These Services may include: short-duration Vehicle hire with driver; half-day or full-day use; hourly arrangements; multi-day Vehicle-with-driver arrangements; custom itineraries; multi-stop routes; meetings, errands, sightseeing, and tourism transportation; airport, port, terminal, hotel, or resort transportation; inter-town and long-distance travel; remote-area transportation; and Vehicle-with-driver components included in tours or travel packages.
Please read these Terms before making payment.Booking, reserving, paying for, confirming, accepting pickup, entering the assigned Vehicle, riding as a passenger, requesting the driver to begin or continue the Service, or otherwise availing a Car Rental (With Driver) through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms together with all applicable Agency policies, procedures, company processes, Provider requirements, safety instructions, and regulations.
If anything is unclear, contact D’Palawan Travel and Tours before making payment.
If you disagree with any applicable provision, do not proceed with the booking or Service.

“Driver” means the person assigned by the Provider to operate the Vehicle.
“Vehicle” means the applicable four-wheeled passenger vehicle assigned by the Provider.
“Car Rental (With Driver)” or “Vehicle-with-Driver Service” means an arrangement in which a Vehicle and Driver are supplied together for the Client’s agreed transportation requirements.
“Booking Confirmation” means the applicable written or electronic confirmation, itinerary, quotation acceptance, voucher, invoice, receipt, message, acknowledgment, or similar booking record.
“Official Channels” means the telephone number, email, website, messaging accounts, and other communication channels identified or authorized by DPTT.
“Calendar days” means consecutive days, including weekends and public holidays, unless otherwise stated.
2. Vehicle Types Covered
For convenience, the word “Car” may sometimes be used as a general label, but these Terms may apply to a variety of four-wheeled passenger Vehicles, including: sedans; SUVs; crossovers; vans; AUVs; MPVs; pickups configured for lawful passenger transportation; and other comparable four-wheeled Vehicles suitable for the booked Service.
The actual Vehicle assigned may depend on: passenger count; baggage; route; road conditions; availability; Vehicle capacity; Provider requirements; and the Booking Confirmation.
3. Scope of Vehicle-With-Driver Services
These Terms apply to four-wheeled transportation where a Driver is supplied by the independent Provider and the Client participates as a passenger.
Covered arrangements may include: airport transfers; port transfers; terminal transfers; hotel-to-hotel transportation; hotel or resort transfers; inter-town travel; inter-municipality transportation; hourly Vehicle hire; half-day or full-day hire; multi-day hire; meetings and business transportation; custom tourism itineraries; multi-stop routes; long-distance transportation; remote-area trips; Vehicle-with-driver tour components; and other comparable transportation arrangements.
4. Car Rental With Driver Distinguished From Self-Drive Rental
These Terms apply where the Provider supplies the Driver.
If the Client or another person authorized by the Client will personally drive or operate the Vehicle, the separate Self-Drive Car Rental: Terms and Conditions terms apply instead.
A Client must not assume that a Vehicle booked with a Driver may later be personally driven by the Client unless a separate lawful self-drive arrangement has been expressly authorized and documented.
5. Relationship With Land Transfer Terms
A Vehicle-with-driver booking may overlap operationally with a Land Transfer where the Service includes transportation from one point to another.
Where relevant, the Land Transfer Terms and Conditions (Car, Van, Tuktuk, E-Trike, Bicycle & E-Bike) may therefore apply together with these Terms.
These Car Rental (With Driver) Terms provide additional provisions relevant to: hourly or daily Vehicle use; custom itineraries; waiting time; overtime; additional stops; route extensions; extended Driver and Vehicle availability; and other rental-style Vehicle-with-driver arrangements.
6. Vehicle-With-Driver Services Included in Tours or Packages
Where the Vehicle-with-driver Service forms part of a day tour, travel package, accommodation package, or multi-day itinerary, these Terms apply together with: the Travel Booking & Service Terms and Conditions; the Tours, Travel Packages, and Service Waiver and Liability Disclaimer; the Booking Cancellation, Rescheduling & Refund Policy; the Booking Confirmation; applicable Provider rules; and other applicable DPTT policies.
7. D’Palawan Travel and Tours’ Role
D’Palawan Travel and Tours operates as a travel coordination and booking agency.
DPTT may assist with: identifying Vehicle-with-driver options; checking availability; obtaining quotations; coordinating reservations; communicating passenger count; communicating baggage requirements; coordinating pickup and drop-off points; communicating itinerary requests; coordinating payment arrangements; relaying Driver or Vehicle information; relaying schedule changes; communicating route or meeting-point updates; and providing reasonable booking assistance.
The actual transportation Service is performed by the independent Provider and Driver responsible for the booking.
8. Provider Operational Responsibility
The Provider generally manages the operational aspects of the Vehicle-with-driver Service.
Depending on the booking, these may include: Driver assignment; Vehicle assignment; Vehicle maintenance; roadworthiness; Driver scheduling; route selection; driving decisions; fuel arrangements; passenger capacity; baggage limitations; waiting-time rules; overtime rules; stop rules; parking; toll handling; Driver-side licensing and qualification requirements; Provider-side documentation; operational safety; and other day-to-day transportation decisions.
DPTT’s booking and coordination role does not transfer day-to-day operational management of the Vehicle, Driver, Provider personnel, maintenance, or transportation operations to the Agency.
9. Independent Provider Relationship
Providers generally maintain their own: Vehicles; Drivers; maintenance systems; business operations; registrations; insurance arrangements; pricing policies; waiting-time rules; overtime rules; route policies; employment or contractor relationships; and legal responsibilities.
A booking, referral, commission, or coordination relationship between DPTT and a Provider does not by itself create employment, partnership, joint venture, common ownership, or common operational control.
10. Remote or Limited-Availability Arrangements
Some destinations may have limited availability of Vehicles or established transportation Providers.
Where appropriate and lawful, DPTT may assist the Client in locating an available independent vehicle owner or Provider in response to the Client’s requested itinerary.
If a particular characteristic is material to the Client’s decision, it should be clarified before payment.
This may include: Vehicle type; air-conditioning; passenger capacity; baggage capacity; Vehicle age or configuration; Driver qualifications; registration; insurance; child-safety equipment; accessibility; or other material requirements.
11. Booking Is Not Confirmed Until Acknowledged
An inquiry, quotation, availability request, proposed itinerary, or payment instruction does not by itself guarantee a confirmed booking.
The Vehicle-with-driver Service becomes confirmed when:
- DPTT or the applicable Provider acknowledges that the reservation has been accepted; and
- any required deposit, payment, passenger information, itinerary information, or other confirmation requirement has been satisfied and verified.
Before confirmation, price, Vehicle, Driver, Provider, itinerary, availability, and schedule remain subject to change.
12. Acceptance of These Terms
The Client accepts these Terms by: making a reservation; paying a deposit; making partial or full payment; accepting the Booking Confirmation; replying “Confirmed,” “Yes,” “Agree,” or similar language; accepting pickup; entering the Vehicle; allowing the Driver to proceed with the agreed Service; requesting stops or route changes during the Service; or otherwise availing the Vehicle-with-driver arrangement.
13. Day-Before Reconfirmation Is Required
Clients with advance Car Rental (With Driver) bookings must contact D’Palawan Travel and Tours on the day before the scheduled Service to ensure that the booking has been properly acknowledged and to obtain the latest operational information.
The Client should verify, as applicable: booking name; Service date; pickup location; pickup time or window; destination or itinerary; passenger count; baggage requirements; Vehicle information where available; Driver information where available; contact number; flight or ferry information where relevant; special requirements; and other operational instructions.
14. Latest Confirmed Instructions Control
Clients should rely on the most recent confirmed operational instructions rather than solely on: an earlier quotation; an old screenshot; a preliminary route; an outdated pickup time; a previous Vehicle description; a promotional page; or an earlier travel-time estimate.
15. Accurate Pickup and Destination Information
The Client is responsible for supplying accurate and reasonably complete pickup, drop-off, and itinerary information.
Useful information may include: hotel or resort name; airport terminal; port or terminal; barangay; landmark; street or establishment; location pin; contact person; flight details; ferry details; and other practical location information.
Incorrect, incomplete, or misleading information may result in delay, additional mileage, waiting time, missed pickup, or additional charges.
16. Passenger Count
The Client must provide an accurate passenger count before confirmation.
An undisclosed increase in passengers may require: a larger Vehicle; an additional Vehicle; a different Provider; additional charges; schedule changes; or cancellation where suitable capacity is unavailable.
The Client must not pressure the Driver or Provider to exceed lawful or reasonable passenger capacity.
17. Baggage Disclosure
The Client should disclose material baggage requirements before booking.
This is especially important for: large suitcases; multiple bags per passenger; sports equipment; diving equipment; bicycles; surfboards; large boxes; mobility equipment; fragile property; or other unusually large or heavy items.
18. Excess or Undisclosed Baggage
Excess or undisclosed baggage may require: a larger Vehicle; another Vehicle; special arrangements; additional charges; reduced passenger capacity; or rescheduling where appropriate capacity is unavailable.
19. Vehicle Assignment
The Provider generally assigns a Vehicle based on: passenger count; baggage; route; road conditions; availability; capacity; operational requirements; and the Booking Confirmation.
If a particular Vehicle type or feature is essential, that requirement should be confirmed in writing before payment.
20. Vehicle Substitution
The Provider may reasonably substitute the originally anticipated Vehicle because of: maintenance; mechanical problems; availability; passenger count; baggage; route conditions; weather; safety; regulatory requirements; or other legitimate operational reasons.
A reasonable substitute capable of performing the essential booked Service does not automatically create a refund entitlement.
21. Driver Assignment
The Provider generally determines the Driver assigned to the Vehicle.
The Provider remains responsible for Driver-side qualifications and Provider employment or contracting arrangements applicable to the Service.
22. Driver Substitution
A Driver may be substituted because of: availability; illness; scheduling; route assignment; working arrangements; emergency circumstances; or other legitimate operational reasons.
A reasonable Driver substitution does not automatically constitute cancellation of the Service.
23. Provider Substitution
If the originally anticipated Provider becomes unavailable, DPTT or the Provider may coordinate a reasonable alternative Provider where practicable.
A reasonable Provider substitution that preserves the essential nature of the booked Service does not automatically create a refund entitlement.
24. Rental Period and Service Duration
The Service duration is determined by the Booking Confirmation and may be structured as: point-to-point; hourly; half-day; full-day; specific pickup and return times; multi-day; or another agreed period.
The Client should not assume that a fixed-price Service includes unlimited Vehicle and Driver use beyond the agreed period.
25. Custom Itineraries and Multi-Stop Use
A Client may request multiple stops or a customized itinerary where permitted by the Provider.
Any such itinerary remains subject to: agreed Service duration; route feasibility; road conditions; distance; Driver availability; Provider approval; fuel arrangements; parking; tolls; traffic; safety; applicable fees; and the Booking Confirmation.
26. Additional Stops
Stops not included in the original booking may be subject to Provider approval.
Additional stops may affect: Service duration; distance; fuel; Driver availability; waiting time; parking; tolls; route sequencing; and price.
27. Route Extensions
A requested route extension beyond the confirmed itinerary may require additional payment or a revised quotation.
The Driver is not required to undertake an extension that the Provider reasonably determines to be: unsafe; outside the booked Service area; operationally impractical; inconsistent with Driver scheduling; inconsistent with road conditions; unlawful; or otherwise outside the confirmed arrangement.
28. Waiting Time
Waiting-time allowances vary according to the Provider and Booking Confirmation.
Waiting may occur where the Client: is not ready at the agreed pickup time; requests the Vehicle to remain at a destination; extends a meeting or activity; delays a scheduled departure; experiences a delayed flight or ferry; requests additional stops; or otherwise requires the Vehicle and Driver to remain available beyond the included period.
29. Overtime
Where the Service exceeds the confirmed period because of a Client-requested extension, additional waiting, additional destinations, or other Client-requested use, Provider overtime or extension charges may apply.
The applicable rate or method of calculation is determined by the Provider or booking arrangement.
If overtime pricing is material to the Client, it should be clarified before payment.
30. Waiting Time and Overtime Caused by External Conditions
Traffic, road closures, weather, accidents, checkpoints, government restrictions, and similar circumstances may extend journey duration.
Whether such time creates an additional Provider charge depends on the applicable booking arrangement and Provider policy.
DPTT will communicate known rules where available but does not independently set every Provider’s waiting-time or overtime policy.
31. Fuel
Whether fuel is included in the quoted price depends on the Booking Confirmation and Provider arrangement.
The Client should obtain clarification before payment if fuel treatment is not clear.
Additional fuel charges may arise where the Client requests material route extensions, additional destinations, or use outside the originally confirmed scope, subject to Provider rules.
32. Tolls
Toll charges, where applicable, may be: included in the quoted price; payable separately by the Client; or handled under another Provider arrangement.
The Booking Confirmation or Provider terms control.
If toll treatment is material to the Client, clarification should be obtained before payment.
33. Parking
Parking fees may be included or excluded depending on the booking.
Where parking is charged by a third-party establishment, airport, port, attraction, hotel, government facility, or other location, the applicable charge may be payable separately unless expressly included.
34. Entrance, Terminal, and Other Third-Party Fees
Vehicle hire does not automatically include: entrance fees; terminal fees; airport charges; environmental fees; parking fees; tolls; permit fees; or other third-party charges unless those items are expressly identified as included.
35. Pickup and Drop-Off Points
The controlling pickup and drop-off details are those most recently confirmed through Official Channels.
A requested location may need to change because of: road restrictions; parking restrictions; airport or terminal rules; pedestrian-only areas; road closures; construction; flooding; traffic; security restrictions; Vehicle-access limitations; or other legitimate operational considerations.
36. Road Travel Risks
The Client acknowledges that travel by road involves risks that cannot be completely eliminated.
These may include: collisions; sudden braking; swerving; rollovers; driver error by any road user; reckless or negligent acts of third parties; pedestrians; animals crossing; road debris; potholes; blind curves; steep inclines or descents; narrow roads; poor visibility; damaged roads; bridge or culvert problems; landslides; flooding; falling rocks or debris; mechanical failure; overheating; tire failure; brake problems; electrical problems; checkpoints; roadworks; traffic; accidents; road closures; delayed emergency response; and other transport-related hazards.
37. Remote-Area Road Conditions
Remote travel may involve: unpaved roads; gravel roads; mountain roads; narrow roads; roads under construction; flood-prone areas; limited lighting; blind curves; weak mobile signal; limited repair facilities; limited roadside assistance; or long distances from medical facilities.
Clients should maintain reasonable flexibility regarding journey duration and comfort expectations on such routes.
38. Travel-Time Estimates
Travel-time estimates are planning estimates rather than guaranteed arrival times.
Actual journey time may vary because of: traffic; weather; road conditions; roadworks; checkpoints; local events; Vehicle issues; passenger stops; fuel stops; route changes; authority restrictions; or other operational circumstances.
39. Connection Buffer
Where the Service connects with a flight, ferry, appointment, tour, event, or other important fixed commitment, the Client should allow generous additional time.
Consistent with DPTT’s travel-planning framework, at least three (3) hours of additional buffer is recommended for important land-based connections.
This is a planning recommendation and not a guarantee that three hours will always be sufficient.
40. Missed Connections
To the fullest extent permitted by law, DPTT shall not be responsible for missed flights, ferries, tours, appointments, hotel check-ins, business engagements, or other onward commitments where the missed connection results from: traffic; road conditions; weather; road closures; flooding; landslides; checkpoints; Provider delay; mechanical circumstances; Force Majeure; insufficient Client buffer time; or another circumstance outside DPTT’s reasonable control.
41. Safety Overrides Schedule
Safety takes priority over strict adherence to a requested route, schedule, stop, or arrival time.
The Driver may reasonably: reduce speed; reroute; stop; delay departure; avoid a particular road; decline an unsafe stop; seek assistance; terminate a route that has become unsafe or unlawful; or take other reasonable safety measures.
42. Authority Directives
Transportation may be affected by: checkpoints; traffic enforcement; inspections; road closures; curfews; security restrictions; local government restrictions; emergency orders; or other lawful authority directives.
Such requirements may override the preferred route or schedule.
43. Mechanical Problems and Breakdowns
Unexpected mechanical problems may occur despite Provider maintenance efforts.
Where practicable, the Provider may attempt to: inspect or repair the Vehicle; send roadside assistance; provide a substitute Vehicle; transfer passengers to another suitable Vehicle; coordinate another Driver or Provider; change the route; or make another reasonable operational arrangement.
A reasonable replacement or continuation arrangement does not automatically create a refund entitlement.
44. Accidents and Road Incidents
In the event of an accident or material road incident, the Driver and Provider may take immediate steps reasonably necessary to: protect passengers; stop the Vehicle; contact authorities; seek medical assistance; move to a safe location where appropriate; preserve required information; coordinate replacement transportation; or otherwise respond to the incident.
45. Passenger Seatbelts
Passengers must use seatbelts where required by law or where available and reasonably required for safety.
Passengers should remain properly seated while the Vehicle is moving.
46. Child Safety
A parent, guardian, or responsible accompanying adult remains responsible for minors.
Where a child seat, booster seat, or other particular child-safety arrangement is legally required or important to the Client, the Client should request it before booking and obtain confirmation of availability.
The Client should not assume specialized child-safety equipment is automatically available in every Provider Vehicle.
47. Passenger Conduct
Passengers must behave safely and lawfully.
Passengers must not: distract the Driver; interfere with Vehicle operation; open doors unsafely; engage in violent or threatening conduct; harass the Driver or other passengers; damage the Vehicle intentionally; carry illegal substances or contraband; carry unsafe hazardous materials; pressure the Driver to violate traffic laws; or engage in other behavior creating a material safety or legal risk.
48. Intoxication and Unsafe Conduct
The Provider or Driver may refuse or terminate Service where a Passenger’s intoxication, disorderly behavior, aggression, or other conduct creates a reasonable safety or legal concern.
Refund consequences are governed by Provider rules and the Refund Policy.
49. Prohibited Requests
The Client may not require or pressure the Driver to: speed; drive recklessly; ignore traffic rules; overload the Vehicle; enter prohibited roads; evade checkpoints; transport prohibited items; park unlawfully; drive while unsafe to do so; or otherwise violate applicable law or reasonable safety rules.
50. Personal Belongings
The Client remains responsible for personal belongings unless the Provider expressly accepts custody under separate terms.
Clients should safeguard: cash; passports; identification; phones; cameras; medication; jewelry; electronics; travel documents; and other valuables.
Before leaving the Vehicle, passengers should check seats, floors, door pockets, and baggage compartments for personal property.
51. Damage Caused by Client or Passenger Conduct
Subject to Provider rules and applicable law, the Client may be responsible for damage caused by the Client or members of the Client’s group through: intentional conduct; recklessness; misuse of Vehicle equipment; unauthorized handling of Vehicle components; intentional staining or destruction; failure to follow reasonable instructions; or other wrongful acts.
52. Cleaning Charges
A Provider may impose reasonable cleaning charges where Client or passenger conduct results in cleaning needs materially beyond ordinary passenger use.
Examples may include: excessive food or beverage spillage; vomit requiring special cleaning; unauthorized substances; significant mud or contamination caused by avoidable conduct; excessive trash; or other extraordinary cleaning requirements.
53. Health and Fitness Considerations
Passengers should consider personal conditions that may affect comfort or safety during road travel.
Examples include: motion sickness; back or neck conditions; pregnancy; mobility limitations; recent surgery; long-distance travel tolerance; heat sensitivity; medication requirements; or other health considerations.
DPTT does not provide medical advice.
54. Personal Medication
Passengers are responsible for carrying necessary medication and personal medical supplies.
Medication that may be needed during the journey should remain reasonably accessible.
55. Emergency Response
In an accident, injury, medical emergency, Vehicle breakdown, security issue, or other serious incident, the Provider and Driver may take reasonable immediate action.
Emergency response can be affected by: location; traffic; weather; road conditions; mobile signal; availability of ambulances; availability of police or rescue personnel; availability of local medical facilities; and other conditions.
Clients should review the Traveler Emergency & Incident Response Guide.
56. Emergency Medical Assistance
Where reasonably necessary, the Provider or Driver may seek emergency medical assistance for a Passenger.
DPTT may assist with communication or coordination where reasonably possible.
The Client remains responsible for personal: medical expenses; hospital expenses; medication; emergency transportation; additional accommodation; and other personal emergency costs except to the extent another legally responsible party or applicable law provides otherwise.
57. Force Majeure
Vehicle-with-driver Services may be affected by circumstances beyond the reasonable control of DPTT or the Provider.
Examples include: typhoons; storms; earthquakes; flooding; landslides; fires; road closures; government restrictions; civil disturbances; security incidents; public-health restrictions; strikes; transport disruptions; utility failures; telecommunications failures; emergency directives; or other comparable events beyond reasonable control.
Refund, rescheduling, substitution, or credit consequences are governed by the Provider terms, Booking Confirmation, Refund Policy, and mandatory law.
58. Bookings Made Within Three Days Are Non-Refundable
A Car Rental (With Driver) booking first made within three (3) calendar days of the scheduled Service date is non-refundable from the time the booking is confirmed.
This applies subject to rights that applicable law does not permit the parties to waive or exclude.
Clients making short-notice bookings should ensure that their plans are final before payment.
59. Other Cancellation and Refund Rules
Other cancellations and refund requests are governed by: the Booking Cancellation, Rescheduling & Refund Policy; Provider cancellation rules; Vehicle reservation commitments; Driver allocation; amounts already committed; mobilization; payment-processing expenses; other non-recoverable costs; and applicable law.
60. Client No-Show
A Client may be treated as a no-show where the Client: fails to appear; cannot be contacted; fails to reach the confirmed pickup point; arrives beyond the applicable waiting period; provides materially incorrect pickup information that results in a missed Service; refuses to proceed after reasonable Provider mobilization without a qualifying basis; or otherwise fails to use an available confirmed Service.
No-shows are generally non-refundable under the Refund Policy and applicable Provider rules.
61. Late Arrival
Late Client arrival may result in: waiting-time charges; reduced available rental time; overtime charges; schedule changes; Provider reassignment; missed transportation; or no-show treatment where the Provider cannot reasonably continue waiting.
62. Client-Requested Changes
Changes requested after confirmation may result in revised pricing.
Examples include: changing the date; changing pickup time; changing pickup location; changing destination; adding passengers; adding baggage; requiring a larger Vehicle; adding stops; extending the rental period; adding mileage; changing the itinerary; or changing the nature of the booked Service.
63. Land Tours Using a Vehicle With Driver
Where the Vehicle-with-driver arrangement includes a land-tour itinerary involving multiple tourism destinations or attractions, the availability and sequence of stops remain subject to: weather; traffic; road conditions; opening hours; site closures; government restrictions; local events; safety; Provider operational decisions; and time limitations.
64. No Prorated Refund for Skipped Land-Tour Destinations
No prorated or proportional refund is due merely because a destination, attraction, stop, route, or itinerary component on a land tour is skipped, shortened, reordered, replaced, or made unavailable because of:safety considerations;weather;road conditions;traffic;flooding or landslides;government or authority directives;site closures;environmental restrictions;mechanical circumstances;emergency conditions; or the Provider/driver’s reasonable operational or safety discretion.
The Client acknowledges that Vehicle-with-driver and land-tour pricing generally covers overall Vehicle use, Driver time, transportation, mobilization, coordination, and associated Service delivery rather than a separate refundable amount allocated to every individual stop.
65. Claims Relating to Provider or Driver Operations
Where a claim principally concerns matters controlled by the Provider or Driver, the responsible Provider may be required to investigate and respond under its procedures and applicable law.
This may include claims involving: Driver conduct; Vehicle operation; Vehicle maintenance; Vehicle condition; road incidents; route decisions; Provider delays; waiting-time disputes; overtime disputes; baggage handling; Provider cancellation; or other Provider-controlled matters.
66. DPTT Assistance With Provider Concerns
DPTT may, where reasonably appropriate: relay Client concerns; forward documentation; provide Agency-held booking records; request Provider clarification; communicate Provider responses; or help identify available Provider remedies.
Such assistance does not constitute an admission of Agency liability and does not guarantee compensation, refund, insurance payment, replacement Vehicle, Provider admission, or another requested outcome.
67. Limitation Relating to Independent Provider Conduct
To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, death, property damage, theft, delay, missed connections, additional expenses, cancellation, service interruption, or other losses caused by the independent acts, omissions, operational decisions, negligence, misconduct, or non-performance of the Provider, Driver, another road user, or unrelated third party where the matter is outside DPTT’s reasonable control.
This provision does not exclude any responsibility applicable law places directly and non-waivably upon DPTT.
68. Client Indemnification
To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, agents, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Client’s: illegal conduct; fraud; intentional misconduct; unsafe passenger behavior; material interference with Vehicle operation; damage caused by the Client or members of the Client’s group; possession of prohibited items; material breach of these Terms; violation of applicable law; or violation of another person’s lawful rights.
This clause does not require the Client to indemnify DPTT for a responsibility applicable law places directly and non-waivably upon the Agency.
69. Personal Travel Insurance
Clients are encouraged to consider appropriate personal travel insurance based on their itinerary and circumstances.
Depending on individual needs, coverage may include: medical expenses; accident coverage; trip interruption; trip cancellation; baggage; missed connections; emergency transportation; and other appropriate travel risks.
70. Provider Insurance
If a Provider states that insurance exists, such insurance may be subject to: coverage limitations; policy exclusions; deductibles; Vehicle restrictions; Driver requirements; passenger eligibility; reporting deadlines; documentation requirements; and insurer determination.
DPTT does not guarantee the scope, adequacy, continuing validity, or claim outcome of independent Provider insurance unless expressly verified and confirmed in writing.
71. Privacy and Booking Information
DPTT may collect, use, retain, and share personal information reasonably necessary for: booking; pickup coordination; Provider coordination; payment verification; identification where required; safety; incident documentation; refunds; claims; chargebacks; disputes; and other purposes described in the Privacy & Personal Data Policy.
72. Electronic Communications and Evidence
Booking confirmations, messages, location pins, screenshots, payment records, photographs, videos, receipts, Provider communications, and other records exchanged or retained through Official Channels may be used to document: the booking; acceptance; pickup details; itinerary; changes; waiting time; overtime; payments; cancellations; incidents; damage; claims; refunds; chargebacks; and disputes.
73. Controlling DPTT Liability Provision
These Car Rental (With Driver) Terms do not establish a competing numerical liability cap.
Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, the controlling liability provisions are contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
If a competent court determines D’Palawan Travel and Tours itself to be primarily liable, DPTT’s maximum aggregate monetary liability is limited, to the fullest extent permitted by applicable law, to two (2) times the Cash Received by DPTT from the Client for the specific booking or transaction giving rise to the claim.
The definition and calculation of Cash Received, aggregation of claims arising from the same transaction or occurrence, and other conditions governing the cap are contained in the controlling Waiver and Liability Disclaimer.
74. Consequential, Missed-Income, and Opportunity Losses
To the fullest extent permitted by applicable law, DPTT shall not be liable for consequential, indirect, incidental, special, exemplary, or punitive losses.
This expressly includes, where legally excludable: missed income;lost wages;lost earnings;lost profits;lost business;lost opportunities;opportunity costs;business interruption;missed work;missed appointments;missed flights or ferries;missed onward bookings;additional personal travel expenses; and similar consequential economic losses.
The full controlling provision appears in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
75. Agency Interpretation and Clarification
These Terms form part of DPTT’s broader legal, booking, safety, and operational framework.
If an Agency provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must request clarification before payment or participation where the matter is material to the booking.
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, rules, and terms, including determining which DPTT provision applies to a particular booking or circumstance.
This right does not authorize DPTT to override mandatory provisions of applicable Philippine law.
76. Direct Resolution of Complaints and Disputes
If a Client has a complaint, claim, disagreement, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to DPTT through an Official Channel.
The Client should provide reasonably available information such as: Booking Confirmation; payment records; messages; pickup details; route or itinerary information; Vehicle or Driver information; photographs; videos; Provider communications; incident reports; medical documents where relevant; and other reasonably relevant evidence.
The Client and DPTT shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.
77. Governing Law and Exclusive Venue
These Terms and disputes arising from or relating to the Vehicle-with-driver Service, booking, transaction, communication, or Agency policy are governed by the laws of the Republic of the Philippines.
If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.
The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.
78. Consumer Protection and Non-Waivable Rights
Nothing in these Terms is intended to unlawfully waive, exclude, limit, or restrict a right, legal responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.
If any provision exceeds what applicable law permits, the provision shall apply only to the maximum lawful extent while the remainder continues in effect.
79. Severability
If a competent authority determines that a provision of these Terms is invalid, unlawful, or unenforceable, the provision shall be limited or separated only to the extent necessary.
The remaining provisions shall continue to operate to the fullest extent permitted by law.
80. No Waiver by Exception or Non-Enforcement
If DPTT or a Provider grants a goodwill: refund; credit; rescheduling arrangement; Vehicle upgrade; additional waiting time; overtime concession; route accommodation; alternative Vehicle; or other accommodation in a particular case, that accommodation does not automatically amend these Terms, create a precedent, or apply to another booking.
81. Updates to These Terms
D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; Vehicle options; booking processes; transportation practices; payment systems; technology; safety procedures; government requirements; road or travel conditions; or other relevant circumstances.
The current version will be published at:

Advance bookings must be reconfirmed on the day before the scheduled Service. Bookings first made within three calendar days of the Service are non-refundable. Where the Vehicle-with-driver arrangement forms part of a land tour, no prorated refund is due merely because a destination or stop is skipped or modified because of safety, weather, road conditions, government directives, or reasonable Provider/Driver operational discretion. Where DPTT itself is determined primarily liable by a competent court, the controlling liability limitation is contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer. If anything is unclear, obtain clarification before payment. If you disagree with an applicable provision, do not proceed with the Service.
