These Land Transfer Terms and Conditions (“Terms”) apply to land transportation Services coordinated, arranged, reserved, booked, scheduled, or otherwise assisted by D’Palawan Travel and Tours (“DPTT,” the “Agency,” “we,” “us,” or “our”).

These Terms apply, as relevant, to land transportation using cars, vans, tuktuks/tuk-tuks, electric tricycles or e-trikes, bicycles, e-bikes, and other appropriate land-transport vehicles or mobility units assigned or supplied by independent transportation Providers according to the route, distance, passenger count, baggage, availability, Client request, operational suitability, applicable regulations, and Booking Confirmation.

Bicycles and e-bikes may be offered particularly for short-distance transportation, local mobility, tourism movements, or where specifically requested by the Client and accepted by the applicable Provider.

These Terms are intended to clearly explain: the scope of land-transfer Services; DPTT’s role as a travel coordination and booking agency; the responsibilities of independent Transport Providers and drivers/riders; Vehicle and mobility-unit arrangements; car, van, tuktuk, e-trike, bicycle, and e-bike arrangements; booking and payment requirements; pickup, drop-off, waiting-time, and route conditions; road, weather, traffic, and remote-area risks; passenger and baggage responsibilities; delays, substitutions, cancellations, and refunds; land-tour itinerary changes; incident and emergency procedures; and the allocation of responsibilities among the Client, DPTT, the Provider, driver/rider, and relevant authorities.

Please read these Terms before making payment or beginning a Land Transfer.

Booking, reserving, paying for, confirming, participating in, entering, boarding, mounting, riding, receiving, using, or otherwise availing a Land Transfer through D’Palawan Travel and Tours constitutes acknowledgment and acceptance of these Terms and all other applicable Agency policies, procedures, company processes, Provider requirements, safety instructions, and regulations.

If anything is unclear, contact D’Palawan Travel and Tours before making payment.

If you disagree with an applicable provision, do not proceed with the booking or Service.

1. Definitions

“Agency,” “DPTT,” “we,” “us,” or “our” means D’Palawan Travel and Tours.

“Client,” “Passenger,” “Traveler,” “you,” or “your” means any person who inquires about, reserves, books, pays for, participates in, uses, or is included in a Land Transfer coordinated through DPTT.

“Provider,” “Transport Provider,” “Transport Supplier,” or “Independent Provider” means the independent transport company, Vehicle owner, bicycle/e-bike supplier, driver, rider, operator, or other third party responsible for performing the Land Transfer.

“Vehicle”, when used generally in these Terms, means the car, van, tuktuk/tuk-tuk, e-trike, bicycle, e-bike, or other appropriate land-transport vehicle or mobility unit assigned or supplied by the Provider to perform the booked Service, unless the context clearly requires a narrower meaning.

“Tuktuk” or “Tuk-Tuk”, for purposes of these Terms, means a three-wheeled motorized passenger vehicle used for local or short-distance transportation. This definition includes conventional fuel-powered tuktuks/tricycles and electric three-wheeled passenger vehicles commonly described as electric tricycles or e-trikes, regardless of the particular commercial description used by the Provider.

“E-Trike” means a three-wheeled electrically powered passenger vehicle. For purposes of DPTT’s Land Transfer Terms, an e-trike is included within references to tuktuk/tuk-tuk transportation unless the Booking Confirmation provides otherwise.

“Bicycle” means a pedal-powered bicycle offered or arranged for short-distance transportation, local mobility, tourism movement, or another specifically confirmed purpose.

“E-Bike” means an electrically assisted or electrically powered bicycle-type mobility unit supplied or made available by a Provider for short-distance transportation or another specifically confirmed use. For clarity, a three-wheeled electric passenger vehicle classified in these Terms as an e-trike is treated as a tuktuk/e-trike rather than an e-bike for purposes of this policy.

“Land Transfer” means point-to-point or route-based transportation by road or land where the main purpose is moving the Client between agreed locations. Depending on the Booking Confirmation, this may be performed using a car, van, tuktuk, e-trike, bicycle, e-bike, or another appropriate land-transport arrangement.

“Land Tour” means an itinerary involving one or more tourism destinations, attractions, or stops where transportation is primarily performed by land.

“Booking Confirmation” means the applicable confirmation, itinerary, message, receipt, voucher, invoice, acknowledgment, or similar record describing the confirmed Service.

“Official Channels” means the contact methods identified or authorized by DPTT, including its official telephone number, email, website, messaging accounts, and official social-media communication channels.

“Calendar days” means consecutive days including weekends and public holidays unless otherwise stated.

2. Scope of These Land Transfer Terms

These Terms apply to land-based transportation coordinated through DPTT, including: point-to-point transfers; hotel and resort transfers; port transfers; terminal transfers; inter-town transfers; inter-municipality transfers; transport between tourism destinations; transport to inland attractions; transport to remote barangays; land tours; multi-stop land itineraries; shared or joiner transfers; private transfers; transport segments included in travel packages; car transfers; van transfers; tuktuk/tuk-tuk transfers; electric tricycle/e-trike transfers; bicycle transfers or local bicycle mobility for short distances and/or where specifically requested by the Client and confirmed by the Provider;e-bike transfers or local e-bike mobility for short distances and/or where specifically requested by the Client and confirmed by the Provider; and other comparable land transportation arrangements.

The particular mode of transportation depends on the Booking Confirmation, route, distance, Client request, Provider availability, passenger and baggage requirements, road conditions, applicable regulations, and reasonable safety considerations.

3. Tuktuk / Tuk-Tuk and E-Trike Transfers

For purposes of these Terms, a tuktuk/tuk-tuk is a three-wheeled motorized passenger vehicle. The term includes both conventional fuel-powered three-wheelers and electric tricycles or e-trikes where used for the booked Land Transfer.

Where appropriate to the route and booking, a Land Transfer may therefore be performed by a conventional tuktuk, motorized tricycle, electric tuktuk, or e-trike rather than a conventional car or van.

Tuktuk/e-trike transportation may be particularly suitable for: short-distance local transfers; local tourism movements; town or barangay transportation; hotel-to-attraction transfers; port or terminal movements; short land-tour segments; routes where a smaller local Vehicle is operationally practical; or situations where the Client specifically requests this type of transportation and the Provider confirms availability and suitability.

The suitability of a tuktuk/e-trike depends on factors such as passenger count, baggage, distance, road conditions, weather, Vehicle configuration, availability, local traffic requirements, Provider operating practices, charging or fuel considerations, and the particular requirements of the Client.

The Client acknowledges that tuktuks and e-trikes may differ materially from enclosed cars or vans in passenger enclosure, weather protection, air-conditioning, suspension, seating configuration, luggage capacity, available restraints, and overall ride characteristics.

If a specific three-wheel Vehicle type is essential to the Client—for example, an electric e-trike rather than a conventional fuel-powered tuktuk—that requirement should be confirmed in writing before payment.

4. Bicycle and E-Bike Transfers

DPTT may also coordinate bicycles and e-bikes for short-distance Land Transfers, local transportation, tourism mobility, or where specifically requested by the Client, provided that an appropriate independent Provider is available and the proposed arrangement is reasonably suitable for the route.

Bicycle and e-bike arrangements may be appropriate for: short-distance point-to-point travel; movement within a town, tourism area, resort area, or barangay; short connections between nearby attractions; local tourism or recreational mobility; short portions of a land-tour itinerary; routes where a bicycle or e-bike is reasonably practical; or other Client-requested arrangements specifically confirmed by the Provider.

The availability of a bicycle or e-bike does not mean that it is appropriate for every Client, route, distance, weather condition, or baggage requirement.

Suitability may depend on: distance; road conditions; traffic; weather; Client age and physical ability; Client riding competence where the Client will operate the unit; passenger-carrying design, if any; baggage; helmet availability; battery charge or estimated range for e-bikes; Provider rules; local restrictions; operational safety; and the specific arrangement requested by the Client.

If the Client specifically wants a bicycle or e-bike rather than a car, van, tuktuk, or e-trike, that request should be disclosed and confirmed before payment.

A Client request for a bicycle or e-bike remains subject to Provider availability and reasonable operational and safety approval.

Where the Client will personally operate the bicycle or e-bike, the Client is responsible for riding lawfully and prudently, remaining within personal ability, following Provider instructions and applicable traffic requirements, using required safety equipment, and avoiding operation while intoxicated, seriously fatigued, medically impaired, or otherwise unfit to ride safely.

Where a bicycle or e-bike arrangement involves a Provider-supplied rider, passenger seat, passenger-carrying cycle, or another configuration, the Client must comply with the passenger-capacity, positioning, baggage, and safety requirements applicable to that particular unit.

A bicycle or e-bike provided principally as a general rental for unrestricted Client use rather than for a defined Land Transfer may also be governed by separate Provider rental terms.

5. Land Transfers Included in Tours or Packages

These Terms also apply where a land-transfer component forms part of: a day tour; a multi-day tour; a travel package; an island-and-land itinerary; an accommodation package; an airport-and-tour arrangement; or another combined travel Service.

Where the Land Transfer forms only one component of a larger arrangement, these Terms apply together with: the Travel Booking & Service Terms and Conditions; the Tours, Travel Packages, and Service Waiver and Liability Disclaimer; the Booking Cancellation, Rescheduling & Refund Policy; the Booking Confirmation; applicable Provider rules; and other relevant Site Policies.

6. D’Palawan Travel and Tours’ Role

D’Palawan Travel and Tours operates as a travel coordination and booking agency.

DPTT may assist with identifying available land-transfer options, requesting quotations, checking availability, coordinating reservations, communicating passenger and baggage requirements, coordinating pickup and drop-off details, communicating requested routes or stops, coordinating payment, relaying Provider or driver/rider information, communicating schedule changes, and providing reasonable booking support.

The actual transportation Service is performed by the independent Provider responsible for the booking.

7. Provider Operational Responsibility

The Provider performing the transfer generally manages the operational aspects of the transportation Service.

Depending on the booking, these may include: Vehicle, bicycle, or e-bike assignment; driver or rider assignment; maintenance; roadworthiness or operational condition; fuel or battery charging; driver/rider scheduling; route selection; departure timing; pickup sequencing; passenger or rider capacity; baggage limitations; waiting-time rules; stop rules; safety procedures; mechanical response; Provider-side permits, registrations, or documentation; compliance with transport rules applicable to the Provider and mode of transportation; and real-time road and safety decisions.

DPTT’s coordination of the booking does not transfer day-to-day operational management of the Provider’s Vehicle, bicycle, e-bike, driver/rider, personnel, equipment, or transportation operations to the Agency.

8. Independent Provider Relationship

Independent Transport Providers generally maintain their own Vehicles or mobility units, drivers/riders, business operations, maintenance arrangements, registrations where applicable, insurance arrangements, employment or contractor relationships, operating procedures, pricing rules, waiting-time policies, and legal responsibilities.

A booking, referral, coordination, commission, or other commercial relationship between DPTT and a Provider does not by itself create an employment relationship, partnership, joint venture, common ownership, or common operational management.

9. Remote-Area and Limited-Availability Arrangements

Some destinations or remote areas may have limited transportation availability.

Where appropriate and lawful, DPTT may assist in locating an available independent Vehicle owner, bicycle/e-bike Provider, driver/rider, or other Transport Provider where the Client requests transportation to or from such an area.

If a particular qualification or feature is essential to the Client’s decision, the Client should ask about it before booking.

This may include Vehicle type, bicycle or e-bike type, air-conditioning, seat configuration, Vehicle registration, driver/rider qualifications, insurance, helmet availability, child-safety equipment, baggage capacity, accessibility, route familiarity, battery range for an e-bike, or another material requirement.

10. Booking Is Not Confirmed Until Acknowledged

An inquiry, price request, preliminary quotation, availability inquiry, or draft itinerary does not by itself constitute a confirmed booking.

A Land Transfer becomes confirmed when the Agency or applicable Provider acknowledges the reservation as confirmed and any required deposit, payment, booking information, or other confirmation requirement has been satisfied and verified.

Before confirmation, price, Provider, driver/rider, mode of transportation, pickup time, route, and availability remain subject to change.

11. Acceptance of These Terms

The Client accepts these Land Transfer Terms by booking, reserving, paying a deposit, making partial or full payment, confirming the Service, permitting the assigned Provider to proceed for pickup or delivery, entering or boarding a Vehicle, mounting or using a bicycle/e-bike, participating in the transfer, or otherwise availing the Service.

Acceptance also includes the applicable Agency policies, booking procedures, Booking Confirmation, Provider rules, safety instructions, company processes, government requirements, and service-specific conditions.

12. Day-Before Reconfirmation Is Required

Clients with advance Land Transfer bookings must contact D’Palawan Travel and Tours on the day before the scheduled transfer to ensure that the booking has been properly acknowledged and to obtain the latest available operational instructions.

This requirement applies to advance transfers by: car; van; tuktuk/tuk-tuk; e-trike; bicycle; e-bike; and other applicable land transportation.

The Client should verify, as applicable, the booking name, transfer date, pickup point, destination, pickup window, passenger count, baggage, mode of transportation, Vehicle or mobility-unit information where available, driver/rider information where available, contact number, flight or ferry details where relevant, and special requirements previously disclosed.

13. Why Day-Before Reconfirmation Matters

Land transportation may be affected by conditions that change shortly before travel, including traffic, weather, road construction, flooding, landslides, checkpoints, road closures, local events, Provider scheduling, Vehicle or mobility-unit availability, battery or charging considerations for electric units, mobile-signal limitations, flight changes, and other operational circumstances.

Reconfirmation allows the latest available information to be communicated before the Client travels.

14. Latest Confirmed Instructions Control

The Client should rely on the most recent confirmed operational instructions rather than only on an old quotation, earlier screenshot, preliminary route, outdated pickup time, promotional page, previous location pin, or earlier travel-time estimate.

15. Accurate Pickup and Destination Information

The Client is responsible for providing accurate pickup and destination information.

Where applicable, this may include a hotel or resort name, barangay, terminal, port, airport, landmark, Google Maps location or pin, contact person, building or establishment name, or other practical location details.

DPTT is not responsible for delay or additional cost materially caused by incorrect, incomplete, or misleading location information supplied by the Client.

16. Pickup Points May Need to Change

A pickup or drop-off point may reasonably change because of road closures, Vehicle-access restrictions, bicycle/e-bike access limitations, construction, flooding, traffic controls, local ordinances, security restrictions, pedestrian-only areas, unsafe road conditions, parking restrictions, Vehicle size limitations, or other legitimate operational circumstances.

Where the originally requested location cannot reasonably or lawfully be reached, the Provider may request pickup or drop-off at a nearby practical location.

17. Road and Land-Travel Risks

The Client acknowledges that land transportation involves risks that cannot be completely eliminated.

Depending on the transportation mode and circumstances, these may include Vehicle collisions, bicycle or e-bike falls, loss of balance, loss of traction, sudden braking, swerving, rollovers, pedestrian crossings, animal crossings, acts of other road users, driver/rider error by any road user, mechanical breakdown, engine or electrical problems, battery depletion, overheating, brake problems, tire damage, punctures or blowouts, potholes, uneven surfaces, gravel, mud, sand, narrow roads, steep roads, limited lighting, blind curves, unmarked hazards, heavy rain, flooding, landslides, falling debris, strong winds, poor visibility, traffic congestion, road closures, checkpoints, local events, weak mobile signal, limited roadside assistance, limited repair facilities, delayed emergency response, and other road and travel hazards.

18. Bicycle and E-Bike Specific Risks

Clients using bicycles or e-bikes should understand that these forms of transportation provide substantially less physical protection than an enclosed car or van.

Additional risks may include: loss of balance; falls; skidding; reduced visibility to other motorists; close passing by other Vehicles; door-opening hazards; wet or slippery roads; sand, gravel, mud, and potholes; steep gradients; fatigue; heat exposure; battery depletion on e-bikes; mechanical or electrical failure; reduced luggage capacity; rain exposure; limited lighting; higher physical exposure in a collision; and other risks inherent in lightweight two-wheeled transportation.

Where the Client operates the bicycle or e-bike, the Client must ride conservatively, remain within personal ability, follow Provider instructions and applicable road rules, and use appropriate safety equipment.

A Provider may refuse or discontinue bicycle/e-bike use where the route, weather, Client condition, traffic, equipment condition, or other circumstances create a reasonable safety concern.

19. Remote-Area Road Conditions

Some Palawan routes and other remote routes may include partially paved roads, gravel roads, narrow roads, mountain roads, roads affected by rain, temporary repairs, construction areas, poor lighting, limited mobile connectivity, limited roadside services, or long distances between repair or medical facilities.

Clients should maintain reasonable flexibility regarding travel time, transportation mode, and comfort expectations on such routes.

20. Travel Times Are Estimates

Any estimated travel time is a planning estimate rather than a guaranteed arrival time.

Actual travel time may be affected by traffic, weather, road conditions, roadworks, accidents, checkpoints, Vehicle or equipment issues, passenger stops, fuel or charging stops, local events, route changes, other passengers on shared transfers, bicycle/e-bike speed and route limitations, or other circumstances outside DPTT’s reasonable control.

21. Connection Buffer

Clients connecting from a Land Transfer to an important fixed departure should allow a generous buffer.

Consistent with DPTT’s overall travel-planning framework, at least three (3) hours of additional buffer is recommended for significant land-transfer connections to flights or similarly time-sensitive departures.

This is a planning recommendation and is not a guarantee that three hours will always be sufficient.

Clients should allow additional time where appropriate because of long distances, rainy season, known roadworks, remote routes, traffic, possible ferry connections, airport requirements, weather, use of slower short-distance transportation modes, or the importance of the onward commitment.

22. Missed Flights, Ferries, Tours, and Other Connections

To the fullest extent permitted by law, DPTT shall not be responsible for missed flights, ferries, appointments, accommodation check-ins, tours, or other onward commitments where the missed connection results from traffic, road conditions, accidents, road closures, weather, flooding, landslides, checkpoints, Provider delay, mechanical circumstances, Force Majeure, insufficient Client buffer time, or another circumstance outside DPTT’s reasonable control.

23. Transportation Mode Assignment

The Provider generally determines the specific Vehicle or transportation mode assigned to the transfer according to passenger count, baggage, distance, route, availability, road conditions, capacity, operational requirements, safety, and the Booking Confirmation.

Where the Client has specifically requested a particular mode—such as car, van, tuktuk, e-trike, bicycle, or e-bike—the requested mode must be confirmed in writing if it is material to the Client’s decision.

24. Transportation Substitution

The Provider may reasonably substitute the originally anticipated Vehicle or transportation mode because of mechanical problems, maintenance, battery or charging limitations, availability, passenger capacity, baggage, route conditions, weather, safety, regulatory requirements, or other legitimate operational circumstances.

A reasonable substitute capable of performing the essential transportation Service does not automatically create a refund entitlement.

Where the difference in transportation mode is material to the Client—for example, replacement of an enclosed car with an open tuktuk, or replacement of a requested tuktuk with a bicycle/e-bike—the Client should be informed where reasonably practicable before the substituted Service begins.

25. Driver or Rider Substitution

The Provider may substitute a driver or rider because of availability, scheduling, illness, working-hour limitations, route assignment, emergency circumstances, or other legitimate operational reasons.

A change of driver/rider does not automatically constitute cancellation of the booking.

26. Provider Substitution

If the originally anticipated Provider becomes unavailable, DPTT or the responsible Provider may coordinate a reasonable alternative Provider where practicable.

A Provider substitution that preserves the essential transportation Service does not automatically create a refund entitlement.

27. Driver, Rider, Vehicle, and Equipment Documentation

The responsible Provider manages Provider-side documents and qualifications applicable to the Vehicle, bicycle/e-bike, driver, or rider.

If a specific credential, registration, permit, insurance condition, equipment specification, or other document is material to the Client’s decision, the Client should request current confirmation before payment.

28. Passenger and Rider Capacity

Passenger numbers must remain within the practical and lawful capacity applicable to the assigned transportation mode.

A bicycle or e-bike must not carry an additional passenger unless the particular unit is designed and permitted for passenger carriage and the Provider confirms that arrangement.

The Client must provide an accurate passenger count before confirmation.

An undisclosed increase in passenger count may require a larger Vehicle, an additional Vehicle, a different transportation mode, another Provider, additional charges, a schedule change, or cancellation where appropriate capacity is unavailable.

29. Baggage Disclosure

The Client should disclose material baggage requirements before booking.

This is particularly important for large suitcases, multiple suitcases per passenger, sports equipment, diving equipment, surfboards, bicycles carried as luggage, large boxes, mobility equipment, fragile items, or other unusually large or heavy baggage.

Bicycles, e-bikes, tuktuks, and e-trikes may have materially less baggage capacity than conventional cars or vans.

If significant baggage is expected, the Client should confirm that the requested mode is appropriate before payment.

30. Excess Baggage

Undisclosed or excessive baggage may require a larger Vehicle, another Vehicle, different transportation mode, special arrangements, additional charges, reduced passenger capacity, or rescheduling where suitable capacity is unavailable.

31. Personal Belongings

Clients remain responsible for personal belongings unless a Provider expressly accepts custody under separate terms.

Passengers and riders should safeguard cash, passports, identification, mobile phones, cameras, jewelry, medication, travel documents, electronics, and other valuables.

Before leaving any Vehicle, tuktuk, e-trike, bicycle, or e-bike, Clients should check the applicable seating, storage, basket, rack, luggage area, and other locations for personal belongings.

32. Seatbelts and Other Safety Equipment

Passengers must use seatbelts where required by law or where the assigned Vehicle is equipped with them and their use is instructed or reasonably expected.

Where the transportation mode does not use conventional seatbelts, Clients must follow the safety requirements appropriate to that mode.

For bicycle and e-bike arrangements, Clients must use helmets or other safety equipment where required by law, required by the Provider, included as a material safety instruction, or otherwise reasonably appropriate to the confirmed arrangement.

33. Tuktuk / Tuk-Tuk and E-Trike Safety Considerations

Passengers using a tuktuk, tuk-tuk, or e-trike should understand that the configuration, passenger enclosure, seating, luggage space, weather protection, ride characteristics, and available safety equipment may differ from those of a conventional enclosed car or van.

Passengers must remain properly seated, keep hands, feet, and belongings within the passenger area, avoid distracting the driver, follow capacity restrictions, secure loose items, follow lawful driver instructions, exercise additional care when entering or leaving the Vehicle, and consider weather exposure where appropriate.

If the Client requires the comfort, luggage capacity, accessibility, air-conditioning, or enclosure of a conventional car or van, that requirement should be specified before booking rather than assumed.

34. Bicycle and E-Bike Safety Considerations

Where a Client rides or operates a bicycle or e-bike, the Client must exercise reasonable care and follow applicable Provider and road-safety instructions.

The Client should: use required or appropriate protective equipment; remain within personal riding ability; observe traffic rules; avoid unsafe speeds; avoid distracted riding; avoid using a handheld phone while moving where unsafe or prohibited; slow down on wet, sandy, muddy, gravel, uneven, or congested roads; avoid carrying unsafe or excessive baggage; follow passenger restrictions; avoid riding while intoxicated or materially impaired; use lights or visibility equipment where required or appropriate; follow Provider battery/range instructions for e-bikes; and stop using the unit if a serious mechanical, electrical, brake, tire, steering, or battery problem is reasonably suspected.

Where the Provider determines that continued bicycle or e-bike travel would be unsafe because of severe weather, road conditions, darkness, mechanical condition, battery condition, traffic, Client fitness, or another material risk, the Provider may reasonably delay, terminate, reroute, or substitute the transportation arrangement.

35. Children and Dependents

Parents, guardians, and responsible accompanying adults remain responsible for the supervision of minors and dependents.

Where applicable, legally required child-safety measures must be observed.

If a child seat, specialized restraint, child helmet, or another safety item is necessary or important to the Client, availability should be requested and confirmed before payment.

A bicycle or e-bike must not be assumed suitable for transporting a child merely because the unit is available. The particular arrangement must be suitable, permitted, and confirmed by the Provider.

36. Boarding, Entering, Mounting, and Exiting

Passengers and Clients must exercise reasonable care when entering or leaving a Vehicle and when mounting or dismounting a bicycle or e-bike.

Clients should wait for a safe location, follow driver/rider or Provider instructions, watch for traffic, assist minors and dependents, avoid unsafe movements into traffic, use available steps or handholds where applicable, and take additional care on wet, uneven, muddy, sandy, or roadside surfaces.

37. Passenger and Client Conduct

Passengers and Clients must behave lawfully and reasonably during transportation.

Conduct that may justify denial or termination of transportation includes violence, threats, harassment, serious intoxication, illegal drug use, possession of prohibited contraband, deliberate distraction of the driver/rider, dangerous interference with the Vehicle or mobility unit, intentional property damage, refusal to follow material safety instructions, or other behavior creating a serious safety or legal concern.

38. Checkpoints and Authority Requirements

Land Transfers may encounter lawful checkpoints or inspections.

Clients must cooperate with lawful authority requirements, which may include identification checks, Vehicle or equipment inspections, baggage checks, route restrictions, security procedures, traffic controls, or other lawful requirements.

Time spent complying with lawful authority procedures may affect the journey schedule.

39. Route Changes and Detours

The Provider or driver/rider may reasonably change the route because of traffic, road closures, construction, accidents, flooding, landslides, unsafe bridges or roads, checkpoints, government instructions, local events, security concerns, Vehicle or bicycle/e-bike restrictions, weather, or other legitimate operational circumstances.

A reasonable detour does not automatically create a refund entitlement.

40. Requested Stopovers

Unscheduled Client-requested stops are subject to Provider or driver/rider agreement, Provider rules, available time, route practicality, traffic and parking conditions, other passengers on shared transfers, transportation mode, battery/range considerations where relevant, safety, and additional charges where applicable.

A point-to-point transfer does not automatically include unlimited discretionary stops.

41. Waiting Time

Waiting-time allowances vary by Provider and booking.

Additional waiting charges may apply where the Client is not ready at the agreed time, requests the Provider to wait, extends a stop, changes plans during the transfer, experiences a flight or appointment delay beyond the included allowance, or otherwise requires substantially more Provider time than booked.

42. Late Client Arrival

Late arrival may result in reduced waiting time, additional waiting charges, schedule changes, missed shared transport, Provider reassignment, no-show classification, or cancellation where the Provider cannot reasonably continue waiting.

The applicable consequence depends on the Provider rules and Booking Cancellation, Rescheduling & Refund Policy.

43. Shared and Joiner Transfers

Shared or joiner transfers may involve other passengers and therefore may require multiple pickup points, multiple drop-off points, waiting for other booked passengers, route sequencing, reasonable luggage limitations, fixed departure windows, and reasonable schedule flexibility.

A Client booking shared transportation should not assume the same routing or timing flexibility available with a private transfer.

44. Private and Individual Transfers

A private transfer generally provides exclusive use of the booked Vehicle for the agreed transportation Service, subject to Provider rules and the Booking Confirmation.

Where a bicycle or e-bike is booked for one Client, the arrangement may instead involve individual use of the confirmed unit rather than exclusive use of a conventional passenger Vehicle.

Private or individual transportation does not automatically include unlimited waiting time, unlimited stopovers, material route changes, additional destinations, extended use, or additional travel beyond the booked scope.

45. Land Tours and Multi-Stop Itineraries

Land tours may include several destinations or attractions.

The sequence and availability of stops may be affected by weather, road conditions, traffic, opening hours, government restrictions, site closures, crowding, safety, local events, time limitations, transportation-mode limitations, Provider operational decisions, or other circumstances.

46. No Prorated Refund for Skipped Land-Tour Destinations

No prorated or proportional refund is due merely because a destination, attraction, stop, route, or itinerary component on a land tour is skipped, shortened, reordered, replaced, or made unavailable because of safety considerations, weather, road conditions, flooding, landslides, traffic or road closures, government or authority directives, site closures, environmental restrictions, mechanical or electrical circumstances, battery/range limitations arising unexpectedly despite reasonable planning, emergency conditions, or the Provider/operator’s reasonable operational or safety discretion.

The Client acknowledges that a land-tour price generally covers overall transportation or mobility-unit use, Provider/driver/rider time, fuel or ordinary charging requirements where applicable, coordination, mobilization, and Service delivery rather than a separate refundable price assigned to each stop.

47. Safety Takes Priority Over Itinerary Completion

A driver, rider, Provider, competent authority, or responsible onsite personnel may determine that proceeding to a particular road or destination is unsafe, impractical, unavailable, or prohibited.

Safety and lawful authority requirements take priority over strict completion of an itinerary.

48. Mechanical, Electrical, or Equipment Problems

Vehicles, bicycles, and e-bikes may occasionally experience unexpected mechanical, electrical, tire, battery, or other equipment problems despite maintenance efforts.

Where a problem occurs, the responsible Provider may attempt to repair the unit, send assistance, provide replacement transportation, transfer the Client to another suitable Vehicle or mobility unit, change the route, reschedule transportation, or make another reasonable operational arrangement.

A reasonable replacement or continuation arrangement does not automatically create a refund entitlement.

49. Weather and Natural Conditions

Land transportation may be affected by heavy rain, storms, flooding, landslides, fallen trees, fallen debris, mud, reduced visibility, strong winds, damaged roads, excessive heat, or other natural conditions.

Bicycles, e-bikes, tuktuks, and e-trikes may be more exposed to certain weather conditions than conventional enclosed cars or vans.

The Provider may reasonably delay, reroute, interrupt, substitute, or cancel transportation where conditions create a material safety concern.

50. Force Majeure

Land Transfers may be affected by events beyond the reasonable control of DPTT or the Provider, including typhoons, storms, earthquakes, flooding, landslides, fires, public-health restrictions, government actions, civil disturbance, security incidents, strikes, road closures, transport restrictions, utility failure, telecommunications failure, or other comparable events beyond reasonable control.

Refund, rebooking, substitution, or credit consequences are governed by Provider terms, the Booking Confirmation, the Booking Cancellation, Rescheduling & Refund Policy, and mandatory law.

51. Bookings Made Within Three Days Are Non-Refundable

A Land Transfer booking first made within three (3) calendar days of the scheduled Service date is non-refundable from the time the booking is confirmed.

This applies to qualifying bookings involving cars, vans, tuktuks/tuk-tuks, e-trikes, bicycles, e-bikes, and other land-transfer arrangements, subject to rights that applicable law does not permit the parties to exclude.

Clients making short-notice bookings should ensure that their travel plans are final before payment.

52. Other Cancellations

Cancellations outside the three-day rule are governed by the Booking Cancellation, Rescheduling & Refund Policy, applicable Provider policies, group size, transportation reservation commitments, driver/rider allocation, amounts already paid or committed, mobilization, bank or payment costs, and applicable law.

53. No-Shows

A Client may be treated as a no-show if the Client fails to appear, cannot be contacted, fails to reach the confirmed pickup point, arrives beyond applicable waiting time, provides incorrect pickup information resulting in a missed Service, refuses to proceed after reasonable Provider mobilization without a qualifying basis, or otherwise fails to use an available confirmed Service.

No-shows are generally non-refundable under the Refund Policy and applicable Provider terms.

54. Flight, Ferry, and Schedule Changes

If the Client’s flight, ferry, accommodation, or other travel schedule changes, the Client must notify DPTT as soon as reasonably possible.

A requested change remains subject to Provider availability, driver/rider availability, transportation availability, waiting-time rules, new pricing, other bookings already assigned to the Provider, and the Refund Policy.

55. Client-Requested Route, Mode, or Schedule Changes

Changes requested after confirmation may involve additional charges.

This may include changing the pickup location, changing the destination, adding stopovers, adding passengers, requiring a larger Vehicle, changing from bicycle/e-bike or tuktuk/e-trike to car/van, changing from car/van to another requested mode, changing departure time, extending waiting time, adding mileage or distance, adding destinations, or converting a transfer into a tour or extended transportation arrangement.

56. Health and Fitness Considerations

Passengers and Clients are responsible for considering personal health and comfort needs before undertaking the journey.

Relevant considerations may include motion sickness, back or neck conditions, pregnancy, mobility limitations, heat sensitivity, recent surgery, long-distance travel tolerance, medication requirements, physical fitness for bicycle/e-bike use, balance, riding competence, or other health circumstances affected by road travel.

DPTT does not provide medical advice.

57. Personal Medication

Clients are responsible for carrying required medication and necessary personal medical supplies.

Important medication should be kept accessible rather than packed in inaccessible baggage.

58. Emergency Response

In the event of an accident, injury, medical issue, Vehicle/equipment breakdown, security concern, or other emergency, the responsible Provider, driver, or rider may take reasonable immediate action under the circumstances.

Emergency response may be affected by distance, traffic, road conditions, weather, mobile signal, availability of ambulances, police or rescue services, local medical facilities, and other conditions.

Clients should review the Traveler Emergency & Incident Response Guide.

59. Emergency Medical Coordination

Where reasonably necessary, the Provider or driver/rider may seek emergency medical or transportation assistance for the Client.

DPTT may assist with communications or coordination where reasonably possible.

The Client remains responsible for personal medical, hospital, emergency transportation, evacuation, accommodation, or related expenses except to the extent another responsible party or applicable law provides otherwise.

60. Incident Reporting

A material incident should be reported promptly to the Provider and, where DPTT assistance is requested, to the Agency.

Where reasonably possible, Clients should preserve photographs, videos, driver/rider and Vehicle/equipment information, witness details, police reports, medical records, receipts, messages, booking records, and other relevant evidence.

61. Claims Relating to Provider, Driver, or Rider Operations

Where a claim principally concerns Provider-controlled transportation matters, the responsible Provider may be required to investigate and respond under its own procedures and applicable law.

This may include claims concerning driver/rider conduct, Vehicle or bicycle/e-bike operation, equipment condition, maintenance, road incidents, baggage handling, waiting-time disputes, Provider cancellations, operational delays, route decisions, or other Provider-controlled matters.

62. DPTT Assistance With Provider Concerns

DPTT may, where reasonably appropriate, relay a Client complaint, provide Agency-held booking information, request clarification from the Provider, forward supporting documentation, communicate the Provider’s response, or assist in identifying available options.

Such assistance does not guarantee compensation, a refund, Provider admission of liability, replacement transportation, insurance payment, or another requested outcome.

63. Limitation Relating to Independent Provider Conduct

To the fullest extent permitted by applicable law, DPTT shall not be responsible for injury, loss, property damage, delay, missed connection, additional expense, cancellation, or other damage caused by the independent acts, omissions, operational decisions, negligence, misconduct, or non-performance of a Provider, driver/rider, other road user, or unrelated third party where the matter is outside DPTT’s reasonable control.

This does not exclude a responsibility that applicable law places directly and non-waivably upon DPTT.

64. Client Indemnification

To the fullest extent permitted by law, the Client agrees to indemnify and hold harmless DPTT and its owners, officers, employees, and authorized representatives from third-party claims, penalties, losses, liabilities, or reasonable expenses arising directly from the Client’s illegal conduct, fraud, intentional misconduct, carriage of prohibited property, intentional or wrongful damage to a Vehicle/bicycle/e-bike, unsafe operation of a Client-operated unit, material breach of these Terms, unsafe conduct, harassment of the driver/rider, material interference with transportation operations, violation of applicable law, or violation of another person’s lawful rights.

This provision does not require the Client to indemnify DPTT for a responsibility applicable law places directly and non-waivably upon the Agency.

65. Personal Travel Insurance

Clients are encouraged to consider suitable personal travel insurance according to their itinerary and circumstances.

Depending on individual needs, coverage may include medical expenses, accident coverage, trip interruption, trip cancellation, baggage, missed connections, emergency transportation, bicycle/e-bike-related activities where covered, and other appropriate travel risks.

66. Provider Insurance

If a Provider states that insurance exists, the insurance may remain subject to coverage limitations, deductibles, exclusions, claim deadlines, documentation, driver/rider eligibility, passenger eligibility, Vehicle or equipment limitations, activity limitations, and insurer approval.

DPTT does not guarantee the scope, adequacy, continued validity, or outcome of independent Provider insurance unless expressly verified and confirmed in writing.

67. Privacy and Booking Information

DPTT may collect and share personal information reasonably necessary for booking, pickup coordination, Provider coordination, identification where required, payment verification, safety, incident documentation, refunds, disputes, and other legitimate purposes described in the Privacy & Personal Data Policy.

68. Electronic Communications and Evidence

Booking Confirmations, messages, location pins, payment records, photographs, videos, receipts, and other communications exchanged through Official Channels may be retained and used to document booking details, pickup points, route changes, transportation mode, driver/rider information, cancellations, delays, incidents, refund requests, claims, and disputes.

69. Specific Liability Provisions

These Land Transfer Terms do not establish a separate numerical liability cap that competes with DPTT’s more specific service waiver.

Where a claim directly concerns alleged primary liability of D’Palawan Travel and Tours itself, any applicable monetary limitation shall be governed by the Tours, Travel Packages, and Service Waiver and Liability Disclaimer, subject to applicable law.

If a competent court determines DPTT itself to be primarily liable, DPTT’s maximum aggregate monetary liability is limited, to the fullest extent permitted by applicable law, to two (2) times the Cash Received by DPTT from the Client for the specific booking or transaction giving rise to the claim, subject to the definitions and conditions in the controlling Waiver and Liability Disclaimer.

70. Consequential and Indirect Losses

To the fullest extent permitted by law, DPTT shall not be responsible for indirect, incidental, punitive, exemplary, special, or consequential losses caused by independent Provider operations or circumstances outside DPTT’s reasonable control.

Examples may include lost income, lost wages, lost earnings, lost profits, lost business, lost opportunity, opportunity costs, missed work, missed appointments, missed flights, missed ferries, missed tours, additional accommodation, additional transportation, business interruption, or similar consequential economic losses.

71. Client Responsibility to Clarify Important Requirements

If a particular feature is important to the Client’s decision, the Client should obtain confirmation before payment.

This may include: car; van; tuktuk/tuk-tuk; fuel-powered or electric tuktuk; e-trike; bicycle; e-bike; air-conditioning; passenger capacity; baggage capacity; helmet availability; child-seat availability; accessibility; specific route; pickup point; drop-off point; waiting time; stopovers; driver/rider details; insurance questions; battery/range expectations where relevant; travel time; refund conditions; or another requirement material to the booking.

72. Agency Interpretation and Clarification

These Terms form part of DPTT’s wider legal, contractual, booking, and safety framework.

If an Agency provision appears unclear, incomplete, ambiguous, or potentially inconsistent, the Client must seek clarification before payment or participation where the matter is material to the booking.

To the fullest extent permitted by applicable law, D’Palawan Travel and Tours reserves the exclusive right to interpret, clarify, administer, and apply its own policies, procedures, company processes, booking conditions, and terms, including determining which Agency provision applies to a particular booking or circumstance.

This right does not authorize DPTT to override mandatory requirements of applicable Philippine law.

73. Direct Resolution of Complaints and Disputes

If a Client has a complaint, disagreement, claim, or dispute involving D’Palawan Travel and Tours, the Client agrees to first provide written notice directly to the Agency through an Official Channel.

The Client should provide available supporting information such as Booking Confirmation, payment records, messages, pickup details, location information, photographs, videos, Provider communications, driver/rider or Vehicle/equipment information, incident reports, medical documentation where relevant, and other reasonably relevant records.

The Client and Agency shall first attempt in good faith to resolve the matter directly for at least thirty (30) days from written notice of the dispute.

74. Governing Law and Exclusive Venue

These Land Transfer Terms and disputes arising from or relating to a Land Transfer, booking, transaction, communication, or applicable Agency policy are governed by the laws of the Republic of the Philippines.

If a dispute involving D’Palawan Travel and Tours remains unresolved after the required 30-day direct-resolution period, then, to the fullest extent permitted by applicable law, any court action arising from or relating to the dispute may only be filed before the proper courts of Puerto Princesa City, Palawan, Philippines.

The parties agree to such venue subject to any jurisdiction or venue requirement that applicable law makes mandatory and non-waivable.

75. Consumer Protection and Non-Waivable Rights

Nothing in these Terms is intended to unlawfully waive, exclude, limit, or restrict a right, legal responsibility, or remedy that applicable Philippine law does not permit the parties to waive or limit.

If a provision is legally restricted, it shall apply to the maximum extent permitted while the remainder of these Terms continues in effect.

76. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful, or unenforceable, the provision shall be limited or separated only to the extent necessary.

The remaining provisions shall continue to operate to the fullest extent permitted by law.

77. No Waiver by Exception or Non-Enforcement

If DPTT grants a goodwill refund, rescheduling arrangement, additional waiting time, alternative Vehicle or transportation mode, credit, or other accommodation in a particular case, that accommodation does not amend these Terms generally, establish a precedent, automatically apply to another Client or booking, or waive applicable Provider rules.

78. Updates to These Land Transfer Terms

D’Palawan Travel and Tours may revise these Terms when reasonably necessary because of changes in Services, Provider arrangements, Vehicle or mobility-unit types, booking procedures, transport practices, government requirements, safety practices, payment systems, technology, road or travel conditions, or other relevant circumstances.

The current version will be published at:

Final Acceptance Notice: Booking, reserving, paying for, confirming, entering or boarding the assigned Vehicle, mounting or using an assigned bicycle/e-bike, participating in, receiving, using, or otherwise availing a Land Transfer through D’Palawan Travel and Tours constitutes acceptance of these Land Transfer Terms and all applicable Agency terms, policies, procedures, company processes, Provider rules, safety requirements, and regulations.

These Terms expressly include applicable Land Transfers by car, van, tuktuk/tuk-tuk, electric tricycle/e-trike, bicycle, and e-bike. For purposes of these Terms, tuktuk/tuk-tuk means a three-wheeled passenger Vehicle and expressly includes an e-trike. Bicycles and e-bikes may be arranged for short-distance transportation and/or where specifically requested by the Client, subject to Provider availability, route suitability, Client requirements, applicable safety considerations, and confirmation of the booking.

Advance bookings must be reconfirmed on the day before the scheduled Service. Bookings first made within three calendar days of the Service are non-refundable. No prorated refund is due merely because a land-tour destination is skipped or modified for safety, weather, road, authority, or reasonable Provider operational reasons.

If anything is unclear, obtain clarification before payment. If you disagree with an applicable provision, do not proceed with the Service.
