deductions; fuel charges; mileage charges; damage assessments; repair pricing; Provider insurance or coverage; Vehicle substitution; handover issues; return inspection; or other Provider-controlled rental matters.
71. DPTT Assistance With Provider Disputes
DPTT may, where reasonably appropriate: relay communications; provide Agency-held booking records; forward Client documentation; request Provider clarification; communicate Provider responses; or assist with identifying available procedures.
Such assistance does not constitute an admission of Agency liability and does not guarantee a deposit return, damage decision, insurance outcome, refund, replacement Vehicle, Provider admission, or other requested result.
72. Limitation Relating to Independent Provider Matters
To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, property damage, Vehicle damage, loss, delay, expense, breakdown, rental dispute, deposit dispute, towing cost, repair dispute, insurance dispute, or other damage caused by the independent acts, omissions, operational decisions, negligence, misconduct, or non-performance of the Provider, Vehicle owner, other road user, or unrelated third party where the matter is outside DPTT’s reasonable control.
This provision does not exclude any responsibility applicable law places directly and non-waivably upon DPTT.
73. Renter Indemnification
To the fullest extent permitted by applicable law, the Renter agrees to indemnify and hold harmless DPTT and its owners, officers, employees, agents, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Renter’s: illegal conduct; fraud; intentional misconduct; reckless or negligent driving; unauthorized Driver use; prohibited use of the Vehicle; overloading; traffic violations; damage caused through wrongful use; material breach of these Terms; material breach of lawful Provider restrictions; or violation of another person’s lawful rights.
This provision does not require the Renter to indemnify DPTT for a legal responsibility applicable law places directly and non-waivably upon the Agency.
74. Personal Insurance
The Renter may wish to obtain or verify personal travel, accident, medical, or other insurance appropriate to the intended use of the Vehicle.
Any personal insurance remains subject to its own terms and exclusions.
75. Privacy and Rental Information
DPTT may collect, use, retain, and share information reasonably necessary for: booking; identity verification; driver eligibility coordination; Provider coordination; handover; payment verification; extensions; incident documentation; refunds; claims; chargebacks; disputes; and other legitimate purposes described in the Privacy & Personal Data Policy.
76. Electronic Communications and Evidence
Electronic records may be used to document the rental.
These may include: Booking Confirmations; messages; emails; payment records; driver-license or identification information; handover photographs; handover videos; GPS or location pins; extension requests; Provider approvals; incident reports; return photographs; return videos; repair estimates; receipts; and other relevant rental documentation.
77. Controlling DPTT Liability Provision
These Car Rental (Self-Drive) Terms do not establish a separate competing numerical liability cap.
Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, the controlling liability provisions are contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
If a competent court determines D’Palawan Travel and Tours itself to be primarily liable, DPTT’s maximum aggregate monetary liability is limited, to the fullest extent permitted by applicable law, to two (2) times the Cash Received by DPTT from the Client for the specific booking or transaction giving rise to the claim.
The definition and calculation of Cash Received, aggregation of related claims, and other conditions governing that limitation are contained in the controlling Waiver and Liability Disclaimer.
78. Consequential, Missed-Income, and Opportunity Losses
To the fullest extent permitted by applicable law, DPTT shall not be liable for consequential, indirect, incidental, special, exemplary, or punitive losses.
This expressly includes, where legally excludable: missed income;lost wages;lost earnings;lost profits;lost business;lost opportunities;opportunity costs;business interruption;missed work;missed flights or ferries;missed reservations or appointments;additional personal travel expenses; and similar consequential economic losses.
The full controlling provision appears in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
79. Agency Interpretation and Clarification
These Terms form part of DPTT’s broader legal, booking, operational, safety, and policy framework.
If an Agency provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Renter must request clarification before payment, handover, or use where the matter is material to the rental.
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, rules, and terms, including determining which DPTT provision applies to a particular booking or circumstance.
This right does not authorize DPTT to override mandatory provisions of applicable Philippine law.
80. Provider Rental Agreement Remains Important
The Renter acknowledges that the Provider’s Rental Agreement may contain additional self-drive requirements concerning: deposits; eligible Drivers; age restrictions; Vehicle use; fuel; mileage; extensions; late returns; damage; insurance or coverage; geographic restrictions; prohibited uses; accident procedures; and other rental-specific matters.
The Client should review and understand those requirements before accepting the Vehicle.
81. Direct Resolution of Complaints and Disputes
If the Renter has a complaint, claim, disagreement, or dispute involving D’Palawan Travel and Tours, the Renter agrees to first provide written notice directly to DPTT through an Official Channel.
The Renter should provide reasonably available supporting information, including where relevant: Booking Confirmation; payment records; Rental Agreement; handover records; photographs; videos; Provider communications; extension requests; incident reports; police or authority reports; repair documentation; medical records; return records; and other reasonably relevant evidence.
The Renter and DPTT shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.
82. Governing Law and Exclusive Venue
These Terms and disputes arising from or relating to the self-drive rental, booking, transaction, communication, or Agency policy are governed by the laws of the Republic of the Philippines.
If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.
The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.
83. Consumer Protection and Non-Waivable Rights
Nothing in these Terms is intended to unlawfully waive, exclude, limit, or restrict any right, responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.
If any provision exceeds what applicable law permits, the provision shall apply only to the maximum lawful extent while the remainder continues in effect.
84. Severability
If a competent authority determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.
The remaining provisions shall continue to operate to the fullest extent permitted by law.
85. No Waiver by Exception or Non-Enforcement
A goodwill refund, credit, deposit accommodation, extension, alternative Vehicle, rescheduling arrangement, reduction in a charge, or other concession granted in a particular case does not: amend these Terms generally; create a precedent; automatically apply to another rental; or waive an otherwise applicable Provider rule.
86. Updates to These Terms
D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; Vehicle options; rental procedures; payment systems; technology; safety practices; government requirements; road and travel conditions; or other relevant circumstances.
The current version will be published at:
https://bookwithoutcreditcard.com/carrentalterms-selfdrive
Updates generally apply to future bookings and subsequent use while existing transactions remain subject to the terms and mandatory laws legally applicable to them.

Advance bookings must be reconfirmed on the day before the scheduled rental. Bookings first made within three calendar days of the rental start date are non-refundable. Once the Rental Period has begun, early return or reduced use does not automatically create a prorated refund. If the self-drive rental forms part of a larger tour or travel package, the Agency’s no-prorated-refund rule for land and sea destinations modified for safety, weather, authority, environmental, or reasonable operational reasons also applies. Where DPTT itself is determined primarily liable by a competent court, the controlling liability limitation is contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer. If anything is unclear, obtain clarification before payment or handover. If you disagree with an applicable provision, do not proceed with the rental.
