This Disclaimer explains important limitations, responsibilities, risk allocations, and conditions relating to the website and travel coordination services of D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).
It is intended to help Clients and website visitors understand: the nature and limitations of information published on this website (the “Site”); DPTT’s role as a travel coordination and booking agency; the role and responsibility of independent third-party service providers; the changing and sometimes unpredictable nature of travel; the risks inherent in tours, transportation, rentals, outdoor activities, sea travel, and other tourism-related Services; the importance of Client preparation, compliance, and personal responsibility; and the circumstances in which liability may be limited or allocated among the Agency, the Client, independent Providers, and other parties.
This Disclaimer forms part of the wider legal and booking framework of D’Palawan Travel and Tours and must be read together with the Agency’s other applicable policies, booking conditions, service-specific terms, Provider requirements, safety instructions, and Client responsibilities.
If anything in this Disclaimer or another applicable policy is unclear, contact D’Palawan Travel and Tours before making payment or proceeding with a booking.
If you disagree with any applicable provision, policy, process, rule, or condition, do not proceed with the booking, payment, participation, or Service.
1. Acceptance of This Disclaimer
Booking, reserving, paying for, confirming, participating in, receiving, using, or otherwise availing any Service through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of this Disclaimer and all other applicable Agency terms, policies, procedures, company processes, service-specific conditions, Provider requirements, safety instructions, and regulations.
Acceptance may be evidenced through any lawful means, including: submitting a reservation or booking request; paying a deposit, partial payment, or full payment; electronically or physically accepting a waiver; replying “Confirmed,” “Agree,” “Yes,” or similar language; accepting a booking confirmation; appearing at a meeting or pickup point; boarding a vehicle or vessel; accepting possession of a rental unit; checking into an accommodation arranged as part of a booking; or participating in or otherwise using a Service.
Electronic confirmations, booking records, receipts, payment records, messages, screenshots, emails, forms, and other electronic communications may constitute evidence of acceptance and of the matters communicated between the parties, to the fullest extent permitted by law.
2. Relationship With Other DPTT Policies
This Disclaimer must be read together with the applicable: Terms of Use; Terms of Service; Refund Policy; Privacy Policy; Disclosure; service-specific terms; Tours, Travel Packages, and Service Waiver and Liability Disclaimer; Pre-Travel Client Responsibilities; Travel & On-Tour Client Responsibilities; Emergency & Incident Response Guide; Booking Confirmation; Provider rules; and other written requirements relevant to the Service.
These documents are intended to operate together.
Where a provision specifically addresses a particular Service or risk—for example, a boat transfer, land transfer, airport transfer, rental, or particular tour—the more specific applicable provision may supplement this general Disclaimer.
3. D’Palawan Travel and Tours’ Role
D’Palawan Travel and Tours operates as a travel coordination and booking agency.
DPTT may assist Clients with: identifying available travel options; requesting quotations; checking availability; arranging reservations; coordinating schedules; relaying Provider requirements; communicating passenger or renter information; coordinating payments; communicating pickup and meeting points; relaying itinerary and operational updates; and providing reasonable booking and travel coordination assistance.
Many Services coordinated through DPTT are performed by independent third-party Providers, including tour operators, transport suppliers, drivers, vehicle owners, boat operators, vessel owners, captains, crew, guides, accommodation establishments, rental suppliers, activity providers, attractions, venues, and other tourism-related businesses or individuals.
4. Operational Responsibility of Independent Providers
The Provider responsible for performing a particular Service generally controls the operational aspects of that Service.
Depending on the Service, operational matters may include: driver, captain, guide, or crew assignment; vehicle and vessel assignment; staffing; maintenance; equipment condition; roadworthiness or seaworthiness; route selection; departure timing; waiting-time rules; boarding procedures; passenger capacity; baggage and weight restrictions; safety briefings; onsite supervision; weather and safety assessments; emergency procedures; operational substitutions; permit and regulatory compliance applicable to the Provider; and other real-time service decisions.
DPTT may coordinate or communicate concerning these matters without thereby assuming operational possession, management, supervision, or control of an independent Provider’s personnel, vehicles, vessels, equipment, premises, or activities.
5. Independent Provider Acts and Omissions
To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, loss, damage, delay, cancellation, service interruption, missed connection, additional expense, or other consequences caused by the independent acts, omissions, negligence, misconduct, operational decisions, or non-performance of a Provider or unrelated third party where those matters are outside DPTT’s reasonable control.
Examples may include matters involving: driver or crew conduct; guide performance; vehicle or vessel operation; equipment failure; maintenance; accommodation operations; Provider staffing; Provider cancellation; overbooking; Provider scheduling; lost or damaged property in a Provider’s custody; Provider safety procedures; Provider regulatory compliance; Provider service quality; or other matters arising directly from the Provider’s operations.
Where appropriate, DPTT may assist Clients in communicating with the Provider, requesting information, forwarding documents, or seeking available alternatives.
Such assistance does not guarantee a refund, compensation, credit, replacement, insurance payment, reimbursement, admission of liability, or other particular outcome.
6. Providers Remain Independent
Independent Providers maintain their own operations and may maintain their own: terms and conditions; cancellation policies; refund rules; safety procedures; insurance arrangements; operating procedures; complaint procedures; claim requirements; business registrations; personnel; and legal obligations.
Coordination, booking, referral, or commercial dealings between DPTT and a Provider do not by themselves create an employment relationship, partnership, joint venture, common ownership, or common management arrangement.
7. Information on the Site Is for General Reference
Unless expressly stated otherwise, articles, travel guides, destination descriptions, sample itineraries, photographs, videos, schedules, maps, route suggestions, estimates, blog posts, travel tips, FAQs, and similar Site content are provided for general informational and planning purposes.
General Site content should not be treated as a guarantee that: conditions will remain unchanged; a particular Provider will be available; a particular activity will operate; an itinerary will be followed exactly; a quoted travel time will always be achieved; government rules will remain unchanged; weather will be favorable; a destination will remain open; a particular vehicle or vessel will be assigned; or the actual experience will exactly reproduce a photograph, video, article, or sample itinerary.
8. General Information Is Not Professional Advice
Information published or communicated by DPTT for general travel purposes does not constitute individualized: legal advice; medical advice; financial advice; insurance advice; immigration advice; safety certification; engineering or mechanical advice; or other regulated professional advice.
Clients should consult qualified professionals or appropriate government authorities where professional advice is necessary for their particular circumstances.
9. Government and Official Information Takes Priority
Information published by DPTT does not replace official orders, advisories, restrictions, or instructions issued by competent authorities.
Depending on the Service and destination, relevant authorities may include: local government units; tourism offices; Philippine Coast Guard; port authorities; airport authorities; protected-area management offices; environmental authorities; law-enforcement agencies; transport regulators; immigration authorities; and other government agencies.
Lawful government or safety directives take priority over Client preferences, preliminary itineraries, promotional materials, and earlier scheduling expectations.
10. Travel Conditions Are Dynamic
Travel conditions in Palawan and other island or remote destinations can change rapidly.
Travel may be affected by: weather; localized weather systems; strong winds; waves and sea state; currents and tides; flooding; landslides; road conditions; traffic; mechanical problems; port restrictions; airport restrictions; environmental regulations; protected-area closures; visitor capacity limits; government directives; security conditions; Provider availability; staff availability; emergency situations; local events; or other circumstances beyond reasonable control.
A sunny weather forecast does not necessarily mean that sea travel or an outdoor activity will be authorized or safe. Conditions may differ between locations and can change after departure.
11. Itineraries, Schedules, and Routes May Change
Published or preliminary itineraries are planning references unless expressly incorporated into a confirmed booking.
Even after confirmation, reasonable operational changes may be necessary.
Depending on circumstances, a Provider may need to: change the order of destinations; skip a location; shorten a stop; change a route; change a departure or meeting point; delay departure; return early; substitute an activity; replace a vehicle or vessel; substitute a Provider; or cancel or suspend part of the Service.
Safety, lawful authority directives, environmental protections, and reasonable operational decisions take priority over strict adherence to a preferred itinerary.
12. No Prorated Refund for Certain Skipped Destinations or Activities
For both land and sea tours, no prorated or proportional refund is due merely because a destination, attraction, stop, route, or portion of the itinerary is skipped, shortened, replaced, or made unavailable because of safety considerations, weather or sea conditions, government or authority directives, road conditions, environmental restrictions, or the Provider/operator’s reasonable operational or safety discretion.
The Client understands that payment for a tour may cover the overall mobilization and delivery of the Service and is not necessarily calculated as a separate refundable price for each individual destination or stop.
Any refund eligibility outside these circumstances is governed by the Booking Cancellation, Rescheduling & Refund Policy, applicable Provider rules, booking-specific conditions, and mandatory law.
13. Short-Notice Bookings
Bookings made within three (3) calendar days of the scheduled Service date are non-refundable.
Short-notice bookings may require immediate commitment of Provider capacity, transportation, personnel, fuel, permits, equipment, accommodations, supplies, or other resources.
Clients making a booking within this period should therefore ensure that their travel plans, participant information, dates, and other requirements are final before payment.
This rule must be read together with the complete Booking Cancellation, Rescheduling & Refund Policy and rights that cannot lawfully be excluded.
14. Advance Booking Reconfirmation
Clients with advance bookings must contact D’Palawan Travel and Tours on the day before the scheduled tour to reconfirm that the booking has been properly acknowledged and to obtain the latest available operational information.
Where relevant, Clients should likewise reconfirm advance transfers, rentals, and other scheduled Services on the day before performance.
This reconfirmation allows updated information to be communicated concerning: meeting points; pickup locations; departure windows; Provider assignments; weather conditions; route changes; manifest requirements; identification requirements; vehicle or vessel changes; safety instructions; and other time-sensitive matters.
Clients should review the most recent confirmed instructions rather than relying solely upon an older quotation, sample itinerary, or preliminary communication.
15. Best-Effort Information; No Guarantee of Continuous Accuracy
DPTT uses reasonable efforts to provide useful and current information.
However, information may become incomplete, inaccurate, or outdated because of changes occurring after publication or communication.
This may include changes to: pricing; schedules; travel times; routes; availability; environmental fees; entrance fees; permits; government requirements; Provider policies; pickup points; weather conditions; site access; and other operational matters.
DPTT may correct, update, replace, reorganize, or remove Site content where reasonably necessary.
16. Client Responsibility to Verify Critical Information
Clients are responsible for reviewing and verifying information that is material to their travel plans.
Particular care should be taken with: flight schedules; ferry connections; airport check-in requirements; passport and visa requirements; identification requirements; manifest information; permit requirements; health requirements; weather advisories; road and port closures; pickup points; tour cutoffs; baggage or weight restrictions; Provider policies; and other time-sensitive information.
If a particular condition is essential to your decision to travel, ask for clarification before booking and verify it again where appropriate before departure.
17. Pricing May Change Before Confirmation
Prices appearing on the Site or in preliminary communications may change prior to booking confirmation because of: Provider pricing changes; availability; seasonal demand; group size; fuel costs; government fees; environmental fees; route changes; accommodation changes; vehicle or vessel requirements; foreign-exchange considerations where applicable; or other legitimate booking factors.
The controlling price is the price accepted as part of the confirmed transaction, subject to later charges expressly permitted under applicable booking terms or arising from Client-requested changes.
18. Package Names Do Not Guarantee Uniform Inclusions
Tour names and package descriptions may be used across different destinations and Providers, but similarly named Services do not necessarily include identical components.
Differences may involve: meals; entrance fees; environmental fees; permits; equipment; transportation; guide services; snorkeling equipment; insurance, if any; number of stops; duration; accommodation standards; or other components.
Clients should rely on the inclusions and exclusions stated in their applicable Booking Confirmation rather than assuming that a similarly named tour sold elsewhere has identical inclusions.
19. Onsite and Government-Imposed Fees
Some destinations, attractions, ports, protected areas, and local authorities may impose fees payable onsite or separately from the booking price.
Such fees may include: environmental fees; entrance fees; terminal fees; port charges; permit fees; conservation fees; or other government or destination charges.
Unless the Booking Confirmation expressly states that a fee is included, the Client remains responsible for paying applicable onsite or government-imposed charges.
20. Photos, Videos, and Other Media
Photographs, videos, illustrations, maps, and other media appearing on the Site are provided for general reference, information, and presentation.
Actual conditions may differ because of: weather; season; tides; water clarity; lighting; camera angle; image processing; compression; screen settings; renovations; natural environmental changes; Provider substitutions; vehicle or vessel assignments; equipment changes; or other circumstances.
DPTT does not guarantee that actual conditions on the date of travel will exactly reproduce photographs, videos, descriptions, or promotional material.
21. Maps, Locations, Routes, and Travel-Time Estimates
Maps, geographic information, location pins, distances, and estimated travel times are general planning aids unless expressly confirmed otherwise.
Actual travel time may vary because of traffic, weather, road conditions, sea conditions, checkpoints, construction, accidents, route changes, passenger loading, stops, port procedures, terminal restrictions, and other circumstances.
Clients should maintain appropriate time buffers for flights, ferries, appointments, check-ins, and other fixed commitments.
22. Missed Flights, Ferries, Connections, and Appointments
DPTT does not guarantee that a transfer, tour, or other Service will enable a Client to meet an onward flight, ferry, appointment, accommodation check-in, tour cutoff, or similar fixed commitment where circumstances outside the Agency’s reasonable control cause delay.
Clients are responsible for allowing reasonable buffer time appropriate to: the distance involved; local road conditions; weather; sea conditions; airport or port requirements; season; traffic; remote-area conditions; and the importance of the onward connection.
23. Assumption of Ordinary Travel Risks
Travel necessarily involves risks that cannot be completely eliminated even where reasonable precautions are taken.
Depending on the activity, risks may include: road accidents; boat or maritime incidents; waves and currents; drowning; slips and falls; uneven terrain; mechanical breakdown; weather exposure; heat and dehydration; motion sickness; wildlife or marine-life encounters; illness; food reactions; theft; property damage; remote-location hazards; delayed emergency response; acts of other travelers or third parties; and other foreseeable or unforeseeable travel hazards.
Detailed risks applicable to particular Services are addressed in the relevant service-specific terms and the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
24. Personal Health and Fitness
Clients are responsible for assessing whether they are physically and medically suitable for the Service they intend to undertake.
Travelers with conditions that may be affected by transportation, heat, physical exertion, sea travel, remote locations, water activities, altitude, food, or environmental exposure should obtain appropriate medical advice before participation.
This may be particularly important for persons who are: pregnant; elderly; very young; recovering from illness or surgery; affected by significant mobility limitations; prone to severe motion sickness; affected by cardiovascular or respiratory conditions; or otherwise medically vulnerable.
Providers may impose reasonable participation restrictions for safety, legal, or operational reasons.
25. Personal Insurance
Clients are encouraged to consider obtaining appropriate personal travel insurance based on their itinerary and circumstances.
Depending on the traveler, suitable coverage may include: medical expenses; accident coverage; emergency evacuation; trip cancellation; trip interruption; baggage; personal property; rental-related risks; or other appropriate coverage.
Unless expressly confirmed in writing, a booking through DPTT should not be assumed to include personal travel or accident insurance.
Any insurance is governed exclusively by the issuing insurer’s terms, exclusions, coverage limits, documentation requirements, and claims procedures.
26. No Guarantee Concerning Provider Insurance
DPTT does not guarantee that every Provider will maintain a particular type, amount, or scope of insurance at every point in time unless that matter has been expressly verified and confirmed in writing for the particular booking.
The existence of Provider insurance also does not guarantee that an insurer will approve a particular claim.
Where insurance is material to a Client’s decision, the Client should request current information before booking.
27. Client Conduct and Compliance
Clients are responsible for following lawful instructions issued by: Providers; drivers; guides; captains and crew; accommodation staff; tourism authorities; port and airport authorities; law-enforcement personnel; protected-area personnel; and other authorized persons.
Clients must also comply with applicable laws, safety requirements, manifests, identification requirements, environmental regulations, prohibited-item rules, and reasonable Provider policies.
Failure to comply may result in denial, suspension, or termination of participation where reasonably necessary for safety or legal compliance, subject to applicable law and the Refund Policy.
28. Client-Supplied Information
Clients are responsible for providing accurate and timely information necessary for the booking.
This may include: full names; headcount; age or date of birth when required; nationality when required; identification information; flight details; accommodation information; pickup location; contact information; rental eligibility information; special requirements; and other information reasonably necessary for the Service.
DPTT shall not be responsible for consequences arising from materially inaccurate, incomplete, misleading, or late information supplied by the Client where such information causes or contributes to the problem.
29. Third-Party Websites and External Services
The Site may contain links to external websites, payment platforms, social-media services, booking systems, map providers, advertisements, accommodations, Providers, tourism resources, and other independent services.
Those external parties maintain their own content, availability, privacy practices, security procedures, terms, pricing, refund policies, and service conditions.
DPTT does not control subsequent changes made by an independent website or platform after a Client leaves the DPTT Site.
Clients should review the applicable third party’s own terms before completing transactions through external platforms.
30. Force Majeure and Circumstances Beyond Reasonable Control
DPTT shall not be responsible, to the fullest extent permitted by law, for failure, delay, alteration, cancellation, or inability to perform caused by circumstances beyond its reasonable control.
These may include: typhoons; storms; rough seas; earthquakes; flooding; landslides; fires; epidemics or pandemics; public-health measures; government restrictions; security incidents; civil disturbance; port closures; airport closures; road closures; protected-area closures; environmental restrictions; transport interruptions; power or telecommunications failures; strikes; emergency safety measures; and other comparable events beyond reasonable control.
The financial and operational consequences of such events are governed by the applicable Refund Policy, Provider rules, Booking Confirmation, service-specific terms, and mandatory law.
31. General Limitation of Liability
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from circumstances outside the Agency’s reasonable control or from the independent operations of Providers and unrelated third parties.
This includes, where legally excludable, losses involving: lost income; lost business; lost profits; lost opportunity; missed appointments; missed onward bookings; business interruption; loss of enjoyment; additional accommodation or transportation costs; loss arising from itinerary changes; or similar consequential economic losses.
Liability relating to a specific Service shall additionally be governed by the applicable service-specific terms, the Tours, Travel Packages, and Service Waiver and Liability Disclaimer, the Provider’s applicable rules, the Booking Confirmation, and Philippine law.
Where a more specific applicable waiver or service term establishes a lawful limitation or liability cap for a particular claim, that more specific provision shall apply to the extent permitted by law.
32. No Exclusion of Non-Waivable Liability
Nothing in this Disclaimer is intended to exclude, waive, or limit liability where applicable Philippine law expressly prohibits such exclusion, waiver, or limitation.
If a competent authority determines that a particular limitation cannot legally apply, that provision shall be limited only to the extent required by law while the remaining provisions continue to operate where legally possible.
33. Agency Interpretation and Clarification
DPTT’s policies are intended to operate together as a consistent legal, booking, and safety framework.
If any provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must request clarification before payment or participation.
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, rules, procedures, company processes, booking conditions, and terms, including determining which Agency provision applies to a particular booking or circumstance.
Any interpretation remains subject to applicable Philippine law and rights that cannot legally be waived.
34. Direct Resolution of Concerns and Disputes
If a Client has a complaint, disagreement, claim, or dispute involving D’Palawan Travel and Tours, the Client agrees to first communicate the matter directly to the Agency through an Official Channel.
The Client should provide relevant supporting documentation where available, including booking confirmations, receipts, messages, photographs, videos, Provider communications, incident reports, or other information reasonably necessary to evaluate the matter.
The Client and Agency shall first attempt in good faith to resolve the issue directly for a period of at least thirty (30) days from written notice of the dispute.
35. Governing Law and Exclusive Venue
This Disclaimer and any dispute arising from or relating to the Site, an Agency policy, booking, transaction, or Service shall be governed by the laws of the Republic of the Philippines.
If a dispute remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the matter may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.
The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.
36. Severability
If any provision of this Disclaimer is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.
The remaining provisions shall continue to apply to the fullest extent legally permitted.
37. No Waiver by Non-Enforcement
A failure or delay by DPTT to enforce a particular provision on one occasion does not constitute a permanent waiver of that provision or prevent enforcement in another circumstance.
Any waiver applicable to a particular matter must be expressly communicated by the Agency and shall not automatically amend the Agency’s policies for other bookings or Clients.
38. Updates to This Disclaimer
D’Palawan Travel and Tours may revise this Disclaimer when reasonably necessary because of changes in: Services; business operations; Provider arrangements; booking processes; technology; travel conditions; government regulations; legal requirements; or other relevant circumstances.
The current version will be published on this page.
For future Site use and future bookings, continued use after publication of an updated Disclaimer constitutes acceptance of the updated version to the extent applicable.
Existing booking rights and obligations remain subject to the provisions and mandatory laws legally applicable to the relevant transaction.
