These Airport Transfer Terms (“Terms”) apply to airport pickup, airport drop-off, and related land transportation Services coordinated, arranged, reserved, booked, scheduled, or otherwise assisted by D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).
Airport transfers may be performed using an appropriate car, van, SUV, MPV, AUV, pickup, tuk-tuk/tuktuk, or other suitable land vehicle assigned by the independent transportation Provider according to the particular booking, route, passenger count, baggage requirements, availability, and operational circumstances.
The page title “Airport Transfer Terms and Conditions (Car, Van & Tuk-Tuk)” is used as the primary service category, but these Terms also apply to an airport transfer performed by a tuk-tuk/tuktuk or another suitable land vehicle where that arrangement is expressly confirmed.
These Terms explain: the scope of airport-transfer Services; DPTT’s role as a travel coordination and booking agency; the responsibilities of independent transport Providers and drivers; arrival and departure transfer procedures; flight-information and communication requirements; airport meeting-point and terminal restrictions; waiting-time rules; passenger and baggage responsibilities; road and airport-access risks; delays, substitutions, cancellations, and refunds; missed-flight and missed-connection risks; emergency and incident procedures; and the allocation of responsibilities among the Client, DPTT, the Provider, airlines, airport authorities, and other relevant parties.
Please read these Terms before making payment.
Booking, reserving, paying for, confirming, participating in, accepting pickup, entering the assigned Vehicle, receiving, using, or otherwise availing an Airport Transfer through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms and all other applicable Agency policies, procedures, company processes, Provider requirements, safety instructions, and regulations.
If anything is unclear, contact D’Palawan Travel and Tours before making payment.
If you disagree with any applicable provision, do not proceed with the booking or Service.

2. Scope of Airport Transfer Services
These Terms apply to airport-related land transportation coordinated through DPTT, including: airport-to-hotel transfers; airport-to-resort transfers; airport-to-port transfers; airport-to-terminal transfers; airport-to-town transfers; airport-to-private accommodation transfers; airport-to-tourism-destination transfers; hotel-to-airport transfers; resort-to-airport transfers; port-to-airport transfers; terminal-to-airport transfers; town-to-airport transfers; private airport transfers; shared or joiner airport transfers where applicable; airport transfers included within travel packages; car transfers; van transfers; tuk-tuk/tuktuk airport transfers where appropriate and confirmed; and other comparable airport-related land transportation.
3. Airports and Airport-Related Areas
For purposes of these Terms, references to an “airport” may include: passenger terminals; arrival areas; departure areas; designated pickup zones; transport bays; parking areas; terminal access roads; airport-controlled roads; airport-adjacent meeting points; staging areas; and other locations reasonably used for airport passenger pickup or drop-off.
4. Tuk-Tuk / Tuktuk Airport Transfers
Where suitable to the airport, route, passenger count, baggage, local traffic requirements, and confirmed booking, an Airport Transfer may be performed using a tuk-tuk/tuktuk.
A tuk-tuk/tuktuk may be appropriate for certain: short-distance airport transfers; airport-to-town transfers; local accommodation transfers; airport-adjacent transportation; light-baggage transfers; or other local routes where such a Vehicle is practical.
Tuk-tuk/tuktuk suitability depends on factors including: distance; passenger count; baggage quantity; weather; road conditions; airport access rules; local transport regulations; Vehicle availability; and the Client’s particular requirements.
If a conventional enclosed car or van is essential to the Client, that requirement must be confirmed before payment.
5. Airport Transfers Included in Tours or Packages
These Terms also apply where an Airport Transfer is included as a component of: a tour package; a multi-day itinerary; an accommodation package; a transportation package; a tour-and-transfer arrangement; a rental arrangement; or another combined travel Service.
In such circumstances, these Airport Transfer Terms apply together with the applicable: Travel Booking & Service Terms and Conditions; Tours, Travel Packages, and Service Waiver and Liability Disclaimer; Booking Cancellation, Rescheduling & Refund Policy; Booking Confirmation; Provider terms; and other applicable Agency policies.
6. D’Palawan Travel and Tours’ Role
D’Palawan Travel and Tours operates as a travel coordination and booking agency.
DPTT may assist Clients with: checking transfer availability; requesting quotations; coordinating reservations; communicating flight details; communicating passenger counts; communicating baggage information; coordinating pickup and drop-off points; coordinating payment; relaying Provider or driver information; communicating terminal instructions; relaying flight-delay information received from the Client; communicating schedule or route changes; and providing reasonable booking assistance.
The actual transportation Service is performed by the independent Provider responsible for the booking.
7. Provider Operational Responsibility
The independent Provider performing the Airport Transfer generally controls operational matters within its transportation Service.
Depending on the booking, Provider responsibilities may include: Vehicle assignment; driver assignment; Vehicle condition; Vehicle maintenance; roadworthiness; fuel; driver scheduling; route selection; airport-access procedures; passenger capacity; baggage limits; waiting-time rules; parking arrangements; meeting-point implementation; driver safety procedures; mechanical response; Provider-side permits or documentation; and compliance with operational requirements applicable to the Provider.
DPTT’s booking and coordination functions do not transfer day-to-day operational management of the Provider’s Vehicle, driver, personnel, or transportation operations to the Agency.
8. Independent Provider Relationship
Transport Providers generally maintain their own: vehicles; drivers; maintenance arrangements; business operations; registrations; insurance arrangements; airport-access procedures; waiting-time rules; pricing; personnel arrangements; and legal responsibilities.
A booking, commission, referral, or coordination relationship between DPTT and an independent Provider does not by itself create common ownership, employment, partnership, joint venture, or common operational management.
9. Booking Is Not Confirmed Until Acknowledged
An inquiry, quotation, tentative schedule, availability check, or payment instruction does not by itself constitute a confirmed Airport Transfer.
A booking becomes confirmed when:
- DPTT or the applicable Provider acknowledges the transfer as confirmed; and
- any required payment, deposit, flight information, or other booking requirement has been completed and verified.
Before confirmation, price, Provider, driver, Vehicle, pickup arrangements, and availability remain subject to change.
10. Acceptance of These Terms
The Client accepts these Airport Transfer Terms by making a reservation, paying a deposit, making partial or full payment, confirming the transfer, requesting or accepting dispatch, entering the assigned Vehicle, participating in the transfer, or otherwise availing the Service.
Acceptance includes applicable: DPTT policies; company processes; Booking Confirmation terms; Provider requirements; airport rules; safety instructions; refund provisions; and government regulations.
11. Day-Before Reconfirmation Is Required
Clients with advance Airport Transfer bookings must contact D’Palawan Travel and Tours on the day before the scheduled transfer to ensure that the booking has been properly acknowledged and to obtain the latest available operational information.
This requirement applies to advance airport transfers by: car; van; tuk-tuk/tuktuk; and other applicable land Vehicles.
The Client should reconfirm, as applicable: full booking name; transfer date; pickup location; destination; flight number; airline; scheduled arrival or departure time; passenger count; reasonable baggage count; contact number; meeting point; Vehicle requirement where specifically agreed; and other important booking information.
12. Flight Information Must Be Accurate
Where flight information is relevant to the transfer, the Client is responsible for providing accurate: airline name; flight number; arrival or departure date; scheduled arrival time; scheduled departure time; terminal information where applicable; and other flight information reasonably needed for coordination.
DPTT shall not be responsible for consequences materially caused by incorrect, incomplete, outdated, or misleading flight information supplied by the Client.
13. Client Must Notify DPTT of Flight Changes
The Client must promptly advise DPTT through an Official Channel if a flight is: delayed; rescheduled; advanced; diverted; canceled; changed to another flight number; changed to another terminal; or otherwise materially changed.
DPTT may attempt to coordinate the change with the Provider, but adjustment remains subject to Provider availability, driver scheduling, waiting-time rules, and other existing bookings.
14. Flight Monitoring Does Not Replace Client Notification
If DPTT or a Provider independently checks publicly available flight information as a courtesy, such monitoring does not relieve the Client of the responsibility to communicate material flight changes.
Airline systems, airport boards, third-party flight trackers, and online information can be delayed, incomplete, or inconsistent.
The Client remains responsible for promptly communicating known changes affecting the Airport Transfer.
15. Arrival Transfers
For an Arrival Transfer, the Passenger should follow the latest confirmed instructions concerning: meeting point; terminal exit; transport bay; parking area; pickup lane; driver identification; Vehicle identification; contact procedure; and waiting-time requirements.
The Client should activate or monitor the available communication method as soon as reasonably practical after landing and completing airport procedures.
16. Arrival Processing Time
The Client acknowledges that actual pickup time after a flight lands may be affected by: aircraft disembarkation; immigration procedures; baggage claim; customs procedures; terminal congestion; airport security; baggage delays; lost-baggage processing; passenger mobility; mobile connectivity; and other airport procedures.
These factors may affect Provider waiting time and should be communicated where substantial delay occurs.
17. Departure Transfers
For a Departure Transfer, the Client must be ready at the confirmed pickup location at the agreed time.
The Client is responsible for planning sufficient time for: the road journey; traffic; airport entry; airline check-in; baggage drop; security screening; immigration where applicable; terminal walking time; boarding requirements; and other airline or airport procedures.
18. Airline Check-In and Boarding Requirements
Airline check-in, baggage-drop, security, boarding, documentation, and gate requirements are controlled by the applicable airline and airport authorities.
The Client is responsible for determining and complying with: recommended airport arrival time; check-in cutoff; baggage-drop cutoff; boarding-gate closure; passport requirements; visa requirements; identification requirements; travel-document requirements; baggage rules; and other airline conditions.
DPTT’s transportation coordination does not modify airline or airport deadlines.
19. Airport Meeting Points May Change
Airports may regulate or change pickup and drop-off arrangements.
A meeting point may need to change because of: curbside restrictions; no-waiting zones; no-parking zones; terminal congestion; airport traffic management; security restrictions; construction; special events; temporary road closures; transport-bay requirements; law-enforcement instructions; or other airport operational rules.
A reasonable meeting-point change required by airport rules or safety conditions does not constitute cancellation or breach of the Airport Transfer.
20. Airport No-Waiting and Parking Restrictions
Some airport areas do not permit drivers to remain indefinitely while waiting for passengers.
Airport or traffic authorities may require a driver to: move the Vehicle; circle back; wait in a staging area; use paid parking; use a designated transport bay; leave a restricted curb; change the pickup point; or follow another traffic-control instruction.
The Client agrees to cooperate with reasonable updated pickup instructions arising from these restrictions.
21. Waiting Time
Waiting-time allowances vary by Provider and Booking Confirmation.
Additional waiting charges or rescheduling may apply where: a flight is substantially delayed; baggage retrieval is substantially delayed; the Client does not communicate after arrival; the Client is not at the meeting point; the Client changes the pickup time; airport procedures substantially extend the wait; the Client asks the driver to remain beyond the included allowance; or another Client-related circumstance substantially extends Vehicle and driver time.
22. Flight Delay Does Not Automatically Guarantee Unlimited Waiting
A delayed flight does not automatically obligate the Provider or driver to wait indefinitely.
The Provider may have: another scheduled booking; driver working-hour restrictions; airport parking limitations; Vehicle scheduling commitments; distance-related constraints; other passengers; or other legitimate operational obligations.
DPTT may attempt to coordinate a revised pickup, substitute driver, alternative Vehicle, later transfer, or other available arrangement, but availability cannot be guaranteed.
23. Late Client Arrival at the Meeting Point
A Client may be considered late or a no-show where the Client: fails to appear at the confirmed meeting point; does not respond to reasonable contact attempts; goes to a different meeting point despite updated instructions; substantially exceeds the Provider’s waiting allowance without communication; or otherwise prevents the confirmed pickup from being completed.
Late-arrival and no-show consequences are governed by Provider rules and the Booking Cancellation, Rescheduling & Refund Policy.
24. Pickup Information Must Be Accurate
The Client is responsible for providing accurate pickup information.
This may include: hotel or resort name; street or barangay; port; terminal; landmark; airport terminal; meeting point; contact person; location pin; or other practical location details.
Additional costs or delays materially caused by inaccurate information supplied by the Client may be chargeable to the Client where permitted by the booking terms.
25. Baggage Information
The Client should provide a reasonable estimate of baggage before booking, particularly where the group carries: large suitcases; multiple suitcases; oversized baggage; sports equipment; diving equipment; bicycles; surfboards; large boxes; mobility equipment; strollers; or other unusually large items.
26. Baggage Capacity
A Vehicle that accommodates a particular number of passengers may not necessarily accommodate the same number of passengers together with substantial luggage.
Baggage requirements may therefore affect: Vehicle size; Vehicle type; number of Vehicles required; pricing; passenger capacity; and availability.
27. Excess or Undisclosed Baggage
If the Client arrives with baggage materially exceeding what was disclosed, the Provider may require: a larger Vehicle; an additional Vehicle; rearrangement of transportation; additional charges; delayed departure; or another reasonable solution.
The Provider may refuse unsafe overloading.
28. Personal Belongings and Travel Documents
The Client remains responsible for personal belongings and travel documents.
Passengers should personally safeguard: passports; airline tickets or boarding documents; identification; cash; mobile phones; laptops; cameras; jewelry; medication; wallets; small bags; and other valuables.
Before leaving the Vehicle, the Client should check: seats; floor areas; seat pockets; luggage compartments; door areas; and other storage spaces.
29. Road Travel Risks
Airport ground transportation involves ordinary and extraordinary road-travel risks that cannot be completely eliminated.
These may include: collisions; sudden braking; swerving; vehicle rollover; pedestrian crossings; animal crossings; other road users; mechanical failure; engine problems; overheating; brake problems; tire damage; battery or electrical problems; potholes; uneven roads; road construction; heavy rain; flooding; landslides; falling debris; poor visibility; traffic congestion; checkpoints; road closures; official rerouting; remote-area conditions; weak mobile signals; limited roadside assistance; and other transportation hazards.
30. Travel-Time Estimates Are Not Guarantees
Any estimated airport-transfer duration is a planning estimate.
Actual journey time may vary because of: traffic; airport congestion; weather; roadworks; accidents; road closures; checkpoints; Vehicle problems; local events; flight-related traffic surges; route changes; or other conditions outside DPTT’s reasonable control.
31. Client Must Allow Adequate Flight Buffer Time
The Client is responsible for choosing a pickup time that provides a reasonable margin for road travel and all airport and airline procedures.
DPTT may provide general coordination guidance, but the Client remains responsible for considering: distance from the airport; known road conditions; season; weather; traffic; airline-recommended airport arrival time; international or domestic departure requirements; check-in cutoffs; baggage-drop deadlines; security screening; immigration where applicable; terminal access; and the consequences of missing the flight.
32. Land-Transfer Buffer Recommendation
Consistent with DPTT’s general Land Transfer framework, Clients should ordinarily allow at least three (3) hours of additional buffer for a significant land-transfer segment connected to a flight, and substantially more where circumstances reasonably require it.
This is a planning recommendation, not a guarantee that three hours will always be sufficient.
For departure flights, the three-hour road-travel buffer should not be confused with the airline’s own recommended terminal-arrival period. The Client should account for both the potential land-travel delay and the airline/airport processing time appropriate to the flight.
33. Missed Flights
To the fullest extent permitted by applicable law, DPTT shall not be responsible for a missed flight where the missed departure results from: traffic; airport congestion; road conditions; weather; flooding; landslides; road closures; accidents; checkpoints; government restrictions; Provider delay; mechanical circumstances; insufficient Client buffer time; incorrect flight information; Client lateness; airline or airport procedures; Force Majeure; or another circumstance outside DPTT’s reasonable control.
34. Consequences of a Missed Flight
To the fullest extent permitted by law, DPTT does not assume responsibility for consequential costs resulting from a missed flight caused by circumstances outside the Agency’s reasonable control.
Such costs may include: replacement airline tickets; rebooking fees; hotel expenses; meals; additional transportation; missed accommodations; missed tours; lost income; lost work time; lost business opportunity; or other consequential expenses.
35. Airline Delays and Cancellations
DPTT does not control airline schedules, aircraft operations, flight delays, diversions, or cancellations.
Where an airline disruption affects the Airport Transfer, DPTT may attempt to coordinate an adjusted transportation arrangement, subject to: Provider availability; driver availability; Vehicle availability; waiting-time rules; other confirmed bookings; new timing requirements; additional costs; and the applicable Refund Policy.
36. Vehicle Assignment
The independent Provider generally assigns the Vehicle according to: passenger count; baggage; route; distance; airport access; Vehicle availability; road conditions; Provider operations; and the Booking Confirmation.
37. Specific Vehicle Requests
If the Client specifically requires: a sedan; an SUV; a van; a particular passenger capacity; a tuk-tuk/tuktuk; an enclosed Vehicle; air-conditioning; special baggage capacity; child-safety equipment; mobility accommodation; or another material Vehicle feature, that requirement should be expressly confirmed before payment.
38. Vehicle Substitution
The Provider may reasonably substitute the anticipated Vehicle because of: mechanical concerns; maintenance; availability; passenger capacity; baggage; airport-access requirements; road conditions; safety; Provider scheduling; or other legitimate operational circumstances.
A reasonable substitute Vehicle capable of performing the essential Airport Transfer does not automatically create a refund entitlement.
39. Driver Substitution
A Provider may substitute the originally anticipated driver because of: illness; scheduling; availability; working-hour restrictions; traffic location; airport queue conditions; other assigned trips; emergency circumstances; or other legitimate operational considerations.
A change of driver does not automatically constitute cancellation.
40. Provider Substitution
If the original Transport Provider becomes unavailable, DPTT or the responsible Provider may attempt to coordinate an alternative independent Provider.
A reasonable Provider substitution that preserves the essential Airport Transfer does not automatically entitle the Client to a refund.
41. Tuk-Tuk / Tuktuk Safety and Baggage Considerations
Where a tuk-tuk/tuktuk is expressly confirmed for an Airport Transfer, the Client understands that its: passenger enclosure; luggage capacity; weather protection; seating configuration; ride characteristics; available restraints; air-conditioning, if any; and overall comfort characteristics may differ materially from a conventional enclosed car or van.
Passengers must remain properly seated, secure loose belongings, follow capacity limits, avoid distracting the driver, and exercise reasonable care when entering and leaving the Vehicle.
42. Seatbelts and Passenger Safety
Passengers must use seatbelts where required by law or where the assigned Vehicle is equipped with them and their use is instructed or reasonably expected.
Passengers must follow lawful and reasonable safety instructions issued by the Provider or driver.
43. Minors and Child Safety
A parent, guardian, or responsible adult remains responsible for supervising minors.
Where legally required, applicable child-safety measures must be observed.
If a specialized child seat or restraint is necessary or important to the Client, availability should be requested and confirmed before payment.
44. Passenger Conduct
Passengers must behave lawfully and reasonably during the transfer.
A Provider or driver may refuse or terminate transportation where reasonably necessary because of: violence; threats; harassment; serious intoxication; illegal drug use; contraband; deliberate driver distraction; unsafe interference with the Vehicle; intentional property damage; refusal to comply with important safety instructions; or other serious safety or legal concerns.
45. Checkpoints and Official Instructions
Airport transfers may be affected by: police checkpoints; airport security controls; government inspections; airport traffic officers; terminal restrictions; road closures; special security procedures; or other lawful authority requirements.
Passengers must cooperate with lawful requirements, including producing identification or travel documents where required.
46. Route Changes and Detours
The Provider or driver may reasonably use another route because of: traffic; road closures; construction; accidents; airport restrictions; flooding; landslides; checkpoints; government instructions; security issues; local events; Vehicle restrictions; or other operational circumstances.
A reasonable detour does not automatically create a refund entitlement.
47. Requested Stopovers
A standard Airport Transfer does not automatically include unlimited discretionary stops.
An additional stop is subject to: Provider approval; driver availability; traffic; route practicality; flight timing; other passengers on a shared transfer; waiting time; and additional charges where applicable.
48. Shared or Joiner Airport Transfers
A shared or joiner Airport Transfer may involve: other passengers; multiple pickups; multiple drop-offs; limited waiting time; fixed departure windows; route sequencing; baggage limits; and reasonable timing flexibility.
Clients booking shared transportation should not assume the same scheduling flexibility available in a private transfer.
49. Private Airport Transfers
A private transfer generally provides exclusive use of the assigned Vehicle for the confirmed route, subject to Provider rules.
A private transfer does not automatically include: unlimited waiting; unlimited stops; additional destinations; substantial route changes; extended Vehicle hire; or additional mileage beyond the confirmed arrangement.
50. Mechanical Problems
An unexpected mechanical problem may occur despite reasonable maintenance.
If a Vehicle becomes unavailable or experiences a breakdown, the Provider may attempt to: repair the Vehicle; send roadside assistance; provide another Vehicle; send another driver; transfer passengers to another Vehicle; change the route; or make another reasonable transportation arrangement.
A reasonable substitute arrangement does not automatically create a refund entitlement.
51. Weather and Natural Conditions
Airport Transfers may be affected by: heavy rain; storms; flooding; landslides; fallen trees; road debris; poor visibility; strong winds; damaged roads; or other natural conditions.
The Provider may reasonably delay, reroute, interrupt, or cancel transportation where conditions create a material safety concern.
52. Force Majeure
Airport Transfers may be affected by circumstances beyond the reasonable control of DPTT or the Provider.
These may include: typhoons; storms; earthquakes; flooding; landslides; fires; public-health restrictions; government orders; civil disturbance; security incidents; strikes; airport closures; road closures; transport restrictions; utility failure; telecommunications failure; airline disruption; or other comparable events beyond reasonable control.
Refund, rebooking, substitution, or credit consequences are governed by Provider terms, the Booking Confirmation, the Booking Cancellation, Rescheduling & Refund Policy, and mandatory law.
53. Bookings Made Within Three Days Are Non-Refundable
An Airport Transfer booking first made within three (3) calendar days of the scheduled Service date is non-refundable from the time the booking is confirmed.
This applies to applicable bookings by car, van, tuk-tuk/tuktuk, and other confirmed land Vehicles, subject to rights that applicable law does not permit the parties to exclude.
Clients making short-notice Airport Transfer bookings should ensure their travel plans and flight information are correct before making payment.
54. Other Cancellations
Cancellations outside the three-day rule are governed by: the Booking Cancellation, Rescheduling & Refund Policy; Provider cancellation rules; Vehicle reservation commitments; driver allocation; dispatch or mobilization; amounts already committed; payment-processing costs; and applicable law.
55. No-Show Rules
A Client may be treated as a no-show where the Client: fails to appear; cannot be contacted; provides an incorrect pickup point; goes to an incorrect meeting point despite updated instructions; arrives after the Provider’s allowable waiting period; fails to communicate a material flight change; refuses to proceed after reasonable Provider mobilization without a qualifying basis; or otherwise fails to use the confirmed available transfer.
No-show bookings are generally non-refundable under the Refund Policy and applicable Provider rules.
56. Land-Tour Components and No Prorated Refund
If an Airport Transfer forms part of a broader land tour, tour package, or multi-stop itinerary, the following universal DPTT rule also applies:
No prorated or proportional refund is due merely because a destination, attraction, stop, route, or itinerary component is skipped, shortened, reordered, replaced, or made unavailable because of safety considerations, weather, road conditions, government or authority directives, environmental restrictions, mechanical circumstances, or the Provider/operator’s reasonable operational or safety discretion.
57. Airport Transfer Route Changes
For a pure Airport Transfer, a reasonable route change, airport-access change, pickup-zone change, or detour does not create a proportional refund right where the essential transportation can still reasonably be completed.
58. Health and Fitness Considerations
Passengers are responsible for considering their own medical and physical needs before the journey.
Relevant considerations may include: motion sickness; back or neck conditions; pregnancy; mobility limitations; recent surgery; long-distance travel tolerance; medication requirements; or other health circumstances affected by road travel.
DPTT does not provide medical advice.
59. Personal Medication
Passengers remain responsible for carrying necessary medication and personal medical supplies.
Essential medication should be kept accessible rather than placed in inaccessible checked or stored baggage.
60. Emergency Response
In the event of an accident, injury, medical concern, Vehicle breakdown, security incident, or other emergency, the Provider or driver may take such immediate action as reasonably necessary.
Emergency response may be affected by: location; traffic; weather; road conditions; airport access; mobile signal; ambulance availability; police availability; local medical facilities; and other circumstances.
Clients should review the Traveler Emergency & Incident Response Guide.
61. Emergency Medical Coordination
Where reasonably necessary, the Provider or driver may seek medical or emergency assistance for a Passenger.
DPTT may assist with communications or coordination where reasonably possible.
The Client remains responsible for personal emergency transportation, hospital, medical, accommodation, evacuation, and similar expenses except where another responsible party or applicable law provides otherwise.
62. Incident Reporting
A material incident should be reported promptly to the Provider and, where Agency assistance is requested, to DPTT.
Where reasonably possible, Clients should preserve: photographs; videos; driver information; Vehicle information; witness details; police or airport-authority reports; medical records; receipts; messages; flight records; Booking Confirmation; and other reasonably relevant evidence.
63. Claims Concerning Provider or Driver Operations
Where a claim principally concerns Provider-controlled transportation matters, the responsible Provider may be required to investigate and respond according to its own procedures and applicable law.
This may include issues concerning: driver conduct; Vehicle operation; Vehicle condition; maintenance; waiting time; baggage handling; Provider cancellation; operational delays; route decisions; airport pickup implementation; or other Provider-controlled matters.
64. DPTT Assistance With Provider Concerns
DPTT may, where reasonably appropriate: relay a Client complaint; provide Agency-held booking information; forward relevant records; request clarification from the Provider; communicate a Provider response; or help identify available Provider options.
Such assistance does not guarantee compensation, refund approval, Provider admission of liability, replacement transportation, insurance payment, airline reimbursement, or another requested outcome.
65. Limitation Relating to Independent Provider Conduct
To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, loss, property damage, delay, missed flight, missed connection, additional expense, cancellation, or other damage caused by the independent acts, omissions, operational decisions, negligence, misconduct, or non-performance of a Provider, driver, airline, airport personnel, other road user, or unrelated third party where the matter is outside DPTT’s reasonable control.
This provision does not exclude any responsibility that applicable law places directly and non-waivably upon DPTT.
66. Client Indemnification
To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Client’s: illegal conduct; fraud; intentional misconduct; provision of materially incorrect flight information; provision of materially incorrect pickup information; carriage of prohibited property; material breach of these Terms; intentional damage to Provider property; unsafe conduct; material interference with the driver; violation of airport rules; or violation of another person’s lawful rights.
This clause does not require the Client to indemnify DPTT for a responsibility that applicable law places directly and non-waivably upon the Agency.
67. Travel Insurance
Clients are encouraged to consider appropriate personal travel insurance.
Depending on individual circumstances, coverage may include: medical expenses; accident coverage; trip cancellation; trip interruption; baggage; missed flights; missed connections; emergency transportation; flight disruption; and other travel risks.
Insurance coverage is governed by the insurer’s own policy, limitations, exclusions, and claims requirements.
68. Provider Insurance
If a Transport Provider states that insurance exists, such coverage may remain subject to: coverage limits; exclusions; deductibles; driver eligibility; passenger eligibility; Vehicle restrictions; reporting deadlines; claims documentation; and insurer approval.
DPTT does not guarantee the scope, adequacy, continued validity, or outcome of independent Provider insurance unless expressly verified and confirmed in writing.
69. Privacy and Flight Information
DPTT may collect and share personal information reasonably necessary for: booking; airport pickup; Provider coordination; flight coordination; identification where required; payment verification; incident documentation; refunds; disputes; and other legitimate purposes described in the Privacy & Personal Data Policy.
Relevant booking information may be supplied to the responsible Transport Provider where necessary to perform the transfer.
70. Electronic Communications and Evidence
Booking confirmations, flight information, messages, location pins, payment records, photographs, videos, receipts, timestamps, and other communications through Official Channels may be retained and used to document: booking details; flight information; pickup instructions; meeting-point changes; flight delays; waiting-time issues; cancellations; no-shows; incidents; refund requests; claims; and disputes.
71. Specific Liability Provisions
These Airport Transfer Terms do not establish a separate numerical liability cap that competes with DPTT’s more specific service waiver.
Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, any applicable monetary limitation shall be governed by the Tours, Travel Packages, and Service Waiver and Liability Disclaimer, subject to applicable law.
That more specific provision shall control to the extent it addresses the same liability issue.
72. Consequential and Indirect Losses
To the fullest extent permitted by applicable law, DPTT shall not be liable for indirect, incidental, punitive, exemplary, special, or consequential losses caused by independent Provider operations or circumstances outside DPTT’s reasonable control.
These may include: replacement airfare; airline rebooking charges; lost income; lost wages; lost profits; lost business opportunity; missed accommodation; missed tours; missed appointments; additional transportation; additional accommodation; business interruption; or other consequential economic losses.
73. Client Responsibility to Clarify Important Requirements
If a particular feature is important to the Client’s decision, the Client should obtain confirmation before payment.
This may include: car, van, or tuk-tuk/tuktuk; Vehicle capacity; air-conditioning; baggage space; child seat availability; mobility accommodation; airport meeting point; waiting time; specific pickup time; flight-delay handling; private or shared transfer; refund conditions; insurance questions; or another material booking requirement.
74. Agency Interpretation and Clarification
These Airport Transfer Terms form part of DPTT’s wider legal, booking, and safety framework.
If an Agency provision appears unclear, ambiguous, incomplete, or potentially inconsistent, the Client must request clarification before payment or participation where the issue is material to the booking.
To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, and terms, including determining which Agency provision applies to a particular booking or circumstance.
This provision does not authorize DPTT to override a mandatory requirement of applicable Philippine law.
75. Direct Resolution of Complaints and Disputes
If a Client has a complaint, disagreement, claim, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to the Agency through an Official Channel.
The Client should provide available supporting information such as: Booking Confirmation; payment records; flight information; messages; pickup details; location pins; driver or Vehicle information; photographs; videos; airport or airline communications; Provider communications; incident reports; medical records where relevant; and other reasonably relevant evidence.
The Client and Agency shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.
76. Governing Law and Exclusive Venue
These Airport Transfer Terms and disputes arising from or relating to an Airport Transfer, booking, transaction, communication, or applicable Agency policy are governed by the laws of the Republic of the Philippines.
If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.
The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.
77. Consumer Protection and Non-Waivable Rights
Nothing in these Terms is intended to unlawfully waive, exclude, restrict, or limit any right, legal responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.
If a provision is legally restricted, it shall apply to the maximum extent permitted while the remaining provisions continue in effect.
78. Severability
If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, that provision shall be limited or separated only to the extent necessary.
The remaining provisions shall continue to apply to the fullest extent permitted by law.
79. No Waiver by Exception or Non-Enforcement
If DPTT grants additional waiting time, rescheduling assistance, alternative transportation, goodwill credit, refund, or another accommodation in one particular case, that accommodation: does not amend these Terms generally; does not establish a precedent; does not automatically apply to another Client or booking; and does not waive applicable Provider rules.
80. Updates to These Airport Transfer Terms
D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in: Services; Provider arrangements; Vehicle types; airport procedures; booking processes; airline or airport practices; government requirements; safety practices; payment systems; technology; road conditions; or other relevant circumstances.

Final Acceptance Notice: Booking, reserving, paying for, confirming, accepting pickup, entering the assigned Vehicle, participating in, receiving, using, or otherwise availing an Airport Transfer through D’Palawan Travel and Tours constitutes acceptance of these Airport Transfer Terms and all applicable Agency terms, policies, procedures, company processes, Provider rules, airport requirements, safety instructions, and regulations. These Terms expressly include qualifying airport transfers by car, van, and tuk-tuk/tuktuk where the applicable Vehicle is confirmed for the booking. Advance bookings must be reconfirmed on the day before the scheduled Service. Bookings first made within three calendar days of the Service are non-refundable. Where an airport transfer forms part of a land tour or package, no prorated refund is due merely because a land-tour destination is skipped or modified for safety, weather, road, authority, or reasonable Provider operational reasons. If anything is unclear, obtain clarification before payment. If you disagree with an applicable provision, do not proceed with the Service.
