Depending on local usage, Services of this nature may sometimes be described as: motorbike with driver; motorbike with rider; backride transportation; habal-habal; motorbike passenger transport; or similar locally used descriptions.
Use of any descriptive term does not alter applicable legal, licensing, safety, Provider, or government requirements.
These Terms are intended to clearly explain: DPTT’s travel coordination and booking role; the operational responsibility of the independent Motorbike Provider and Driver/Rider; the heightened risks associated with two-wheel passenger transportation; helmet and Passenger safety requirements; booking and payment rules; pickup, route, waiting-time, and itinerary conditions; weather, road, and remote-area risks; Passenger conduct and responsibilities; accident and emergency procedures; cancellation and refund rules; Provider-related claims; and the applicable DPTT liability framework.
Please read these Terms carefully before making payment or riding as a Passenger.Booking, reserving, paying for, confirming, accepting pickup, mounting, riding as a Passenger, participating in, receiving, using, or otherwise availing a Motorbike Rental (With Driver) Service through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms together with all applicable Agency policies, procedures, company processes, Provider requirements, Driver/Rider instructions, safety requirements, and regulations.
If anything is unclear, contact D’Palawan Travel and Tours before making payment.
If you disagree with an applicable provision, do not proceed with the booking or Service.

2. Scope of These Terms
These Terms apply to Motorbike-with-Driver Services including: short-distance passenger transportation; point-to-point local transfers; hotel, resort, port, terminal, or accommodation transfers; inter-area transportation where appropriate; hourly Motorbike-with-Driver arrangements; daily hire where offered; multi-stop local itineraries; transport between tourism locations; remote or rural-area transportation; Motorbike-with-Driver components included in tours or travel packages; pickup and drop-off coordination; route changes and safety-related diversions; and other comparable two-wheel Passenger Services.
3. Motorbike With Driver Distinguished From Self-Drive Rental
These Terms apply where the Client rides as a Passenger and the Provider supplies the Driver/Rider.
Where the Client personally takes possession of and operates the Motorbike, the separate Self-Drive Motorbike Rental: Terms and Conditions apply instead.
4. Application to Tours and Travel Packages
Where a Motorbike-with-Driver Service forms part of a day tour, travel package, accommodation arrangement, custom itinerary, or other travel Service, these Terms apply together with: the Travel Booking & Service Terms and Conditions; the Tours, Travel Packages, and Service Waiver and Liability Disclaimer; the Booking Cancellation, Rescheduling & Refund Policy; the Booking Confirmation; Provider requirements; and other applicable DPTT policies.
5. D’Palawan Travel and Tours’ Role
D’Palawan Travel and Tours operates as a travel coordination and booking agency.
DPTT may assist with: identifying available Motorbike transportation options; checking availability; requesting quotations; coordinating reservations; communicating pickup and drop-off information; communicating Passenger requirements; coordinating payment arrangements; relaying Provider or Driver information; communicating meeting-point changes; relaying schedule or route updates; communicating Passenger concerns; and providing reasonable booking support.
The actual Motorbike transportation Service is performed by the independent Provider and Driver/Rider responsible for the booking.
6. Provider Operational Responsibility
The Provider generally manages operational aspects of the Service.
Depending on the arrangement, these may include: Motorbike assignment; Driver/Rider assignment; Motorbike maintenance; roadworthiness; Driver qualifications; Provider-side licenses and documentation; helmet availability; Passenger capacity; baggage limitations; route selection; speed and riding decisions; waiting-time rules; stop rules; fuel; weather and road-condition assessment; operational safety decisions; emergency procedures; and other day-to-day transportation matters.
DPTT’s booking or coordination activity does not transfer day-to-day operational management of the Motorbike, Driver/Rider, Provider personnel, maintenance, or riding decisions to the Agency.
7. Independent Provider Relationship
Providers generally maintain their own Motorbikes, Drivers/Riders, personnel, operating procedures, maintenance arrangements, insurance arrangements, registrations, policies, and legal responsibilities.
A booking, commission, referral, coordination, or commercial relationship between DPTT and a Provider does not by itself create: employment; partnership; joint venture; common ownership; common fleet management; or common operational control.
8. Limited-Availability and Remote-Area Arrangements
Some remote locations may have limited transportation availability.
Where appropriate and lawful, DPTT may assist the Client in identifying an available independent Motorbike owner or Driver/Rider in response to a Client-requested route.
If a particular requirement is material to the Client’s decision, it should be clarified before payment.
This may include: Driver qualification; Motorbike type; Motorbike registration; helmet availability; insurance; Passenger capacity; baggage capacity; route experience; or other relevant Provider characteristics.
9. Booking Is Not Confirmed Until Acknowledged
An inquiry, quotation, availability request, proposed route, or preliminary discussion does not by itself guarantee a confirmed Service.
A booking becomes confirmed when:
- DPTT or the applicable Provider acknowledges that the reservation has been accepted; and
- any required deposit, payment, Passenger information, or other confirmation requirement has been satisfied and verified.
Before confirmation, Provider, Driver/Rider, Motorbike, price, pickup time, route, and availability remain subject to change.
10. Acceptance of These Terms
The Client accepts these Terms by: making a reservation; paying a deposit; making partial or full payment; accepting the Booking Confirmation; replying “Confirmed,” “Yes,” “Agree,” or similar language; accepting pickup; mounting the Motorbike; riding as a Passenger; requesting additional stops or route changes; or otherwise availing the Service.
11. Day-Before Reconfirmation Is Required
Clients with advance Motorbike Rental (With Driver) bookings must contact D’Palawan Travel and Tours on the day before the scheduled Service to ensure that the booking has been properly acknowledged and to obtain the latest available operational information.
The Client should verify, as applicable: booking name; Service date; pickup location; pickup time or window; destination or route; Passenger count; baggage; Provider information where available; Driver/Rider information where available; helmet arrangements; contact number; weather or road-condition updates; and other operational instructions.
12. Latest Confirmed Instructions Control
The Client should rely on the most recent confirmed operational instructions rather than solely on: an earlier quotation; an old screenshot; a preliminary route; an outdated pickup time; a previous location pin; a promotional page; or an earlier travel-time estimate.
13. Accurate Pickup and Destination Information
The Client is responsible for providing accurate pickup and destination information.
This may include: hotel or resort; barangay; port or terminal; landmark; business establishment; location pin; contact person; destination name; and other practical information necessary for coordination.
14. Pickup or Drop-Off Points May Change
A meeting, pickup, or drop-off point may reasonably change because of: road restrictions; traffic; construction; flooding; road closures; security restrictions; parking or stopping restrictions; Motorbike-access limitations; weather; authority directives; or other legitimate operational reasons.
The Client agrees to reasonably cooperate with updated instructions communicated through Official Channels.
15. Motorbike Passenger Travel Is a Higher-Risk Form of Road Transportation
The Client acknowledges that riding as a Passenger on a Motorbike involves materially greater exposure to bodily injury than traveling inside an enclosed passenger Vehicle.
A Motorbike offers limited physical protection in the event of: a collision; fall; skid; loss of balance; sudden braking; impact with another road user; or another road incident.
Even a relatively low-speed incident may result in serious injury.
16. Road and Collision Risks
Motorbike Passenger transportation may involve risks including: collisions with cars, vans, trucks, buses, or other motorcycles; pedestrian incidents; animal crossings; road debris; rear-end collisions; side impacts; unsafe overtaking by other road users; sudden braking; unexpected Vehicle movements; road-rage incidents; reckless driving by third parties; impaired driving by other motorists; door-opening hazards; traffic congestion; and other road-user risks.
17. Loss-of-Balance and Traction Risks
Two-wheel travel may involve: skidding; sliding; tipping; wobbling; fishtailing; loss of traction; loss of balance; sharp avoidance maneuvers; and sudden changes in Vehicle stability.
Risk may increase on: wet roads; sand; gravel; mud; oil or slippery surfaces; loose stones; potholes; uneven pavement; steep inclines; steep descents; unpaved roads; and construction areas.
18. Passenger-Specific Risks
A Passenger’s position and movement can affect Motorbike stability.
Passenger-specific risks include: falling while mounting; falling while dismounting; unexpected movement affecting balance; inadequate grip; incorrect foot placement; contact with hot Motorbike components; clothing or straps contacting moving parts; injury during sudden acceleration; injury during sudden braking; being thrown from the Motorbike during impact; and loss of balance at very low speed or while stopped.
19. Helmet Use Is a Critical Safety Requirement
The Client must wear an appropriate helmet throughout the ride whenever required by law, Provider requirements, or reasonable safety practice.
If a helmet is supplied, the Passenger should check that it: fits reasonably securely; can be properly fastened; does not have an obvious material defect; and is appropriate for use.
If a required helmet is unavailable or obviously unsuitable, the Client should not proceed with the ride until the issue is resolved.
20. Protective Clothing and Footwear
Clients are encouraged to wear clothing appropriate for Motorbike travel.
This may include: closed footwear; long trousers; clothing that protects exposed skin; rain protection where appropriate; and other practical protective clothing.
21. Secure Loose Clothing, Bags, and Straps
The Client must take reasonable precautions to prevent: loose clothing; bag straps; camera straps; scarves; cords; shoelaces; plastic bags; or other loose items from contacting the wheels, chain, sprockets, exhaust, or other moving or hot Motorbike components.
22. Safe Mounting and Dismounting
The Client should mount and dismount only when the Motorbike is: stopped; reasonably stable; positioned in a safe location; and ready according to the Driver/Rider’s instruction.
Additional care should be used on: slopes; wet surfaces; sand; gravel; mud; uneven shoulders; or busy roadsides.
23. Passenger Position and Balance
During travel, the Passenger should: remain properly seated; keep feet on Passenger footrests where provided; maintain a secure hold or stable position; avoid sudden unnecessary movements; avoid leaning unpredictably; avoid interfering with the Driver/Rider; follow reasonable Driver/Rider instructions; and remain attentive to the ride.
24. Do Not Distract the Driver/Rider
The Passenger must not materially interfere with safe Motorbike operation.
This includes avoiding: unexpected physical movement; grabbing Vehicle controls; covering the Driver/Rider’s vision; intentionally startling the Driver/Rider; unsafe photography while moving; arguments or conduct materially distracting the Driver/Rider; and other interference with Motorbike control.
25. Baggage and Personal Items
Motorbikes have materially less baggage capacity than cars or vans.
The Client must disclose unusually large, heavy, awkward, or numerous items before booking.
The Provider or Driver/Rider may reasonably: limit baggage; refuse unsafe baggage; require a different transport arrangement; require baggage to be transported separately; or decline the Service where the load cannot be carried safely.
26. Passenger and Load Limits
The Client must comply with lawful and Provider-imposed Passenger and load limitations.
The Client must not pressure the Driver/Rider to: overload the Motorbike; carry more passengers than permitted; carry unsafe luggage; carry unstable loads; or operate contrary to reasonable safety requirements.
27. Client Fitness to Ride
The Client is responsible for considering whether Motorbike Passenger transportation is reasonably suitable for the Client’s physical and medical circumstances.
Relevant considerations may include: pregnancy; advanced age; mobility limitations; balance difficulties; serious cardiovascular conditions; respiratory conditions; recent surgery; existing back or neck injuries; severe anxiety concerning Motorbike travel; heat sensitivity; severe motion sensitivity; or other conditions that may increase risk.
28. Consider Alternative Transportation Where Appropriate
Clients who are uncomfortable with Motorbike travel or whose personal circumstances make Motorbike Passenger transportation unsuitable should consider an alternative such as a car, van, or other appropriate transportation option where available.
DPTT may assist with identifying alternative transportation where reasonably available, subject to a separate booking and applicable charges.
29. Children and Minors
Transportation of minors is subject to: applicable law; Provider rules; Motorbike capacity; appropriate helmet availability; the child’s ability to ride safely; and other relevant safety considerations.
A parent, guardian, or responsible adult must not assume that Motorbike transportation is suitable for a child merely because a Service is locally available.
Where the suitability of a minor Passenger is uncertain, a safer alternative form of transport should be considered.
30. No Riding While Intoxicated or Materially Impaired
A Client should not ride as a Passenger while so intoxicated or impaired that the Client cannot: sit securely; maintain reasonable balance; follow safety instructions; mount or dismount safely; or avoid materially interfering with Motorbike operation.
The Provider or Driver/Rider may refuse Service where Passenger impairment creates a reasonable safety concern.
31. Driver/Rider May Refuse Unsafe Requests
The Driver/Rider may reasonably refuse a Client request involving: speeding; reckless riding; overloading; unsafe baggage; prohibited routes; hazardous terrain; flooded roads; illegal activity; traffic-law violations; unsafe stop locations; or another unreasonable safety risk.
A Client preference does not override the Driver/Rider’s reasonable safety judgment or lawful Provider requirements.
32. Weather Conditions
Motorbike Services are particularly sensitive to weather.
Conditions that may affect the ride include: rain; heavy rain; strong wind; poor visibility; wet roads; flooding; storms; fallen branches or debris; mud; slippery surfaces; and other weather-related hazards.
33. Weather-Related Delay or Suspension
The Driver/Rider or Provider may reasonably: delay departure; reduce speed; change route; seek shelter; pause the journey; change a meeting point; return early; or cancel the ride where weather or road conditions create a material safety concern.
34. Wet Roads and Reduced Traction
Rain may significantly increase the risks of Motorbike travel because it may: reduce tire grip; increase braking distance; hide potholes; create standing water; make painted road surfaces slippery; make sand, mud, leaves, or gravel more hazardous; and reduce visibility for the Driver/Rider and other road users.
35. Flooding and Unsafe Roads
The Driver/Rider may refuse to enter or continue through a road affected by: floodwater; strong water flow; landslides; falling debris; deep mud; major road damage; unsafe bridges; construction; closures; or other material hazards.
36. Remote-Area Travel
Remote-area Motorbike transportation may involve: unpaved roads; gravel; sand; mud; steep roads; narrow roads; limited lighting; weak mobile signal; limited fuel availability; limited repair facilities; limited emergency services; long distances from clinics or hospitals; and other rural-road conditions.
37. Night Travel
Night Motorbike travel may involve additional risks because of: reduced visibility; limited street lighting; unmarked hazards; animals; pedestrians; road debris; headlight limitations; weather; Driver/Rider fatigue; and reduced availability of emergency or repair Services.
38. Route Selection
The Provider or Driver/Rider generally determines the practical route according to: road conditions; traffic; weather; safety; road restrictions; checkpoints; local knowledge; destination access; Motorbike suitability; and other operational considerations.
39. Route Changes and Detours
The Driver/Rider may reasonably change the planned route because of: traffic; road closures; construction; accidents; flooding; landslides; checkpoints; government instructions; security concerns; weather; unsafe road conditions; or other legitimate operational reasons.
A reasonable route change does not automatically create a refund entitlement.
40. Travel-Time Estimates
Travel-time estimates are provided for planning and are not guaranteed arrival times.
Actual journey time may vary because of: traffic; weather; road conditions; Driver/Rider safety decisions; roadworks; checkpoints; accidents; local events; route changes; breakdowns; or other circumstances.
41. Important Connections
Where a Motorbike-with-Driver Service connects with a flight, ferry, appointment, tour, or other important fixed commitment, the Client should provide substantial additional travel time and should not rely solely on an optimistic travel estimate.
Road, weather, Provider, and authority conditions may change unexpectedly.
42. Missed Connections
To the fullest extent permitted by law, DPTT shall not be responsible for a missed flight, ferry, tour, accommodation check-in, appointment, event, or other onward commitment where the missed connection results from: traffic; weather; road conditions; road closure; flooding; landslides; checkpoint delays; Provider delay; mechanical circumstances; Force Majeure; insufficient Client planning time; or another circumstance outside DPTT’s reasonable control.
43. Waiting Time
Waiting-time allowances, where applicable, are determined by the Provider and booking arrangement.
Additional waiting charges may apply where the Client: is not ready at the confirmed time; requests the Driver/Rider to remain available; extends a stop; changes plans; requests additional errands or destinations; or otherwise requires substantially more Driver/Rider time than originally booked.
44. Additional Stops or Route Extensions
Client-requested additions after confirmation are subject to Provider approval.
They may result in additional charges because of: extra distance; additional Driver/Rider time; additional fuel; waiting time; different route requirements; or other additional operational costs.
45. Driver/Rider Substitution
The Provider may reasonably substitute the originally anticipated Driver/Rider because of: availability; illness; scheduling; route assignment; emergency circumstances; or other legitimate operational reasons.
A reasonable Driver/Rider substitution does not automatically constitute cancellation.
46. Motorbike Substitution
The Provider may reasonably substitute the anticipated Motorbike because of: maintenance; mechanical concerns; availability; route conditions; safety; regulatory requirements; or other legitimate operational reasons.
A reasonable substitute capable of performing the essential Service does not automatically create a refund entitlement.
47. Provider Substitution
If the originally anticipated Provider becomes unavailable, DPTT or the Provider may coordinate a reasonable alternative independent Provider where practicable.
A reasonable Provider substitution preserving the essential transportation Service does not automatically create a refund entitlement.
48. Mechanical Problems
A Motorbike may occasionally experience an unexpected mechanical issue.
Where practicable, the Provider may attempt to: inspect the Motorbike; repair the Motorbike; send assistance; provide another Motorbike; provide another Driver/Rider; coordinate another Provider; or make another reasonable transportation arrangement.
A reasonable replacement or continuation arrangement does not automatically create a refund entitlement.
49. Passenger Belongings
The Client remains responsible for personal belongings unless the Provider expressly accepts custody under separate terms.
Motorbike travel may expose belongings to: rain; dust; mud; vibration; wind; heat; sudden movement; loss during transit; and other road conditions.
The Client should secure: phones; cameras; passports; cash; identification; medication; bags; electronic devices; and other valuables.
50. Prohibited Items
The Client must not require or request the Driver/Rider to transport: illegal drugs; contraband; explosives; unsafe flammable materials; dangerous chemicals; unauthorized weapons; or other property prohibited by law or reasonable Provider safety rules.
51. Authority Requirements and Checkpoints
The Client must reasonably cooperate with lawful: traffic checkpoints; identification checks; security procedures; helmet requirements; road restrictions; traffic-control measures; local ordinances; and other competent authority requirements.
Compliance with authority procedures may delay travel.
52. Safety Takes Priority Over Schedule
Safety takes priority over the Client’s preferred speed, route, departure time, arrival time, stop, or itinerary.
The Driver/Rider may reasonably: slow down; reroute; stop; seek shelter; delay departure; avoid a particular road; decline an unsafe destination; terminate a dangerous route; or take other reasonable safety measures.
53. Client-Caused Termination of Service
The Provider or Driver/Rider may refuse, suspend, or terminate Service where the Client: refuses required helmet use; is materially intoxicated or impaired; behaves violently or abusively; repeatedly interferes with Motorbike control; insists upon unlawful or dangerous operation; carries prohibited items; refuses reasonable safety instructions; or otherwise creates a material safety or legal risk.
Refund eligibility in such circumstances is governed by Provider rules and the Refund Policy.
54. Bookings Made Within Three Days Are Non-Refundable
A Motorbike Rental (With Driver) booking first made within three (3) calendar days of the scheduled Service date is non-refundable from the time the booking is confirmed.
This applies subject to rights that applicable law does not permit the parties to waive or exclude.
Clients making short-notice bookings should ensure that their plans are final before payment.
55. Other Cancellation and Refund Rules
Other cancellation and refund requests are governed by: the Booking Cancellation, Rescheduling & Refund Policy; Provider cancellation rules; Driver/Rider reservation commitments; mobilization; non-refundable Provider amounts; payment-processing costs; booking-specific conditions; and applicable law.
56. Late Arrival and No-Show
A Client may be treated as a no-show where the Client: fails to appear; cannot be contacted; fails to reach the confirmed pickup point; arrives beyond the applicable waiting period; provides materially incorrect pickup information resulting in a missed Service; refuses to proceed after reasonable Provider mobilization without a qualifying basis; or otherwise fails to use an available confirmed Service.
No-shows are generally non-refundable under the Refund Policy and applicable Provider rules.
57. Land-Tour Components
Where the Motorbike-with-Driver arrangement forms part of a land-tour itinerary, the availability and sequence of destinations may be affected by: weather; road conditions; traffic; site opening hours; closures; government restrictions; safety; local events; Driver/Rider operational decisions; and other legitimate circumstances.
58. No Prorated Refund for Skipped Land-Tour Destinations
No prorated or proportional refund is due merely because a destination, attraction, stop, route, or itinerary component on a land tour is skipped, shortened, reordered, replaced, or made unavailable because of:safety considerations;weather;road conditions;traffic;flooding or landslides;government or authority directives;site closures;environmental restrictions;mechanical circumstances;emergency conditions; or the Provider/Driver/Rider’s reasonable operational or safety discretion.
The Client acknowledges that Service pricing generally reflects overall transportation, Driver/Rider time, fuel, coordination, mobilization, and Service delivery rather than a separately refundable price assigned to every individual stop.
59. Package-Level Land and Sea Destination Rule
Where the Motorbike-with-Driver Service forms part of a broader tour or travel package containing land and/or sea components, no prorated refund is due merely because another land or sea destination, attraction, route, or activity is skipped or modified because of safety, weather, sea or road conditions, authority directives, environmental restrictions, or reasonable Provider/operator discretion.
60. Force Majeure
The Service may be affected by circumstances beyond the reasonable control of DPTT or the Provider.
Examples include: typhoons; storms; earthquakes; flooding; landslides; fires; road closures; government actions; civil disturbances; security incidents; public-health restrictions; infrastructure failures; telecommunications failures; emergency directives; or other comparable events beyond reasonable control.
Refund, rescheduling, substitution, or credit consequences are governed by Provider rules, the Booking Confirmation, Refund Policy, and mandatory law.
61. Health-Related Risks
Motorbike Passenger travel may expose the Client to: heat; dehydration; sun exposure; dust; rain; asthma triggers; fatigue; motion-related discomfort; anxiety or panic; aggravation of prior injuries; and other travel-related physical stress.
62. Personal Medication
The Client is responsible for carrying necessary medication and personal medical supplies.
DPTT does not provide medical clearance or medical advice regarding suitability for Motorbike Passenger travel.
63. Emergency Response
In an accident, injury, medical emergency, mechanical problem, security incident, or other serious event, the Provider and Driver/Rider may take reasonable immediate action.
Emergency response may be affected by: location; traffic; weather; road conditions; mobile signal; ambulance availability; police or rescue availability; local clinics or hospitals; time of day; and other circumstances.
Clients should review the Traveler Emergency & Incident Response Guide.
64. Emergency Medical Assistance
Where reasonably necessary, the Provider or Driver/Rider may seek medical or emergency assistance for the Client.
DPTT may assist with communication or coordination where reasonably possible.
The Client remains responsible for personal: medical expenses; hospital expenses; medication; emergency transportation; additional accommodation; and other personal emergency costs except where another legally responsible party or applicable law provides otherwise.
65. Accident and Incident Reporting
A material accident, injury, property loss, dispute, or other serious incident should be reported promptly to the Provider and, where Agency coordination assistance is requested, to DPTT.
Where reasonably possible, the Client should preserve: photographs; videos; Driver/Rider information; Motorbike information; witness information; police or barangay reports where applicable; medical documents; receipts; messages; Booking Confirmations; and other relevant evidence.
66. Claims Relating to Provider or Driver/Rider Operations
Where a claim principally concerns matters controlled by the Provider or Driver/Rider, the responsible Provider may be required to investigate and respond under its procedures and applicable law.
Examples include: Driver/Rider conduct; Motorbike operation; speed or riding decisions; Motorbike condition; maintenance; helmet provision; route decisions; Provider delay; Provider cancellation; operational safety procedures; or other Provider-controlled matters.
67. DPTT Assistance With Provider Concerns
DPTT may, where reasonably appropriate: relay Client concerns; provide Agency-held booking records; forward documentation; request Provider clarification; communicate Provider responses; or assist with identifying available Provider procedures.
Such assistance does not constitute an admission of Agency liability and does not guarantee compensation, refund, Provider admission, insurance payment, replacement transportation, or another requested outcome.
68. Assumption of Ordinary and Inherent Motorbike Risks
To the fullest extent permitted by applicable law, the Client voluntarily accepts the ordinary and inherent risks reasonably associated with riding as a Passenger on a Motorbike.
These include risks associated with: two-wheel balance; limited physical protection; road surfaces; weather; other road users; Passenger movement; mounting and dismounting; remote-area travel; and other inherent characteristics of Motorbike Passenger transportation.
This assumption of risk does not eliminate liability that applicable law makes non-waivable.
69. Release Concerning Independent Provider and Third-Party Matters
To the fullest extent permitted by applicable law, the Client releases and waives claims against DPTT and its owners, officers, employees, agents, and authorized representatives to the extent that a claim arises solely from: independent Provider acts or omissions; Driver/Rider acts or omissions; Motorbike operation; Provider-controlled maintenance; Provider-controlled safety equipment; acts of unrelated road users; acts of pedestrians or other third parties; natural conditions; weather; government restrictions; Force Majeure; or other circumstances outside DPTT’s reasonable control.
This release does not apply to liability that applicable law does not permit to be waived.
70. Client Indemnification
To the fullest extent permitted by applicable law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, agents, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Client’s: illegal conduct; fraud; intentional misconduct; unsafe Passenger behavior; material interference with Motorbike operation; damage intentionally caused by the Client; possession of prohibited items; material breach of these Terms; violation of applicable law; or violation of another person’s lawful rights.
This provision does not require the Client to indemnify DPTT for a legal responsibility applicable law places directly and non-waivably upon the Agency.
71. Personal Travel and Accident Insurance
Clients are encouraged to consider appropriate personal insurance according to their itinerary and risk profile.
Depending on individual needs, coverage may include: medical expenses; accident coverage; emergency transportation; trip cancellation; trip interruption; personal belongings; Motorbike Passenger travel; and other appropriate travel risks.
72. Provider Insurance
If a Provider states that insurance exists, such insurance may remain subject to: coverage limits; policy exclusions; deductibles; covered passengers; helmet requirements; Driver/Rider eligibility; route limitations; reporting deadlines; police-report requirements; documentation requirements; and insurer approval.
DPTT does not guarantee the existence, scope, adequacy, continuing validity, or claim outcome of independent Provider insurance unless expressly verified and confirmed in writing.
73. Privacy and Booking Information
DPTT may collect, use, retain, and share personal information reasonably necessary for: booking; pickup coordination; Provider coordination; identification where required; payment verification; safety; incident documentation; refunds; claims; chargebacks; disputes; and other purposes described in the Privacy & Personal Data Policy.
74. Electronic Communications and Evidence
Electronic records may be used to document the booking and Service.
Such records may include: Booking Confirmations; messages; emails; payment records; location pins; pickup details; Provider communications; Driver/Rider information; photographs; videos; incident reports; medical documents; refund requests; chargeback records; and other relevant documentation.
75. Controlling DPTT Liability Provision
These Motorbike Rental (With Driver) Terms do not establish a separate competing numerical liability cap.
Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, the controlling liability provisions are contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
If a competent court determines D’Palawan Travel and Tours itself to be primarily liable, DPTT’s maximum aggregate monetary liability is limited, to the fullest extent permitted by applicable law, to two (2) times the Cash Received by DPTT from the Client for the specific booking or transaction giving rise to the claim.
The definition and calculation of Cash Received, aggregation of related claims, and other conditions governing that limitation are contained in the controlling Waiver and Liability Disclaimer.
76. Consequential, Missed-Income, and Opportunity Losses
To the fullest extent permitted by applicable law, DPTT shall not be liable for consequential, indirect, incidental, special, exemplary, or punitive losses.
This expressly includes, where legally excludable: missed income;lost wages;lost earnings;lost profits;lost business;lost opportunities;opportunity costs;business interruption;missed work;missed appointments;missed flights or ferries;missed onward reservations;additional personal travel expenses; and similar consequential economic losses.
The complete controlling provision appears in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer.
77. Agency Interpretation and Clarification
These Terms form part of DPTT’s broader legal, booking, safety, operational, and policy framework.
If an Agency provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must request clarification before payment or participation where the matter is material to the booking.
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, rules, and terms, including determining which DPTT provision applies to a particular booking or circumstance.
This right does not authorize DPTT to override mandatory provisions of applicable Philippine law.
78. Direct Resolution of Complaints and Disputes
If a Client has a complaint, claim, disagreement, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to DPTT through an Official Channel.
The Client should provide reasonably available supporting information, including where relevant: Booking Confirmation; payment records; messages; pickup information; Provider information; Driver/Rider information; photographs; videos; incident reports; police or barangay records where applicable; medical documents; and other reasonably relevant evidence.
The Client and DPTT shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.
79. Governing Law and Exclusive Venue
These Terms and disputes arising from or relating to the Motorbike-with-Driver Service, booking, transaction, communication, or Agency policy are governed by the laws of the Republic of the Philippines.
If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.
The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.
80. Consumer Protection and Non-Waivable Rights
Nothing in these Terms is intended to unlawfully waive, exclude, limit, or restrict a right, responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.
If any provision exceeds what applicable law permits, the provision shall apply only to the maximum lawful extent while the remainder continues in effect.
81. Severability
If a competent authority determines that any provision of these Terms is invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.
The remaining provisions shall continue to operate to the fullest extent permitted by law.
82. No Waiver by Exception or Non-Enforcement
A goodwill refund, credit, rescheduling arrangement, additional waiting time, alternative Motorbike, alternative Driver/Rider, alternative Provider, or other concession granted in a particular case does not: amend these Terms generally; create a precedent; automatically apply to another booking; or waive an otherwise applicable Provider rule.
83. Updates to These Terms
D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; Motorbike options; booking procedures; transportation practices; payment systems; technology; safety practices; government requirements; road conditions; or other relevant circumstances.
The current version will be published at:
https://bookwithoutcreditcard.com/motorbikerentalterms-withdriver
Updates generally apply to future bookings and subsequent use while existing transactions remain subject to the terms and mandatory laws legally applicable to them.

📧 dpalawantravelandtours@gmail.comContact UsFinal Acceptance Notice: Booking, reserving, paying for, confirming, accepting pickup, mounting, riding as a Passenger, participating in, receiving, using, or otherwise availing a Motorbike Rental (With Driver) Service through D’Palawan Travel and Tours constitutes acceptance of these Terms and all applicable Agency terms, policies, procedures, company processes, Provider requirements, Driver/Rider safety instructions, and regulations. Advance bookings must be reconfirmed on the day before the scheduled Service. Bookings first made within three calendar days of the Service are non-refundable. Where the Service forms part of a land tour or broader travel package, no prorated refund is due merely because a destination, attraction, stop, route, or activity is skipped or modified because of safety, weather, road or sea conditions, government or authority directives, environmental restrictions, or reasonable Provider/operator discretion. Where DPTT itself is determined primarily liable by a competent court, the controlling liability limitation is contained in the Tours, Travel Packages, and Service Waiver and Liability Disclaimer. If anything is unclear, obtain clarification before payment. If you disagree with an applicable provision, do not proceed with the Service.
