By accessing, browsing, submitting information through, or otherwise using this Site, you acknowledge that you have read, understood, and agreed to these Terms to the extent applicable to your use.

If you proceed beyond general browsing and make an inquiry, reservation, booking, deposit, partial payment, full payment, confirmation, waiver acceptance, or otherwise avail any service through D’Palawan Travel and Tours, you also agree to the Agency’s applicable Terms of Service, policies, service-specific terms, client responsibilities, company processes, Provider requirements, safety rules, and other applicable regulations.

If any provision is unclear, please contact us and obtain clarification before making payment or proceeding with a booking. If you disagree with any applicable provision, policy, process, rule, or condition, do not book, pay for, participate in, or otherwise avail the affected service.

1. Definitions

“Agency,” “DPTT,” “we,” “us,” or “our” means D’Palawan Travel and Tours.

“Provider,” “Supplier,” or “Independent Provider” means an independent third party involved in supplying or performing a travel-related service, including tour operators, transport suppliers, drivers, vehicle owners, boat operators, vessel owners, captains, crew, guides, accommodation providers, rental suppliers, activity providers, venues, attractions, and other tourism-related businesses or individuals.

“Services” means travel-related arrangements coordinated or facilitated through the Agency, including tours, travel packages, land and sea transfers, airport transfers, rentals, accommodations, activities, permits, entrance fees, transportation, and related services.

2. Scope of These Terms of Use

These Terms primarily govern use of the Site and Site-related communications.

When you actually reserve, pay for, book, participate in, receive, or use a travel-related Service, additional documents and requirements apply. These may include the Travel Booking & Service Terms and Conditions, Booking Cancellation, Rescheduling & Refund Policy, service-specific terms, Provider rules, safety requirements, booking confirmations, and other Site Policies relevant to the particular Service.

The different policies are intended to operate together. A provision dealing specifically with a particular type of service, transaction, risk, or situation may supplement these general Terms.

3. Acceptance of the Agency’s Policies

Booking, reserving, paying for, confirming, participating in, receiving, using, or otherwise availing any Service through D’Palawan Travel and Tours constitutes acceptance of all applicable Agency terms, policies, procedures, company processes, service-specific rules, Provider requirements, safety instructions, and applicable regulations.

Acceptance may be evidenced by any lawful means, including:

submitting a reservation or booking request; making a deposit, partial payment, or full payment; signing or electronically accepting a waiver or agreement; replying with words such as “Confirmed,” “Agree,” “Yes,” or similar confirmation; accepting a booking confirmation or itinerary; appearing at a scheduled pickup or meeting point; boarding a vehicle or vessel; accepting possession of a rental unit; participating in a tour, activity, transfer, rental, or travel package; or; otherwise knowingly availing the Service.

If anything is unclear, incomplete, inconsistent, or important to your decision, you must request clarification before payment or participation.

If you disagree with any applicable provision, do not proceed with the booking, payment, reservation, participation, rental, transfer, tour, or other Service.

4. Electronic Communications and Evidence of Acceptance

To the fullest extent permitted by applicable law, electronic records may be used to establish communications, instructions, acknowledgments, changes, approvals, and acceptance.

Relevant records may include:

emails; SMS messages; WhatsApp, Viber, WeChat, Telegram, Messenger, and similar messages; website form submissions; electronic signatures; screenshots; booking and reservation records; payment confirmations and receipts; timestamped communications; photos or videos provided for documentation; and; other electronic business records.

Such records may be retained and used for coordination, accounting, compliance, verification, customer support, incident documentation, fraud prevention, and dispute resolution, subject to the Privacy & Personal Data Policy and applicable law.

5. Relationship Between These Terms and Other Policies

Travel arrangements can involve several documents at the same time. For practical interpretation:

Website access, content, tools, submissions, and Site functionality: these Terms of Use primarily apply; Bookings, tours, transfers, rentals, travel packages, accommodations, activities, scheduling, and payments: the Travel Booking & Service Terms and Conditions, booking confirmation, applicable service terms, and Provider requirements apply; Cancellations, no-shows, changes, credits, and refunds: the Booking Cancellation, Rescheduling & Refund Policy and applicable Provider rules apply; Personal information and data processing: the Privacy & Personal Data Policy applies; Travel risks, operational limitations, and liability: the applicable service-specific terms, General Travel, Website & Service Disclaimer, and Tours, Travel Packages, and Service Waiver and Liability Disclaimer apply; Pre-travel, on-tour, and emergency responsibilities: the Agency’s corresponding responsibility and emergency pages apply.

6. Clarification and Agency Interpretation of Policies

The Agency’s policies are intended to operate consistently. However, travel arrangements may involve different Services, Providers, booking messages, operational requirements, and circumstances.

If any provision appears unclear, ambiguous, incomplete, or potentially inconsistent, the Client agrees to seek clarification through the Contact Us page or another Official Channel before making payment or proceeding with the Service.

To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, rules, procedures, booking conditions, company processes, and terms, including determining which Agency policy applies to a particular booking, transaction, or circumstance.

Any such interpretation shall be made in good faith, based on the applicable policies, booking records, Provider requirements, circumstances known to the Agency, and applicable law.

Nothing in these Terms is intended to eliminate or unlawfully restrict rights that cannot legally be waived.

7. Eligibility and Legal Capacity

By using the Site to enter into a booking or transaction, you represent that you possess the legal capacity necessary to enter into the applicable agreement.

A minor may access general travel information, but bookings, payments, contractual acceptance, and waiver acceptance for a minor must be handled by a parent, legal guardian, or other person legally authorized to act for the minor.

If you make a booking on behalf of another person or group, you represent that you have authority to submit their necessary booking information and coordinate the arrangement on their behalf.

The person making a group booking is responsible for communicating applicable booking information, policies, safety instructions, requirements, and changes to the members of the group.

8. Responsible and Lawful Use of the Site

You agree to use the Site responsibly and only for lawful purposes.

You must not:

submit intentionally false, fraudulent, misleading, defamatory, abusive, or unlawful information; misrepresent your identity or authority to act for another person; attempt unauthorized access to any Site, account, server, database, or related system; introduce malware, malicious code, viruses, or other harmful technology; interfere with, overload, disable, damage, or disrupt Site operations; bypass security or access restrictions; systematically scrape, harvest, copy, or extract Site information through unauthorized automated means; use Site content for unauthorized commercial reproduction or resale; or; use the Site in violation of applicable Philippine law or the rights of another person.

The Agency may restrict, suspend, block, or terminate access where reasonably necessary to protect the Site, Clients, Providers, business systems, intellectual property, or other users.

9. Purpose of the Site

The Site is intended to provide information about D’Palawan Travel and Tours, destinations, tourism-related services, booking options, travel planning, policies, responsibilities, and related matters.

It may include:

destination information; sample itineraries; travel guides and articles; tour and package descriptions; transfer and rental information; photos and videos; inquiry and booking features; links to Providers or third-party platforms; maps, route information, or travel estimates; legal and safety information; and; other travel-planning resources.

Information provided for general planning purposes should not be understood as a guarantee that a particular destination, Provider, route, schedule, inclusion, vehicle, vessel, activity, accommodation, or other travel component will remain available or unchanged.

10. D’Palawan Travel and Tours’ Agency Role

D’Palawan Travel and Tours operates as a travel coordination and booking agency. The Agency assists Clients in identifying available options, requesting quotations, communicating booking requirements, arranging reservations, coordinating schedules, collecting or transmitting booking information, confirming meeting points, and assisting with travel logistics.

Travel packages and individual Services may be fulfilled by independent third-party Providers.

Each Provider remains responsible for the operational aspects of the Service it performs, which may include:

staffing and personnel; drivers, guides, captains, and crew; vehicle and vessel assignment; maintenance and equipment condition; route selection; departure and operational timing; passenger and baggage limitations; safety procedures; onsite supervision; weather and operational assessments; permits and regulatory requirements applicable to its operations; and; other day-to-day service delivery decisions.

The Agency may assist in communicating with a Provider regarding an operational concern, but such coordination does not transfer control of the Provider’s operations to D’Palawan Travel and Tours.

11. Independent Provider Performance

Because some Services are performed by independent Providers, circumstances can arise from Provider acts, omissions, decisions, staffing, equipment, maintenance, availability, scheduling, or operational performance.

To the fullest extent permitted by law, D’Palawan Travel and Tours shall not be responsible for losses, injuries, delays, missed connections, cancellations, service interruptions, property damage, or other consequences caused by the independent acts or omissions of a Provider or unrelated third party where such matter was outside the Agency’s reasonable control.

The responsible Provider may have its own terms, policies, complaint procedures, refund conditions, insurance arrangements, evidence requirements, and claim procedures. DPTT may assist with communications when reasonably possible, but such assistance does not guarantee approval of a claim, compensation, replacement, credit, refund, or particular outcome.

12. Dynamic Travel Conditions

Travel conditions can change quickly, particularly in island, coastal, rural, and remote destinations.

Schedules, routes, departure points, meeting locations, stops, attractions, activities, and inclusions may be affected by circumstances such as:

weather; sea conditions, tides, wind, and currents; flooding, landslides, road conditions, and traffic; mechanical or equipment issues; port or airport restrictions; Philippine Coast Guard or other government directives; environmental or protected-area regulations; permit requirements; visitor capacity restrictions; security conditions; Provider availability; transportation delays; local events; emergencies; or; other circumstances that cannot reasonably be controlled or predicted.

Clients agree to maintain reasonable flexibility where changes are required for safety, regulatory compliance, operational necessity, or circumstances outside the reasonable control of the Agency or Provider.

13. Website Information and Best-Effort Updates

D’Palawan Travel and Tours makes reasonable efforts to provide useful and current information. However, travel information is highly dynamic, and information may become outdated after publication.

The Agency therefore does not guarantee that every item appearing on the Site will always be complete, current, error-free, or appropriate for every traveler or circumstance.

Information that may change includes:

prices; availability; routes; operating schedules; travel times; opening or closing times; entrance and environmental fees; permit requirements; pickup and meeting points; inclusions and exclusions; Provider policies; government regulations; equipment or vehicle assignments; and; weather-dependent activities.

The Agency may correct, modify, update, reorganize, replace, or remove Site content when reasonably necessary.

14. Independent Verification of Important Information

Travelers are responsible for verifying information that is material to their travel decisions, particularly where mistakes or delays could have significant consequences.

Examples include:

airline departure and check-in requirements; ferry and sea-transfer schedules; passport, visa, and immigration requirements; government identification requirements; medical or fitness requirements; permit and manifest information; weather and official advisories; road and port closures; environmental and protected-area regulations; Provider-specific rules; baggage, passenger, or weight limitations; and; time-sensitive onward connections.

Where appropriate, Clients should confirm critical information with the Provider, airline, government authority, tourism office, port authority, accommodation provider, or other responsible entity.

15. Booking Confirmation for Advance Reservations

Clients who make advance reservations must reconfirm with D’Palawan Travel and Tours on the day before the scheduled tour to ensure that the booking has been properly acknowledged and that the latest operational information has been received.

Where relevant, the same practice should be followed for advance transfers, rentals, and other scheduled Services.

The day-before confirmation allows the Agency or Provider to communicate information such as:

final meeting or pickup point; departure or pickup window; Provider assignment; weather-related updates; manifest or identification requirements; route adjustments; equipment, vehicle, or vessel changes; what to bring; and; other time-sensitive operational instructions.

Clients should review the latest confirmation rather than relying exclusively on older messages, quotations, preliminary schedules, or sample itineraries.

16. Prices, Inclusions, and Service Descriptions

Prices, inclusions, exclusions, schedules, and package descriptions displayed on the Site may be indicative and subject to change before a booking is confirmed.

Prices and availability may be influenced by:

season and demand; Provider pricing; fuel or transportation costs; government or environmental fees; group size; route and distance; vehicle or vessel type; accommodation availability; additional services requested; and; other operational factors.

The details stated in the applicable Booking Confirmation, together with relevant Provider terms and Agency policies, govern the confirmed transaction.

17. Itinerary Changes, Substitutions, and Skipped Destinations

Travel itineraries may need to be modified before or during performance because of safety considerations, weather, sea conditions, road conditions, official directives, Provider operational requirements, environmental limitations, mechanical issues, or other reasonable circumstances.

Depending on the circumstances, changes may include:

altering the order of destinations; changing routes; changing pickup or departure points; changing schedules; replacing a Provider, vehicle, or vessel; substituting an activity or destination; shortening a stop; skipping a destination; or; ending an activity early for safety or compliance reasons.

For land and sea tours, no prorated or proportional refund is provided merely because one or more destinations, attractions, stops, or itinerary components are skipped, shortened, changed, or made unavailable because of safety considerations, weather or sea conditions, government or authority directives, road conditions, or the Provider/operator’s reasonable operational discretion.

Refund eligibility, where applicable, remains governed by the Booking Cancellation, Rescheduling & Refund Policy, the applicable Provider rules, and mandatory provisions of law.

18. Bookings Made Within Three Days

A booking made within three (3) calendar days of the scheduled Service date is non-refundable.

Clients making short-notice bookings are responsible for confirming that their schedule, participant information, travel arrangements, and requirements are final before payment.

This rule is subject to rights or remedies that cannot lawfully be excluded and should be read together with the complete Booking Cancellation, Rescheduling & Refund Policy.

19. No-Show, Late Arrival, and Missed Connections

Clients are responsible for arriving at the required meeting or pickup point at the instructed time and for maintaining reasonable travel buffers.

Flights, ferries, road transfers, tours, ports, protected areas, and activity Providers may impose strict departure, boarding, check-in, manifest, and cutoff times.

A late arrival, missed pickup, incorrect meeting point, missing documentation, inability to contact the Client, or failure to comply with required check-in procedures may result in the Service proceeding without the Client and may be treated as a no-show under the applicable Booking Cancellation, Rescheduling & Refund Policy and Provider rules.

Clients should avoid scheduling onward flights, ferries, appointments, or other fixed commitments without reasonable allowance for travel delays.

20. Photos, Videos, Maps, and Other Media

Photographs, videos, maps, illustrations, route displays, and other visual material on the Site are provided for general reference and presentation.

Actual conditions may differ because of:

weather; season; tide; time of day; lighting; camera angle; image processing; screen or device settings; renovations or natural changes; vehicle, vessel, accommodation, or equipment substitutions; or; other operational or environmental circumstances.

Maps and estimated travel times should also be treated as general planning references unless expressly confirmed for the specific booking.

21. Blog Posts, Guides, and Informational Content

Articles, destination guides, sample itineraries, travel tips, and similar Site content are provided for general informational purposes.

Such content is not a substitute for official government advisories, Provider instructions, professional medical advice, legal advice, insurance advice, safety certification, immigration advice, or other specialized professional guidance.

Travelers should obtain appropriate professional or official advice when their individual circumstances require it.

22. Third-Party Websites, Platforms, and Links

The Site may contain links to independent websites, payment providers, reservation systems, map services, accommodation platforms, social-media services, tourism resources, Providers, or other third parties.

Third-party websites and platforms operate under their own terms, privacy practices, security systems, availability, and business policies.

A link or reference is provided for convenience, information, or booking coordination and does not by itself constitute a guarantee of the third party’s service, content, pricing, availability, security, or performance.

When you access a third-party platform, you are responsible for reviewing the terms and policies applicable to that platform.

23. Payments and Third-Party Payment Platforms

Payments may be processed through banks, payment gateways, e-wallets, remittance services, card processors, or other financial service providers.

Those providers may impose separate:

processing fees; foreign exchange rates; service charges; verification procedures; transaction limits; processing periods; chargeback rules; and; security requirements.

The Client is responsible for ensuring that payment is sent using the correct payment details supplied through an Official Channel.

DPTT is not responsible for payments sent to fraudulent, impersonated, altered, or unauthorized accounts where the payment information was not supplied or confirmed through an Official Channel.

24. User Submissions and Communications

When you submit information, documents, photographs, reviews, testimonials, messages, identification details, payment records, or other materials, you represent that:

the information is substantially accurate to the best of your knowledge; you have lawful authority to provide it; its submission does not unlawfully infringe another person’s rights; and; it may be processed for the purpose for which it was reasonably provided, subject to the Privacy Policy and applicable law.

Clients remain responsible for ensuring that names, dates, headcounts, identification details, flight information, accommodation details, pickup locations, and other booking information supplied to the Agency are accurate.

25. Site and Communication Channels Are Not Emergency Services

The Site, email, inquiry forms, social-media accounts, messaging applications, and other Agency communication channels are not emergency-response services and may not be continuously monitored.

In an accident, medical emergency, safety incident, crime, fire, maritime incident, road accident, or other urgent event, Clients should immediately contact the appropriate local emergency responders, authorities, and the onsite Provider.

After immediate safety concerns have been addressed, DPTT may be contacted for coordination assistance within the scope of its role.

Please review the Traveler Emergency & Incident Response Guide before travel.

26. Intellectual Property

Unless otherwise identified, the Site’s original text, design, branding, logos, graphics, photographs, videos, compilations, and other original materials are owned by, licensed to, or lawfully used by D’Palawan Travel and Tours and are protected by applicable intellectual-property laws.

Visitors may access Site content for ordinary personal and non-commercial travel-planning purposes.

Without prior written permission, Site content may not be systematically copied, republished, sold, commercially distributed, reproduced on another website, modified for commercial exploitation, or used in a manner that infringes applicable intellectual-property rights.

If you believe content appearing on the Site infringes rights you lawfully hold, please contact us through the Contact Us page with sufficient information for review.

27. Website Availability and Security

The Agency uses reasonable efforts to maintain the Site, but continuous and error-free availability cannot be guaranteed.

Site access may be interrupted by:

maintenance; hosting or server problems; internet outages; software errors; cybersecurity events; third-party platform interruptions; telecommunications failures; power interruptions; force majeure events; or; other technical circumstances.

Users are responsible for maintaining appropriate security on their own devices and accounts, including safeguarding passwords and implementing reasonable protection against malicious software.

28. Disclaimer of Website Warranties

To the fullest extent permitted by applicable law, the Site and general informational content are made available on an “as available” basis.

The Agency does not guarantee uninterrupted Site availability, absence of technical errors, compatibility with every device or browser, or that information will remain current after publication.

Nothing in this section is intended to exclude warranties, consumer protections, or other rights that cannot legally be excluded.

29. Limitation of Liability Relating to Site Use

To the fullest extent permitted by law, D’Palawan Travel and Tours shall not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from use of, inability to use, or reasonable reliance on general Site content where the loss results from circumstances outside the Agency’s reasonable control.

This may include losses associated with:

website interruptions; technical errors; outdated general information; third-party website failures; malicious activity by unrelated third parties; Provider operational changes; government or authority actions; weather or force majeure; or; other circumstances described in these Terms.

Operational incidents involving a tour, transfer, rental, accommodation, package, or other Service are governed by the applicable Travel Booking & Service Terms and Conditions, service-specific terms, Provider rules, applicable waiver, booking confirmation, and governing law.

30. Client Responsibility and Indemnification

To the fullest extent permitted by applicable law, a Client is responsible for losses or claims resulting from the Client’s own unlawful conduct, intentional misconduct, fraud, misuse of the Site, unauthorized use of Agency intellectual property, material breach of these Terms, or violation of another person’s lawful rights.

Where legally applicable, the Client agrees to indemnify and hold harmless D’Palawan Travel and Tours and its owners, officers, employees, authorized representatives, and affiliates from third-party claims, liabilities, damages, and reasonable costs arising directly from such conduct.

This clause does not require a Client to indemnify the Agency for a liability that applicable law places directly and non-waivably upon the Agency.

31. Force Majeure and Circumstances Beyond Reasonable Control

Neither general Site information nor a travel schedule should be interpreted as guaranteeing that events outside reasonable human control will not occur.

Such events may include, without limitation:

typhoons, storms, earthquakes, flooding, landslides, and other natural events; unsafe sea or road conditions; epidemics, pandemics, or public-health measures; fires; power or telecommunications failures; civil disturbances or security incidents; government restrictions; port, airport, road, or attraction closures; strikes or transportation interruptions; emergency safety measures; and; similar events beyond reasonable control.

The consequences of such events are subject to the applicable booking terms, Provider rules, Refund Policy, and mandatory law.

32. Consumer Rights and Applicable Law

These Terms are intended to operate consistently with applicable laws of the Republic of the Philippines.

Nothing in these Terms is intended to unlawfully waive, exclude, or limit a right or remedy that cannot legally be waived, excluded, or limited.

If a provision is found to be subject to a mandatory legal limitation, that provision shall be applied to the maximum lawful extent while the remaining provisions continue to operate where legally possible.

33. Direct Resolution of Complaints and Disputes

Clients agree that any concern, complaint, disagreement, or dispute involving D’Palawan Travel and Tours should first be submitted directly to the Agency through an Official Channel so that the matter can be documented, reviewed, and, where possible, resolved without litigation.

The Client and Agency shall first attempt in good faith to resolve the matter directly for a period of at least thirty (30) days from written notice of the dispute.

During this period, the parties should reasonably cooperate in providing relevant booking confirmations, receipts, messages, photographs, Provider reports, or other documentation necessary to understand the matter.

34. Governing Law and Exclusive Venue

These Terms and disputes arising from or relating to the Site, the Agency’s policies, bookings, transactions, or Services shall be governed by the laws of the Republic of the Philippines.

If a dispute remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the matter may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.

The parties consent to such venue, subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.

35. Severability

If any provision of these Terms is declared invalid, unlawful, or unenforceable by a competent authority, that provision shall be limited or separated only to the extent necessary, while the remaining provisions shall continue to have effect to the fullest extent permitted by law.

36. No Waiver

A delay or failure by the Agency to enforce any provision on one occasion does not automatically constitute a permanent waiver of that provision or prevent its later enforcement.

Any waiver applicable to a particular circumstance must be expressly confirmed by the Agency and shall not automatically apply to other bookings, Clients, circumstances, or provisions.

37. Updates to These Terms

D’Palawan Travel and Tours may revise these Terms when reasonably necessary to reflect changes in:

the Site; business processes; booking practices; Provider arrangements; technology; security requirements; applicable regulations; or; other operational or legal considerations.

The current version will be published on this page.

Continued use of the Site after an updated version becomes effective constitutes acceptance of the revised Terms as they apply to subsequent Site use. Booking-specific rights and obligations already fixed by applicable law or a completed transaction remain subject to the rules legally applicable to that transaction.
