These Boat Rental (With Boat Captain) Terms (“Terms”) apply to boat rentals, private boat charters, vessel-hire arrangements, island-hopping boat rentals, and similar by-sea Services with a captain and, where applicable, crew, coordinated, reserved, booked, arranged, scheduled, or otherwise assisted by D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).

For purposes of these Terms, a Boat Rental generally means a vessel hired for the private or exclusive use of the Client and/or the Client’s group for an agreed period or itinerary, with a captain supplied by the independent boat owner or Provider and, where applicable, additional crew.

Depending on local availability and the confirmed booking, a Vessel may include: outrigger boats or bangkas; motorized bancas; pump boats; speedboats; small passenger vessels; or other suitable watercraft used for marine tourism. These Terms explain: DPTT’s travel coordination and booking role; the independent Boat Provider’s operational responsibilities; the captain’s authority over navigation and safety; booking and payment requirements; passenger manifests and identification; weather and sea-condition risks; itinerary, anchoring, swimming, snorkeling, and beach-landing rules; passenger conduct and environmental responsibilities; damage and cleanliness responsibilities; cancellation and refund conditions; emergency and incident procedures; and applicable liability limitations. Please read these Terms before making payment.

Booking, reserving, paying for, confirming, dispatching, boarding, participating in, receiving, using, or otherwise availing a Boat Rental through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms and all applicable Agency policies, procedures, company processes, Provider requirements, captain/crew instructions, safety rules, and regulations.

If anything is unclear, contact D’Palawan Travel and Tours before making payment.

If you disagree with any applicable provision, do not proceed with the booking or Service.

“Provider,” “Boat Provider,” “Boat Rental Provider,” or “Independent Provider” means the independent boat owner, charter operator, captain, business, supplier, or other independent party responsible for performing the Boat Rental.

“Captain” means the person designated by the Provider to navigate and exercise operational command over the Vessel during the Service.

“Crew” means any additional personnel assigned by the Provider to assist with navigation, docking, passenger service, safety, equipment, or other operational functions.

“Vessel” means the boat or other watercraft assigned by the Provider.

“Boat Rental” means the private or exclusive hire of a Vessel with Captain for an agreed period, route, itinerary, or tourism purpose.

“Booking Confirmation” means the applicable written or electronic confirmation, itinerary, message, receipt, voucher, invoice, acknowledgment, or similar booking record.

“Official Channels” means the telephone number, email, website, messaging accounts, and other communication channels identified or authorized by DPTT.

“Calendar days” means consecutive days, including weekends and public holidays, unless otherwise stated.

2. Scope of Boat Rental Services

These Terms apply to private or exclusive Boat Rentals with Captain, including: half-day rentals; full-day rentals; multi-day charter arrangements; island hopping; beach hopping; sightseeing by boat; lagoon visits; private marine excursions; snorkeling stops; swimming stops; beach landings; anchoring and recreational stopovers; private group outings; Boat Rentals incorporated into tour packages; and other comparable private marine-tourism arrangements.

3. Boat Rental Distinguished From Boat Transfer

A Boat Rental is different from a simple point-to-point Boat Transfer.

Where the primary purpose of a booking is transportation from an agreed START point to an agreed END point, without a private recreational charter itinerary, the Boat Transfer Terms and Conditions apply.

Where one itinerary includes both:

  • a private Boat Rental or charter component; and
  • a separate point-to-point sea-transfer component,

each component may be governed by its applicable Service-Specific Terms.

4. Boat Rentals Included in Tours and Packages

Where a Boat Rental forms part of a day tour, multi-day package, or other travel arrangement, these Terms apply together with the: Travel Booking & Service Terms and Conditions; Tours, Travel Packages, and Service Waiver and Liability Disclaimer; Booking Cancellation, Rescheduling & Refund Policy; Booking Confirmation; Provider rules; and applicable government, maritime, environmental, and protected-area regulations.

5. D’Palawan Travel and Tours’ Role

D’Palawan Travel and Tours operates as a travel coordination and booking agency.

DPTT may assist with: identifying available Boat Rental options; checking Provider availability; requesting quotations; coordinating reservations; communicating proposed itineraries; collecting passenger information; communicating manifest requirements; coordinating meeting points; communicating proposed departure and return windows; coordinating payments; relaying Provider requirements; communicating weather or operational changes; relaying permit or protected-area requirements; and providing reasonable booking support. The actual Boat Rental Service is performed by the independent Provider responsible for the booking.

6. Provider Operational Responsibility

The Boat Provider generally manages the operational aspects of the Boat Rental.

Depending on the Service, these may include: Vessel assignment; Vessel condition; maintenance; operational readiness; Captain assignment; Crew assignment; navigation; fuel requirements; safety equipment; passenger capacity; cargo and baggage limitations; route feasibility; weather and sea-state assessment; anchoring; boarding and disembarkation; swimming or snorkeling restrictions; return-time requirements; Provider-side permits and documentation; emergency procedures; and compliance with maritime requirements applicable to the Provider. DPTT’s booking and coordination functions do not transfer day-to-day operational management of the Vessel, Captain, Crew, equipment, navigation, or maritime operation to the Agency.

7. Captain’s Operational Authority

The Captain has final operational authority over the Vessel while the Boat Rental is underway, subject to applicable law and competent government authorities.

For safety, navigation, compliance, or operational reasons, the Captain may reasonably: approve or reject a proposed route; change the route; change the order of destinations; skip a destination; shorten a stop; change an anchoring point; refuse unsafe anchoring; restrict swimming; restrict snorkeling; restrict beach landings; delay departure; leave a destination early; return to port early; seek shelter; change a landing point; direct passengers where to sit or move; control baggage or weight distribution; terminate an activity; or take other reasonable measures necessary for safe Vessel operation. Client itinerary preferences do not override the Captain’s reasonable safety or compliance decisions.

8. Government and Maritime Authority Requirements

Boat Rentals remain subject to lawful requirements of competent authorities, including, where applicable: Philippine Coast Guard; port authorities; local government units; protected-area management offices; environmental authorities; tourism offices; law-enforcement authorities; and other competent agencies. Lawful authority directives take priority over Client preferences, preliminary itineraries, or earlier operational expectations.

9. Booking Is Not Confirmed Until Acknowledged

An inquiry, quotation, suggested itinerary, availability check, or preliminary discussion does not by itself constitute a confirmed Boat Rental.

The booking becomes confirmed when:

  • DPTT or the applicable Provider acknowledges the reservation as confirmed; and
  • any required deposit, payment, passenger information, documentation, or other booking requirement has been satisfied and verified.

Before confirmation, Vessel availability, Provider, Captain, itinerary, price, meeting point, and schedule remain subject to change.

10. Acceptance of These Terms

The Client accepts these Terms by: making a reservation; paying a deposit; making partial or full payment; accepting the Booking Confirmation; replying “Confirmed,” “Yes,” “Agree,” or similar language; requesting or authorizing Vessel dispatch; appearing at the meeting point; boarding the Vessel; participating in a related activity; or otherwise using the Boat Rental. Acceptance includes all applicable Agency policies, company processes, Provider requirements, Captain/Crew instructions, safety rules, and regulations.

11. Day-Before Reconfirmation Is Required

Clients with advance Boat Rental bookings must contact D’Palawan Travel and Tours on the day before the scheduled rental to ensure that the booking has been properly acknowledged and to obtain the latest available operational information.

The Client should verify, as applicable: booking name; rental date; meeting point; departure window; passenger count; proposed itinerary; Provider assignment; manifest information; weather or sea-condition updates; permit requirements; environmental fees; items to bring; return-time requirements; and other operational instructions.

12. Latest Instructions Control

The Client should rely on the most recently confirmed instructions rather than solely upon: an old quotation; an earlier screenshot; a preliminary itinerary; an earlier meeting point; a general website description; a weather forecast obtained earlier; or an estimated schedule communicated before operating conditions were known.

13. Passenger Manifest Requirements

A Boat Rental may require passenger information for manifests, permits, port procedures, protected-area requirements, or other lawful purposes.

Depending on applicable requirements, information may include: full legal name; age; date of birth; nationality; gender where specifically required; identification details; passenger count; and other required information.

14. Accuracy of Passenger Information

The Client is responsible for ensuring that passenger information supplied for the booking is accurate and complete.

Incorrect, incomplete, inconsistent, or late information may result in: delay; manifest reprocessing; denial of boarding; permit difficulties; restricted itinerary; government penalties; additional costs; or inability to provide the Service. Any refund consequences are governed by the Refund Policy and Provider rules.

15. Identification

Passengers should carry valid identification where required.

Identification may be requested by: the Provider; port personnel; the Philippine Coast Guard; protected-area personnel; local authorities; law-enforcement personnel; or another competent authority.

16. Permits, Environmental Fees, and Entrance Fees

Some Boat Rental itineraries may involve destinations requiring: environmental fees; entrance fees; protected-area permits; tourism fees; user fees; marine-park fees; or other government or destination charges. Unless the Booking Confirmation expressly states that a particular fee is included, the Client should be prepared to pay legitimate applicable onsite or government charges.

17. Conditional Nature of the Itinerary

Any proposed Boat Rental itinerary is conditional.

Islands, beaches, lagoons, snorkeling points, swimming areas, anchorages, and other destinations remain subject to: weather; sea state; wind; waves; currents; tides; visibility; boat traffic; fuel requirements; daylight; port requirements; protected-area restrictions; environmental rules; government directives; Captain/Crew safety assessment; and other legitimate operational conditions.

18. No Guaranteed Destination or Stop

The inclusion of a destination in a preliminary or confirmed itinerary does not create an absolute guarantee that the destination will be safely, lawfully, or operationally accessible on the rental date.

The Captain may reasonably skip, replace, shorten, reorder, or terminate a destination where circumstances require.

19. No Prorated Refund for Skipped Sea-Tour Destinations

No prorated or proportional refund is due merely because an island, beach, lagoon, snorkeling location, swimming stop, anchorage, attraction, route, or other itinerary component is skipped, shortened, reordered, replaced, or made unavailable because of:safety considerations;weather;sea conditions;wind, waves, tides, or currents;government or authority directives;environmental restrictions;protected-area rules;capacity restrictions;mechanical circumstances;emergency conditions; or the Captain, Provider, or operator’s reasonable operational or safety discretion. The Client acknowledges that Boat Rental pricing generally reflects overall Vessel use, Captain/Crew time, fuel or operating costs as applicable, mobilization, coordination, and the rental period rather than a separately refundable price assigned to each individual destination.

20. Anchoring

Anchoring is subject to: Captain approval; depth; currents; wind; seabed conditions; marine traffic; environmental restrictions; protected-area rules; designated anchoring zones; and other safety and compliance requirements. The Client may not require the Captain to anchor in a location the Captain reasonably considers unsafe, restricted, or environmentally prohibited.

21. Swimming

Swimming may be permitted only where the Captain, Crew, Provider, and applicable authorities allow it.

Swimming may be restricted or prohibited because of: strong currents; waves; poor visibility; weather; boat traffic; marine hazards; water depth; dangerous shoreline conditions; protected-area restrictions; time limitations; or other safety concerns.

22. Snorkeling

Snorkeling is subject to actual conditions and Provider rules.

The Client understands that snorkeling involves risks including: drowning; currents; waves; fatigue; cramps; panic; water inhalation; limited visibility; marine-life contact; equipment problems; boat traffic; sharp coral or rocks; and other water-related hazards. Clients must honestly assess their swimming ability and follow applicable safety instructions.

23. Swimming and Snorkeling Are Voluntary

A Passenger is not required to enter the water merely because swimming or snorkeling is included in the proposed itinerary.

Any Passenger choosing to participate must comply with Provider, Captain, Crew, and applicable safety requirements.

24. Beach Landings

Beach landings may involve: moving boats; waves; wet surfaces; uneven sand; rocks; coral fragments; wading; slippery steps; ladders; shallow-water hazards; and other local conditions. Passengers must follow Crew instructions and exercise reasonable care.

25. Protected Areas and Environmental Compliance

Marine and coastal destinations may be subject to environmental and protected-area rules.

Depending on the destination, prohibited or restricted conduct may include: anchoring on coral; touching or stepping on coral; collecting shells or marine organisms; feeding wildlife; removing sand, coral, plants, or natural objects; littering; smoking in restricted areas; loud music; alcohol consumption in restricted areas; entering closed zones; disturbing wildlife; or other environmentally prohibited activity. Clients must follow applicable environmental laws and destination rules.

26. Environmental Violations

A Client who violates environmental or protected-area rules may be subject to: government fines; penalties; removal from the area; termination of the activity; early return; confiscation of prohibited items where authorized by law; or other lawful enforcement action. DPTT shall not be responsible for penalties resulting from the Client’s own unlawful conduct.

27. Rental Period

The Boat Rental is limited to the period stated or reasonably understood from the Booking Confirmation.

Rental periods may be structured as: half-day; full-day; specific departure and return times; multi-day arrangements; or another agreed rental period.

28. Daylight, Port, and Return-Time Restrictions

The rental may be subject to: daylight limitations; port return windows; local operating hours; Coast Guard requirements; protected-area closing times; weather windows; tide considerations; Crew duty limitations; and other Provider restrictions. The Client must cooperate with the Captain’s reasonable instructions regarding timely departure from destinations and return to port.

29. Client-Caused Late Return

If the Client’s actions cause the Vessel to exceed the agreed rental period or applicable return window, additional Provider charges may apply.

Examples include: refusing to leave a stop at the instructed time; requesting additional destinations; requesting extended swimming or snorkeling; arriving late for departure; requesting an extended route; or other Client-requested delays. Any extension remains subject to Captain and Provider approval and cannot be required where unsafe, unlawful, or operationally impractical.

30. Itinerary Additions and Extensions

Additional destinations, extra rental time, additional fuel requirements, or other material changes requested after confirmation may result in additional charges.

Such changes are subject to: Provider approval; Captain approval; fuel availability; weather; daylight; permits; route feasibility; return-time restrictions; and other operational conditions.

31. Vessel Assignment

The Provider generally assigns the Vessel according to: passenger count; route; availability; capacity; weather; sea conditions; operational requirements; and the Booking Confirmation. If a specific Vessel characteristic is essential to the Client, it should be confirmed before payment.

32. Vessel Substitution

The Provider may reasonably substitute the anticipated Vessel because of: maintenance; mechanical problems; availability; passenger capacity; weather; route requirements; safety; regulatory requirements; or other legitimate operational reasons. A reasonable replacement Vessel capable of providing the essential Boat Rental Service does not automatically create a refund entitlement.

33. Captain or Crew Substitution

The Provider may substitute the Captain or Crew because of: availability; illness; scheduling; qualification requirements; route assignment; emergency circumstances; or other legitimate operational reasons. A reasonable personnel substitution does not automatically constitute cancellation.

34. Provider Substitution

If the original Provider becomes unavailable, DPTT or the responsible Provider may coordinate a reasonable alternative independent Provider where practicable.

A reasonable Provider substitution that preserves the essential nature of the Boat Rental does not automatically create a refund entitlement.

35. Boat and Marine Risks

The Client acknowledges that boating involves risks that cannot be completely eliminated.

These may include: rough seas; sudden weather changes; strong currents; waves; wind-driven spray; wet decks; slips and falls; boarding hazards; disembarkation hazards; collision; mechanical problems; engine failure; fuel problems; grounding; swamping; capsizing; sinking; floating debris; entanglement; sun exposure; heat exhaustion; dehydration; motion sickness; drowning; marine stings or bites; sea-urchin injuries; coral cuts; sharp rocks; limited communications; delayed rescue; and other maritime hazards.

36. Weather and Sea Conditions

Boat Rental operations may be affected by: rain; storms; wind; waves; currents; tides; visibility; sea state; localized weather; port conditions; and government advisories. A sunny forecast or good weather at one location does not guarantee safe conditions throughout the proposed itinerary.

37. Weather-Related Operational Changes

Because safety takes priority, a Boat Rental may be: delayed; rerouted; shortened; rescheduled; restricted; returned early; or cancelled where conditions reasonably require.

38. Force Majeure

Boat Rental Services may also be affected by circumstances beyond the reasonable control of DPTT or the Provider.

Examples include: typhoons; storms; earthquakes; tsunami warnings; port closures; protected-area closures; government actions; environmental restrictions; security incidents; civil disturbance; public-health restrictions; utility failure; telecommunications failure; emergency directives; or other comparable events beyond reasonable control.

39. Passenger Capacity

The Client must provide an accurate passenger count.

The number of passengers must remain within the lawful and operational capacity established for the Vessel.

An undisclosed increase in passenger count may result in: denial of additional passengers; requirement for a larger Vessel; requirement for another Vessel; additional charges; rescheduling; or cancellation where suitable capacity is unavailable.

40. Baggage and Cargo

The Provider may impose limits concerning: baggage size; baggage weight; cargo; coolers; sports equipment; diving or snorkeling equipment; fragile items; hazardous items; and other property brought aboard. Unusually large or heavy items should be disclosed before booking.

41. Hazardous and Prohibited Items

Passengers must not bring aboard items prohibited by law, authority rules, or Provider safety requirements.

These may include: illegal drugs; contraband; explosives; unsafe fuel containers; dangerous chemicals; unauthorized weapons; flammable materials; or other hazardous items.

42. Passenger Conduct

Passengers must behave safely, lawfully, and respectfully.

Conduct that may justify restriction or termination of participation includes: violence; threats; harassment; serious intoxication; illegal drug use; reckless movement aboard the Vessel; interference with the Captain or Crew; refusal to follow material safety instructions; intentional damage; environmental violations; prohibited-item violations; or other conduct creating a material safety or legal risk.

43. Intoxication

The Captain or Provider may refuse boarding, restrict an activity, or terminate participation where a Passenger’s intoxication creates a reasonable safety concern.

Refund consequences are governed by Provider rules and the Refund Policy.

44. Life Jackets and Safety Equipment

Passengers must comply with instructions concerning life jackets and other safety equipment.

Where instructed, passengers must: wear life jackets properly; keep life jackets secured; avoid tampering with emergency equipment; keep emergency access areas clear; remain where instructed; and follow Captain and Crew directions.

45. Minors and Dependents

A parent, guardian, or responsible accompanying adult remains responsible for supervising minors and dependents.

Children must comply with: life-jacket requirements; seating requirements; boarding procedures; swimming restrictions; snorkeling restrictions; Captain/Crew instructions; and other applicable safety rules.

46. Health and Fitness

Passengers are responsible for considering whether they are medically and physically suitable for boating and any optional marine activities.

Particular consideration should be given to: pregnancy; heart conditions; asthma; respiratory conditions; seizure disorders; severe motion sickness; mobility limitations; recent surgery; poor swimming ability; serious anxiety concerning water or boats; and other health conditions affected by marine travel. Clients should obtain professional medical advice where appropriate.

47. Personal Medication and Medical Supplies

Passengers are responsible for carrying required personal medication and medical supplies.

Medication should be: accessible; protected from seawater; appropriately stored; and available to the Passenger when needed.

48. Personal Belongings

The Client is responsible for safeguarding personal property unless the Provider expressly accepts custody under separate terms.

The marine environment may expose property to: seawater; spray; rain; wet decks; movement; loading and unloading; sand; heat; and other conditions capable of causing damage. Passengers should protect: phones; cameras; passports; cash; identification; medication; documents; electronics; and other valuables.

49. Client Responsibility for Damage to the Vessel

The Client and members of the Client’s group must exercise reasonable care while aboard the Vessel.

Subject to Provider rules and applicable law, the Client may be responsible for damage or loss caused by the Client or members of the Client’s group through: intentional conduct; reckless conduct; misuse of equipment; unauthorized activity; failure to follow Captain/Crew instructions; damage to fixtures or equipment; loss of Provider property; or other wrongful acts or omissions.

50. Cleaning Charges

The Provider may impose reasonable cleaning charges where the Vessel is returned in a condition materially beyond ordinary use because of Client or group conduct.

Examples may include: excessive trash; food or beverage spillage; vomit requiring special cleaning; unauthorized substances; damage-related debris; or other extraordinary cleaning requirements. Any charge is subject to Provider rules and applicable law.

51. Equipment Supplied With the Boat

Depending on the booking, the Provider may supply items such as: life jackets; masks; snorkels; fins; coolers; other marine equipment; or other incidental items. Only items expressly included in the Booking Confirmation should be assumed to form part of the rental price.

52. Lost or Damaged Provider Equipment

A Client may be responsible under Provider rules for Provider equipment lost or damaged through misuse, intentional conduct, recklessness, or other Client-caused circumstances.

Normal wear and matters not caused by the Client remain subject to Provider responsibility and applicable law.

53. Bookings Made Within Three Days Are Non-Refundable

A Boat Rental booking first made within three (3) calendar days of the scheduled Service date is non-refundable from the time the booking is confirmed.

This applies subject to rights that applicable law does not permit the parties to exclude.

Clients making short-notice Boat Rental bookings should ensure that their plans are final before payment.

54. Other Cancellation and Refund Rules

All other cancellation and refund requests are governed by: the Booking Cancellation, Rescheduling & Refund Policy; Provider rules; group size; Vessel reservation commitments; Crew commitments; fuel or mobilization costs already incurred; permits; payment-processing expenses; other non-recoverable costs; and applicable law.

55. Client No-Show

A Client may be treated as a no-show where the Client: fails to appear; arrives beyond the Provider’s allowable waiting period; cannot be contacted; goes to an incorrect meeting point despite updated instructions; fails manifest requirements; fails identification requirements; refuses to proceed after reasonable Provider mobilization without a qualifying basis; or otherwise fails to use an available confirmed Boat Rental. No-shows are generally non-refundable under the Refund Policy and applicable Provider rules.

56. Provider Cancellation

If the Provider cancels before Service and cannot reasonably provide a substitute, possible options may include: rescheduling; alternative Vessel; alternative Provider; credit; partial refund; refund of recoverable amounts; or another available remedy. The actual remedy depends on Provider policy, circumstances, amounts already committed, the Refund Policy, and applicable law.

57. Cancellation or Modification Due to Weather or Safety

A weather or safety-related modification does not automatically create a full refund right where the Boat Rental can reasonably continue through: an alternative itinerary; different destinations; a shorter safe route; a different departure time; a substitute Vessel; a substitute Provider; or another reasonable arrangement.

58. Emergency Response

In a maritime, medical, weather, security, or other emergency, the Captain, Crew, Provider, and competent authorities may take reasonable immediate action.

Emergency response may be affected by: distance; sea conditions; weather; communications; rescue-Vessel availability; time of day; port access; local medical resources; and other operational circumstances. Clients should review the Traveler Emergency & Incident Response Guide.

59. Emergency Medical Assistance

Where reasonably necessary, the Provider, Captain, or Crew may seek medical, rescue, evacuation, or emergency assistance for a Passenger.

DPTT may also assist with communications or coordination where reasonably possible.

The Client remains responsible for personal: medical expenses; hospital expenses; medication; emergency transportation; rescue costs; evacuation; additional accommodation; and other personal emergency expenses except to the extent another responsible party or applicable law provides otherwise.

60. Incident Reporting

A significant accident, injury, loss, property damage, environmental incident, dispute, or other material event should be reported promptly to the Provider.

DPTT should also be notified where Agency coordination assistance is requested.

Where reasonably possible, Clients should preserve: photographs; videos; witness information; Provider details; Vessel information; receipts; medical documents; government reports; messages; Booking Confirmations; and other relevant evidence.

61. Claims Concerning Boat Provider Operations

Where a claim principally concerns the operational performance of the Boat Provider, the Provider may be responsible for investigating and responding under its procedures and applicable law.

This may include claims involving: Vessel operation; Captain or Crew conduct; navigation; maintenance; equipment; anchoring; Provider safety procedures; Provider cancellation; operational delay; boarding; baggage handling; or another Provider-controlled matter.

62. DPTT Assistance With Provider Claims

DPTT may, where reasonably appropriate: relay a complaint; provide Agency-held booking records; forward Client documentation; request clarification from the Provider; communicate the Provider’s response; or assist with identifying available Provider remedies. Such assistance does not constitute an admission of Agency liability and does not guarantee compensation, refund, insurance payment, Provider admission, replacement Service, or another requested outcome.

63. Assumption of Ordinary Marine and Activity Risks

To the fullest extent permitted by applicable law, the Client voluntarily accepts the ordinary and inherent risks reasonably associated with: boating; sea travel; boarding and disembarkation; island hopping; swimming; snorkeling; beach access; marine conditions; weather; natural terrain; other passengers; and other inherent characteristics of the chosen activities. This assumption of risk does not eliminate liability that applicable law makes non-waivable.

64. Release Concerning Independent Provider and Third-Party Matters

To the fullest extent permitted by applicable law, the Client releases and waives claims against DPTT and its owners, officers, employees, agents, and authorized representatives to the extent that a claim arises solely from: independent Provider acts or omissions; Vessel operation; Captain/Crew conduct; Provider-controlled equipment; Provider maintenance; independent marine activities; acts of unrelated third parties; natural conditions; weather; government restrictions; Force Majeure; or other circumstances outside DPTT’s reasonable control. This release does not apply to liability that applicable law does not permit to be waived.

65. Client Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, agents, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Client’s: illegal conduct; fraud; intentional misconduct; inaccurate manifest information; damage to the Vessel or Provider property; environmental violation; possession of prohibited items; unsafe conduct; interference with the Captain or Crew; material breach of these Terms; or violation of another person’s lawful rights. This provision does not require the Client to indemnify DPTT for a legal responsibility applicable law places directly and non-waivably upon the Agency.

66. Personal Travel Insurance

Clients are encouraged to consider appropriate personal travel insurance according to their itinerary and circumstances.

Depending on the Client’s needs, coverage may include: medical expenses; accident coverage; emergency evacuation; trip cancellation; trip interruption; baggage; water activities; missed connections; and other appropriate risks.

67. Provider Insurance

If the Boat Provider states that insurance exists, any coverage may remain subject to: coverage limits; exclusions; deductibles; eligible passengers; covered activities; geographical limits; reporting deadlines; documentation requirements; and insurer approval. DPTT does not guarantee the scope, adequacy, continued validity, or outcome of independent Provider insurance unless expressly verified and confirmed in writing.

68. Privacy and Passenger Information

DPTT may collect and share personal information reasonably necessary for: booking; manifest preparation; identification; Provider coordination; permits; protected-area requirements; payment verification; safety; incident documentation; refunds; claims; disputes; and other legitimate purposes described in the Privacy & Personal Data Policy.

69. Electronic Communications and Evidence

Booking confirmations, messages, emails, screenshots, payment records, photographs, videos, manifests, permit information, Provider communications, and other records exchanged or retained through Official Channels may be used to document: booking terms; acceptance; payments; passenger information; itinerary changes; Captain or Provider instructions; cancellations; participation; incidents; damage claims; refund requests; chargebacks; and disputes.

70. Controlling DPTT Liability Provision

These Boat Rental Terms do not establish a competing numerical liability cap.

Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, the controlling liability provisions are contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.

Accordingly, if a competent court determines D’Palawan Travel and Tours itself to be primarily liable, DPTT’s maximum aggregate monetary liability is limited, to the fullest extent permitted by applicable law, to two (2) times the Cash Received by DPTT from the Client for the specific booking or transaction giving rise to the claim.

The definition and calculation of “Cash Received,” aggregation of related claims, and other rules governing that limitation are set out in the controlling Waiver and Liability Disclaimer.

71. Consequential, Missed-Income, and Opportunity Losses

To the fullest extent permitted by applicable law, DPTT shall not be liable for consequential, indirect, incidental, special, exemplary, or punitive losses.

This expressly includes, where legally excludable: missed income;lost wages;lost earnings;lost profits;lost business;lost opportunities;opportunity costs;business interruption;missed work;missed flights or ferries;missed onward bookings;additional personal travel expenses; and similar consequential economic losses. The complete controlling provision is contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.

72. Agency Interpretation and Clarification

These Terms form part of DPTT’s broader legal, booking, safety, and operational framework.

If a DPTT provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must request clarification before payment or participation where the matter is material to the booking.

To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, rules, and terms, including determining which DPTT provision applies to a particular booking or circumstance.

This right does not authorize DPTT to override mandatory provisions of Philippine law.

73. Direct Resolution of Complaints and Disputes

If a Client has a complaint, claim, disagreement, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to DPTT through an Official Channel.

The Client should provide reasonably available supporting information such as: Booking Confirmation; payment records; messages; passenger information; Provider communications; photographs; videos; Vessel information; incident reports; medical documentation where relevant; government reports; and other reasonably relevant evidence. The Client and DPTT shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.

74. Governing Law and Exclusive Venue

These Terms and disputes arising from or relating to a Boat Rental, booking, transaction, communication, or Agency policy are governed by the laws of the Republic of the Philippines.

If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.

The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.

75. Consumer Protection and Non-Waivable Rights

Nothing in these Terms is intended to unlawfully waive, exclude, limit, or restrict any right, legal responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.

If any provision exceeds what applicable law permits, it shall apply only to the maximum lawful extent while the remaining provisions continue in effect.

76. Severability

If a competent authority determines that a provision of these Terms is invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.

The remaining provisions shall continue to operate to the fullest extent permitted by law.

77. No Waiver by Exception or Non-Enforcement

A delay or failure by DPTT to enforce a provision on one occasion does not permanently waive that provision.

A goodwill: refund; credit; rescheduling arrangement; alternative Vessel; alternative Provider; itinerary accommodation; additional time; or other concession granted in one case does not create a precedent or automatically amend these Terms for another booking.

78. Updates to These Boat Rental Terms

D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; maritime procedures; booking processes; technology; payment systems; safety procedures; government requirements; environmental rules; travel conditions; or other relevant circumstances. The current version will be published at:

https://bookwithoutcreditcard.com/boatrentalterms

Updates generally apply to future bookings and subsequent use, while existing transactions remain subject to the terms and mandatory laws legally applicable to them.

Advance bookings must be reconfirmed on the day before the scheduled Service. Bookings first made within three calendar days of the Service are non-refundable. No prorated refund is due merely because an island, beach, snorkeling location, swimming stop, lagoon, anchorage, route, or other sea-tour destination is skipped or modified because of safety, weather, sea conditions, authority restrictions, environmental requirements, or reasonable Captain/Provider operational discretion. Where DPTT itself is determined primarily liable by a competent court, the controlling liability limitation is the provision contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer. If anything is unclear, obtain clarification before payment. If you disagree with an applicable provision, do not proceed with the Service.
