Travel Booking & Service Terms and Conditions

These Terms of Service (“Terms”) govern reservations, bookings, tours, transfers, rentals, travel packages, accommodations, activities, permits, entrance-fee arrangements, transportation, and other travel-related Services coordinated through D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).

These Terms are intended to clearly explain: how bookings are made and confirmed; the role of D’Palawan Travel and Tours; the role of independent third-party service Providers; payment, cancellation, and refund rules; Client responsibilities; travel and operational risks; safety and regulatory requirements; changes, substitutions, delays, and force majeure; documentation and dispute procedures; and how responsibilities and liabilities are allocated among the Agency, Clients, Providers, and other parties.

Please read these Terms before making payment.

Booking, reserving, paying for, confirming, participating in, receiving, using, or otherwise availing any Service through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms and all other applicable Agency policies, procedures, company processes, service-specific terms, Provider requirements, safety instructions, and regulations.

If anything is unclear, contact D’Palawan Travel and Tours before making payment.

If you disagree with any applicable provision, do not proceed with the booking or Service.

1. Definitions

“Agency,” “DPTT,” “we,” “us,” or “our” means D’Palawan Travel and Tours.

“Client,” “Traveler,” “Renter,” “you,” or “your” means a person who inquires about, reserves, books, pays for, participates in, receives, uses, or is included in a Service coordinated through DPTT.

“Provider,” “Supplier,” or “Independent Provider” means an independent third party that supplies, performs, owns, operates, manages, or controls all or part of a travel-related Service.

“Service” or “Services” means a travel-related arrangement coordinated through DPTT, including tours, packages, transfers, rentals, accommodations, activities, permits, transportation, entrance arrangements, and related components.

“Booking Confirmation” means a written or electronic confirmation, itinerary, receipt, voucher, message, invoice, acknowledgment, or similar record evidencing or describing a confirmed booking.

“Site Policies” means DPTT’s published legal, booking, refund, privacy, safety, responsibility, and service-specific policies.

“Service-Specific Terms” means terms applicable to a particular Service, such as boat transfers, land transfers, airport transfers, rentals, or tours and travel packages.

“Official Channels” means communication methods identified or confirmed by DPTT as official, including its official telephone number, email address, website, and authorized messaging or social-media accounts.

“Calendar days” means consecutive days including weekends and public holidays unless expressly stated otherwise.

“Force Majeure” means an event or circumstance beyond the reasonable control of the affected party, as further described in these Terms.

2. Scope of These Terms

These Terms apply to Services coordinated through DPTT, including a single Service or a booking involving multiple Providers.

Examples include: island hopping; land tours; guided tours; travel packages; boat transfers; land transfers; airport transfers; boat rentals; car rentals with a driver; self-drive car rentals; motorbike rentals with a driver; self-drive motorbike rentals; accommodation arrangements; activity arrangements; permits and entrance arrangements; and other tourism-related Services.

3. Acceptance and Incorporation of Other Policies

These Terms must be read together with the other applicable policies of D’Palawan Travel and Tours.

Depending on the Service, the Client may also be bound by: the Terms of Use; Disclosure; Disclaimer; Refund Policy; Privacy Policy; the Tours, Travel Packages, and Service Waiver and Liability Disclaimer; service-specific transfer or rental terms; Pre-Travel Client Responsibilities; Travel & On-Tour Client Responsibilities; the Emergency & Incident Response Guide; the Booking Confirmation; Provider terms and operating rules; and applicable government rules and regulations.

These documents form part of the overall contractual, safety, booking, and operational framework applicable to the Service.

4. Methods of Acceptance

Acceptance of these Terms and applicable policies may be evidenced through any lawful method, including: submitting a reservation request; paying a deposit; making partial or full payment; signing a document; accepting electronically; replying “Yes,” “Confirmed,” “Agree,” or similar language; accepting a Booking Confirmation; providing passenger or rental information after confirmation; appearing at a scheduled pickup or meeting point; boarding a vehicle or vessel; accepting a rental unit; or participating in or using the Service.

To the fullest extent permitted by law, electronic signatures, payment records, confirmations, emails, messages, screenshots, forms, and other electronic records may be used as evidence of the agreement and communications between the parties.

5. Group Bookings

A person making a booking for other travelers represents that the person is authorized to submit information and coordinate the booking on behalf of the group.

The booking Client is responsible for communicating material booking information to the other participants, including: dates and schedules; meeting and pickup points; payment requirements; cancellation rules; safety requirements; Provider rules; identification and manifest requirements; travel responsibilities; and relevant terms applicable to the booked Service.

Each traveler remains individually responsible for their own conduct, compliance, fitness to participate, and observance of applicable safety requirements.

6. Mandatory Pre-Travel, On-Tour, and Emergency Responsibilities

As applicable to the Service, Clients must comply with: the Pre-Travel Client Responsibilities & Readiness Guide before the Service; the Travel & On-Tour Client Responsibilities & Safety Rules during the Service; and the Traveler Emergency & Incident Response Guide where an accident, illness, delay, disruption, safety issue, security concern, or other incident occurs.

Failure or refusal to follow lawful and reasonable safety or compliance requirements may result in denial, interruption, or termination of participation where reasonably necessary for safety or legal compliance.

Refund consequences are governed by the Booking Cancellation, Rescheduling & Refund Policy, Provider rules, and applicable law.

7. Clarifications and Interpretation

If any Agency policy, Service-Specific Term, Booking Confirmation, Provider rule, or communication appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must seek clarification before payment or participation.

Travel Services differ significantly between destinations and Providers. Clients should not assume that practices experienced elsewhere automatically apply to a DPTT booking.

To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, and terms, including identifying which Agency provision applies to a particular booking or circumstance.

Agency interpretation does not permit DPTT to override a right or obligation that applicable law makes mandatory and non-waivable.

8. D’Palawan Travel and Tours’ Agency Role

D’Palawan Travel and Tours operates as a travel coordination and booking agency.

DPTT may assist Clients with: identifying travel options; obtaining quotations; checking availability; communicating booking requirements; coordinating reservations; collecting or transmitting necessary booking information; coordinating payment arrangements; communicating schedules; relaying pickup or meeting information; communicating Provider instructions; relaying operational changes; and providing reasonable booking support.

Travel packages and individual Services may be performed by independent third-party Providers.

9. Independent Provider Operations

The independent Provider responsible for performing a particular Service generally controls the operational aspects of that Service.

Depending on the Service, the Provider may be responsible for: personnel; drivers; guides; captains and crew; vehicle or vessel assignment; maintenance; equipment condition; route selection; boarding procedures; passenger capacity; weight and baggage limits; onsite supervision; safety briefings; weather and operating assessments; waiting-time rules; emergency procedures; permits and operational documentation; Provider-specific licensing or registration requirements; and other day-to-day operational decisions.

DPTT’s booking or coordination activity does not transfer operational management of an independent Provider’s business, personnel, equipment, vehicle, vessel, rental unit, accommodation, or activity to the Agency.

10. Independent Business Relationship With Providers

Providers generally maintain independent businesses, personnel, policies, equipment, systems, registrations, and legal responsibilities.

A booking, referral, coordination, commission, or commercial relationship between DPTT and a Provider does not by itself create: an employment relationship; a partnership; a joint venture; common ownership; common operational control; or a general authority for DPTT to alter the Provider’s independent operating rules.

11. Special or Remote-Area Provider Arrangements

Some remote destinations may have limited transport, vessel, rental, accommodation, or tourism availability.

Where lawful and appropriate, DPTT may assist the Client in identifying or coordinating with an available independent service provider in response to the Client’s requested itinerary.

The Client should request clarification before payment if a particular Provider qualification, accreditation, registration, insurance requirement, equipment standard, or operating characteristic is material to the Client’s decision.

12. Provider Policies and Operational Authority

Providers may impose their own operational conditions, including: check-in times; boarding cutoffs; waiting periods; baggage limits; weight limits; passenger limits; minimum age requirements; identification requirements; manifest rules; security deposits; rental conditions; safety procedures; weather holds; cancellation rules; and other reasonable operating requirements.

Provider requirements may differ from one Service to another.

13. Safety Decisions Take Priority

Providers and competent authorities may delay, reroute, substitute, restrict, interrupt, reschedule, or cancel a Service where reasonably necessary because of: safety concerns; weather; sea state; wind, waves, tides, or currents; traffic; road conditions; flooding or landslides; mechanical concerns; staffing limitations; passenger or capacity restrictions; environmental conditions; government directives; port restrictions; protected-area restrictions; or other legitimate operational reasons.

Safety and lawful authority directives take priority over strict adherence to an advertised, preliminary, or preferred itinerary.

14. Inquiry Versus Confirmed Booking

An inquiry, quotation request, availability check, or preliminary discussion does not by itself constitute a confirmed booking.

A booking becomes confirmed when:

  • the Agency or Provider acknowledges the reservation as confirmed; and
  • any required deposit, payment, documentation, or other condition for confirmation has been satisfied and verified.

Until confirmation occurs, price, availability, Provider assignment, equipment, vehicle, vessel, accommodation, and schedule remain subject to change.

15. Typical Booking Process

A booking may involve: Client inquiry; identification of dates, group size, destinations, and preferences; availability checking; quotation or presentation of options; Client selection; payment or deposit where required; Provider reservation; Booking Confirmation; submission of manifests, identification, or other required information; pre-travel coordination; day-before reconfirmation; and actual performance of the Service.

16. Client Information Must Be Accurate

The Client is responsible for providing accurate and timely information necessary for the booking.

This may include: full names; age or date of birth where required; nationality where required; identification details; group size; flight information; hotel or accommodation; pickup point; contact details; rental eligibility information; special requirements; and other information reasonably required by the Agency, Provider, or competent authority.

DPTT shall not be responsible, to the fullest extent permitted by law, for losses or disruptions materially caused by inaccurate, incomplete, misleading, or late information supplied by the Client.

17. Mandatory Day-Before Reconfirmation

Clients with advance bookings must contact D’Palawan Travel and Tours on the day before the scheduled tour to ensure that the booking has been properly acknowledged and to obtain the latest available operational information.

Where relevant, Clients must likewise reconfirm advance transfers, rentals, and other scheduled Services on the day before performance.

Reconfirmation may involve verification of: date; meeting point; pickup location; departure or pickup window; Provider assignment; headcount; manifest information; weather-related changes; route changes; vehicle or vessel assignment; identification requirements; items to bring; and other operational instructions.

The Client should rely on the most recent confirmed instructions rather than only upon an earlier quotation, draft itinerary, promotional material, or preliminary message.

18. Reachable Contact Information

The Client must provide a reliable contact method and remain reasonably reachable on or immediately before the Service date.

The Client should promptly notify DPTT if: the Client changes telephone number; the accommodation changes; the flight schedule changes; the pickup location changes; the Client expects to be unreachable; the Client expects to be late; or another material travel detail changes.

19. Identification Requirements

Clients should carry appropriate valid government-issued identification where required for the booked Service.

Identification may be required for: passenger manifests; airport or port procedures; Philippine Coast Guard requirements; protected-area access; checkpoints; accommodation check-in; vehicle or motorbike rental; age verification; discount qualification; or other Provider or government requirements.

Failure to present required identification may result in denial, delay, or inability to perform the Service and may affect refund eligibility.

20. Pricing

Prices may depend on: Provider rates; season; demand; group size; route; distance; fuel; vehicle or vessel requirements; accommodation selection; permits and government fees; optional additions; and other operational considerations.

A preliminary quotation may change before confirmation if the underlying Provider price or booking conditions change.

21. Inclusions and Exclusions

Clients should review the Booking Confirmation to determine what is included.

Possible components may include or exclude: transportation; boat fares; accommodation; meals; guides; fuel; equipment; environmental fees; entrance fees; terminal fees; permits; insurance, if any; optional activities; and other local costs.

An item should not be assumed to be included solely because a similarly named package offered elsewhere includes it.

22. Government and Onsite Fees

Government, environmental, port, terminal, permit, entrance, conservation, or similar third-party fees may change independently of DPTT.

Unless the Booking Confirmation expressly states that a particular fee is included, the Client should be prepared to pay legitimate onsite or government charges applicable to the Service.

23. Payment

Providers may require: a deposit; partial payment; full advance payment; security deposits for rentals; or other payment arrangements necessary to secure a reservation.

A payment does not necessarily constitute a confirmed booking until the payment has been verified and the booking has been acknowledged.

24. Proof of Payment

The Client should provide clear proof of payment through an Official Channel when requested.

Proof may include: receipt; transaction reference; bank confirmation; e-wallet confirmation; or screenshot showing sufficient transaction information.

DPTT may require reasonable verification before treating funds as received.

25. Payment and Banking Charges

The Client may be responsible for applicable: bank charges; payment gateway charges; card-processing charges; e-wallet charges; remittance fees; foreign-exchange differences; intermediary banking charges; and other third-party financial transaction costs.

Refundability of these amounts is governed by the Booking Cancellation, Rescheduling & Refund Policy.

26. Rental Security Deposits

Where a Provider requires a rental security deposit, return or deduction of that deposit is subject to the applicable rental terms and Provider assessment.

Possible deductions may include: damage; missing property; fuel deficiencies; late return; cleaning; traffic or parking violations; contractually chargeable rental extensions; or other amounts properly due under the rental terms.

27. Cancellations and Refunds

All cancellations and refunds are subject to the Booking Cancellation, Rescheduling & Refund Policy, applicable Provider rules, booking-specific terms, and mandatory law.

The Client acknowledges that travel bookings may require advance commitment of: Provider capacity; vehicles or vessels; accommodations; personnel; fuel; permits; meals; supplies; and other resources.

Cancellation therefore does not necessarily create a right to recover all amounts paid.

28. Bookings Made Within Three Days Are Non-Refundable

A booking first made within three (3) calendar days of the scheduled Service date is non-refundable from the time it is confirmed.

This applies regardless of group size, subject only to rights that cannot legally be excluded.

Clients making short-notice bookings must therefore confirm their travel plans before payment.

29. No-Shows and Late Arrivals

A booking may be treated as a no-show where the Client: fails to appear; misses departure; arrives beyond the allowable waiting time; becomes unreachable; goes to the wrong meeting point despite correct instructions; fails required check-in procedures; fails identification or manifest requirements; or otherwise fails to participate despite the Service being reasonably available.

No-shows are generally non-refundable in accordance with the Refund Policy and applicable Provider terms.

30. Itinerary Changes and Rescheduling

Requested changes are subject to availability and Provider approval.

Changes may involve additional charges where they require: a new date; different transportation; a different Provider; additional mileage; different accommodation; additional personnel; new permits; Provider cancellation charges; re-mobilization; or other additional costs.

Rescheduling does not automatically convert a non-refundable booking into a refundable booking.

31. Mid-Trip and Same-Day Changes

A Client-requested change after a Service begins may be treated as an additional Service or new booking.

Unused original components may remain non-refundable where they have already been committed, paid, mobilized, or cannot reasonably be resold.

32. Provider and Component Substitutions

DPTT or the responsible Provider may arrange a reasonable substitute where the originally anticipated Provider, vehicle, vessel, accommodation, route, or other component becomes unavailable.

Substitution may occur because of: availability; overbooking; mechanical issues; maintenance; staffing; weather; safety; regulatory requirements; capacity limitations; route conditions; emergencies; or other legitimate operational reasons.

A reasonable substitution that preserves the essential nature of the booked Service does not automatically create a refund entitlement.

33. No Prorated Refund for Skipped Land or Sea Tour Destinations

For both land and sea tours, no prorated or proportional refund is due merely because one or more destinations, attractions, stops, routes, or itinerary components are skipped, shortened, reordered, replaced, or made unavailable because of:safety considerations;weather;sea conditions;wind, waves, tides, or currents;road conditions;flooding or landslides;government or authority directives;environmental restrictions;protected-area restrictions;mechanical circumstances;emergency conditions; or the Provider/operator’s reasonable operational or safety discretion.

The Client acknowledges that the price of a tour generally covers overall mobilization, transportation, staffing, fuel, coordination, equipment, and Service delivery rather than a separate refundable amount allocated to each individual stop.

34. Dynamic Travel Conditions

Travel conditions may change before or during the Service.

Factors may include: weather; sea conditions; road conditions; traffic; airport or port restrictions; local events; government directives; environmental regulations; protected-area restrictions; availability; mechanical concerns; communication outages; security conditions; or other circumstances.

The Client agrees to maintain reasonable flexibility where changes are necessary for safety, compliance, or legitimate operational purposes.

35. Force Majeure

DPTT shall not be responsible, to the fullest extent permitted by law, for delay, interruption, alteration, cancellation, or inability to perform caused by circumstances outside the Agency’s reasonable control.

These may include: typhoons; storms; unsafe sea conditions; earthquakes; flooding; landslides; fires; epidemics or pandemics; public-health restrictions; war; civil disturbance; security incidents; strikes; government actions; port closures; airport closures; road closures; environmental restrictions; protected-area closures; utility failure; telecommunications failure; transport interruption; or other comparable events beyond reasonable control.

The consequences of a Force Majeure event are governed by the applicable Provider terms, Refund Policy, Booking Confirmation, and mandatory law.

36. Personal Safety and Conduct

Clients must behave responsibly and follow lawful and reasonable safety instructions.

Clients must comply, where applicable, with: seatbelt requirements; helmet requirements; life-jacket requirements; boat safety instructions; road traffic laws; maritime requirements; environmental rules; protected-area requirements; Provider safety procedures; local laws and ordinances; and lawful instructions from competent authorities.

37. Unsafe, Illegal, or Disruptive Conduct

A Provider may deny, suspend, or terminate participation where reasonably necessary because of: intoxication; illegal drugs; violence or threats; reckless conduct; harassment; refusal to follow safety requirements; possession of prohibited items; material risk to other passengers; intentional property damage; illegal conduct; or other serious safety or compliance concerns.

Where the Client’s own conduct causes denial or termination, refund eligibility may be limited under the Refund Policy and applicable Provider terms.

38. Health, Fitness, and Personal Readiness

The Client is responsible for assessing personal ability to safely participate in the chosen Service.

Clients should consider relevant circumstances such as: pregnancy; heart or cardiovascular conditions; respiratory conditions; asthma; mobility limitations; recent surgery; severe motion sickness; heat sensitivity; physical exertion; water exposure; remote-area travel; and other relevant medical circumstances.

Clients should obtain appropriate professional medical advice where necessary and carry required personal medications.

39. Minors and Dependents

A parent, guardian, or responsible adult accompanying a minor remains responsible for the minor’s supervision and compliance with applicable safety requirements.

Providers may impose age, height, weight, health, or supervision restrictions for particular activities.

If participation by a minor is important to the booking, applicable restrictions should be confirmed before payment.

40. Personal Belongings

Clients are responsible for supervising personal belongings unless a Provider expressly accepts custody under separate terms.

Travel can involve heightened risk of: loss; theft; water damage; breakage; misplacement; baggage mixing; or damage during transfers or outdoor activities.

Clients should take reasonable precautions with cash, passports, identification, mobile devices, cameras, jewelry, and other valuables.

41. Baggage

Providers may impose baggage, cargo, weight, size, or prohibited-item restrictions.

Clients are responsible for disclosing unusually large, heavy, fragile, or specialized baggage before booking where it may affect transportation capacity.

Additional charges may apply where additional space or capacity is required.

42. Insurance

Clients are encouraged to consider obtaining suitable personal insurance appropriate to their itinerary.

Depending on the Client’s needs, coverage may include: travel insurance; medical insurance; accident insurance; trip cancellation; trip interruption; baggage; emergency evacuation; rental risks; or other appropriate protection.

Unless expressly confirmed otherwise in writing, a booking through DPTT should not be assumed to include personal travel or accident insurance.

43. Provider Insurance

If a Provider states that insurance exists, coverage may be subject to: policy exclusions; coverage limits; deductibles; eligibility requirements; reporting deadlines; claims documentation; and insurer approval.

DPTT does not guarantee the existence, scope, adequacy, validity, continued effectiveness, or collectability of independent Provider insurance unless expressly verified and confirmed in writing.

44. Communications and Documentation

Clients are encouraged to keep records reasonably relevant to their booking, such as: Booking Confirmations; payment records; receipts; messages; cancellation notices; Provider instructions; photographs of rental condition; incident photographs or videos; manifests; signed documents; and other relevant records.

Such records may assist with customer service, claims, refund requests, chargebacks, incidents, or disputes.

45. Privacy and Data Sharing

DPTT may collect, retain, use, and share personal information where reasonably necessary for booking, Service coordination, manifests, permits, identification, payment verification, safety, recordkeeping, dispute management, and legal compliance.

Details are provided in the Privacy & Personal Data Policy.

46. Website and Messaging Channels Are Not Emergency Services

DPTT’s website, email, messaging applications, and social-media accounts are not guaranteed to be monitored continuously.

In an immediate emergency, Clients should first contact: the onsite Provider; local emergency responders; police; medical services; Philippine Coast Guard where applicable; port or airport authorities; or another competent authority appropriate to the emergency.

After immediate safety needs have been addressed, DPTT may be contacted for reasonable coordination assistance.

47. Incident Reporting

Accidents, injuries, mechanical problems, theft, property damage, significant disputes, or other material incidents should be reported promptly to the responsible Provider.

DPTT should also be notified where Agency coordination assistance is requested.

Clients should preserve reasonably available evidence, including: photos; videos; receipts; names of witnesses; police or authority reports; medical documents; Provider communications; and other relevant records.

48. Claims Relating to Independent Provider Performance

Where a claim arises principally from the operational performance of an independent Provider, the relevant Provider may be responsible for investigating and responding to the matter under its own terms and applicable law.

DPTT may assist with: forwarding Client concerns; providing Agency-held booking records; requesting Provider information; communicating Provider responses; or helping identify available options.

Such assistance does not constitute an admission of Agency liability and does not guarantee the outcome of a Provider claim.

49. Release Concerning Risks Outside the Agency’s Reasonable Control

To the fullest extent permitted by applicable law, the Client releases and waives claims against DPTT and its owners, officers, employees, agents, and representatives to the extent that such claims arise solely from: independent Provider acts or omissions; operation or condition of Provider-controlled vehicles, vessels, equipment, accommodations, or activities; the acts of unrelated third parties; weather and natural conditions; government restrictions; force majeure; or other circumstances outside DPTT’s reasonable control.

This provision does not waive liability that applicable law does not permit to be waived.

50. Client Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, and authorized representatives from third-party claims, losses, penalties, liabilities, or reasonable expenses arising directly from the Client’s: illegal conduct; fraud; intentional misconduct; material breach of these Terms; material misrepresentation; damage to third-party property; unauthorized operation of a rental; unsafe conduct; violation of Provider rules; or violation of another person’s lawful rights.

This clause does not require the Client to indemnify DPTT for a responsibility that applicable law places directly and non-waivably upon the Agency.

51. Subrogation

To the extent permitted by applicable law and any relevant insurance contract, the Client agrees that an insurer paying a claim should not acquire greater rights against DPTT than the Client lawfully possesses under these Terms.

Nothing in this clause overrides mandatory insurance or subrogation law.

52. Consequential and Indirect Losses

To the fullest extent permitted by law, DPTT shall not be responsible for indirect, incidental, exemplary, punitive, special, or consequential losses arising from circumstances outside the Agency’s reasonable control or from independent Provider operations.

Such losses may include: lost income; lost profits; lost business; missed work; missed appointments; lost opportunity; business interruption; missed onward reservations; additional personal travel expenses; loss of enjoyment; or similar consequential economic loss.

Specific liability provisions applicable to claims against DPTT are further addressed in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.

53. Specific Monetary Liability Limitation

Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, any applicable monetary limitation shall be determined under the more specific Tours, Travel Packages, and Service Waiver and Liability Disclaimer, subject to applicable law.

That more specific liability provision shall control over a general limitation appearing elsewhere in the Agency’s policy framework to the extent both provisions address the same claim.

This structure is intended to avoid inconsistent monetary liability limits across DPTT’s different legal pages.

54. Consumer Protection and Non-Waivable Rights

Nothing in these Terms is intended to unlawfully waive, eliminate, exclude, or restrict a right, legal responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.

If a provision is legally restricted, it shall apply to the maximum extent permitted while the remainder of these Terms continues to operate where legally possible.

55. Evidence-First Dispute Resolution

Clients and DPTT agree that disputes should first be addressed using available evidence.

Relevant evidence may include: Booking Confirmations; receipts; payment records; messages and timestamps; photos and videos; Provider notices; manifest information; government advisories; incident reports; medical documentation; rental inspection records; and other relevant documents.

56. Mandatory Direct Resolution Before Court Proceedings

If a Client has a complaint, claim, disagreement, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to the Agency through an Official Channel.

The Client and Agency shall then attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.

During this period, both sides should reasonably cooperate in reviewing relevant records and attempting practical resolution.

57. Provider Disputes

Where a dispute is primarily between a Client and an independent Provider, DPTT may, at its discretion and where appropriate: relay communications; provide relevant Agency-held records; seek clarification from the Provider; assist with documentary coordination; or help identify available complaint procedures.

DPTT’s coordination role does not make the Agency the arbitrator or guarantor of the Provider dispute.

58. Governing Law and Exclusive Court Venue

These Terms and disputes arising from or relating to bookings, Services, transactions, Agency policies, or communications are governed by the laws of the Republic of the Philippines.

If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.

The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.

59. Mediation, Arbitration, or Other Proceedings Involving Providers

If mediation, arbitration, administrative proceedings, or other dispute processes occur between the Client and an independent Provider, DPTT may, at its discretion and where lawfully appropriate, provide relevant Agency-held records concerning the transaction.

DPTT’s participation for documentary or evidentiary purposes does not create: a duty to represent either party; an admission of liability; a partnership; an operational responsibility for the Provider; or a guarantee concerning the outcome of the proceeding.

60. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.

The remaining provisions shall continue to operate to the fullest extent permitted by law.

61. No Waiver by Non-Enforcement

A delay or failure by DPTT to enforce a provision on one occasion does not constitute a permanent waiver of that provision.

An exception, credit, refund, rescheduling accommodation, goodwill payment, or other concession given in one particular circumstance does not automatically create a precedent or amend these Terms for another Client or booking.

62. Changes to These Terms

DPTT may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; booking procedures; technology; payment systems; travel conditions; government regulations; legal requirements; or business processes.

The current version will be published at:

https://bookwithoutcreditcard.com/termsofservice

Updates generally apply to future bookings and subsequent Site use, while existing transactions remain subject to the terms and mandatory laws legally applicable to them.

B6. Waiting Time

Waiting-time allowances and additional waiting fees are determined by the applicable Provider and booking arrangement.

B7. Refunds and Itinerary Changes

Cancellation and refund matters are governed by the Refund Policy and applicable Provider terms.

No prorated refund is due merely because a land-tour stop is modified or skipped for one of the safety, weather, road, authority, or reasonable operational reasons stated in these Terms.

C1. Scope

Airport transfers may be coordinated using suitable available land transportation in accordance with the particular booking.

The separate Airport Transfer Terms and Conditions (Car, Van & Tuk-Tuk) page contains the specific conditions applicable to those Services.

C3. Delays

Airport transfers may be affected by flight delays, road conditions, traffic, weather, Provider scheduling, waiting-time limits, or other circumstances.

Any waiting-time extension or additional charge is subject to the booking and Provider rules.

Annex D — Boat Transfers, Island Hopping, and Sea Travel

The responsible maritime Provider manages vessel assignment, operational readiness, captain and crew assignment, safety procedures, manifests, and Provider-side permit or compliance requirements.

D5. Weather and Sea Conditions

D6. Connection Buffer

The source Terms recommend allowing at least four (4) hours of additional buffer where a sea segment connects to an important onward flight, ferry, or similar fixed commitment.

Clients should allow more time where circumstances reasonably require it.

D7. No Prorated Destination Refund

No prorated refund is due merely because a sea-tour destination or stop is skipped, shortened, substituted, or made unavailable because of safety, weather, sea conditions, lawful authority directives, or the Provider/operator’s reasonable operational discretion.

Annex E — Car Rentals

E1. Car Rental With Driver

Bookings involving a vehicle with driver are additionally governed by the Car Rental With Driver: Terms and Conditions terms.

The Provider is responsible for the assigned driver and operational management of the vehicle.

E2. Self-Drive Car Rental

Self-drive car rentals are additionally governed by the Self-Drive Car Rental: Terms and Conditions terms.

The Client is responsible for satisfying applicable driving-license and eligibility requirements and for complying with rental restrictions, traffic laws, return requirements, and vehicle-use conditions.

E3. Inspection

Self-drive Clients should inspect and document the vehicle’s visible condition before accepting it.

Damage, theft, accidents, mechanical concerns, and other incidents must be reported promptly under the applicable rental terms.

Annex F — Tours and Travel Packages

F1. Scope

This Annex applies to day tours, guided tours, mixed-activity excursions, and packages that combine several travel components.

The applicable Tours, Travel Packages, and Service Waiver and Liability Disclaimer forms an important part of the governing framework.

F2. Multiple Providers

A package may combine Services from different independent Providers, including: transportation; boats; accommodation; guides; meals; activities; equipment; permits; and other components.

Each Provider remains responsible for the operational component it performs.

F3. Substitutions

Package components may be reasonably substituted because of availability, safety, weather, regulatory requirements, capacity, Provider changes, or other legitimate operational circumstances.

F4. Protected Areas and Environmental Rules

Clients must comply with environmental, wildlife, conservation, protected-area, waste-disposal, and visitor-management rules applicable to destinations visited.

Violation of such rules may result in penalties or denial of participation by the competent Provider or authority.

Annex G — Dispute Documentation and Agency Assistance

DPTT encourages evidence-based resolution of travel disputes.

Where appropriate, the Agency may provide relevant records in its possession concerning: bookings; payments; confirmations; Client instructions; Provider communications; cancellations; refunds; schedule changes; and other transaction records.

If a dispute primarily concerns an independent Provider, DPTT’s documentary assistance does not make the Agency the decision-maker regarding the Provider’s liability.
